AN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON BOTH SIDES
OF FOUNTAIN AVENUE (17TH STREET), FROM THE NORTH PROPERTY LINE OF BROAD-
WAY TO THE SOUTH PROPERTY LINE OF MONROE STREET, IN THE CITY OF PADJCAH,
KENTUCKY, FOR THE COST OF CONSTRUCTION OF A HARD SURFACE ROADWAY CONSIS"
TING OF A CONCRETE FOUNDATION WITH SHEET ASPHALT TOP, AS SHOWN ON PLANS,
TOGETHER WITH THE NECESSARY MANHOLES, INTAKES, DRIVE WAYS, CATCH BASINS
AND SEWER PIPE CONNECTIONS, AND ALSO THE RE -CONSTRUCTION OF NECESSARY
CURBS AND GUTTERS, EXCEPT THAT PORTION TO BE PAID FOR BY THE CITY OF
PADJCAH, AND PROVIDING THAT SAID COST MAY BE PAID FOR IN TEN AN1'UAL IN-
STALLMENTS IN COMPLIANCE WITH THE PROVISIONS OF THE KENTUCKY STATUTES AP-
PLICABLE THERETO.
WHEREAS, the General Council of the City of Paducah, Kentucky,
has heretofore to -wit; on the 20th day of April, 1927, adopted an ordinance,
entitled, "AN ORDINANCE PROVIDING FOR THE IMPROVFII:'ENT OF FOUNTAIN AVENUE
(17TH STREET), FROM THE NORTH PROPERTY LINE OF BROADNAY TO THE SOUTH PRO-
PERTY LINE OF MONROE STREET, IN THE CITY OF PADJCAH, KENTUCKY, BY THE CON
STRUCTION OF A HARD SURFACE ROADNAY, TOGETHER WITH ALL NECESSARY MANHOLES,
INTAKES, CATCH BASINS AND SEVIER PIPE CONNECTIONS, AND ALSO THE RE -CONSTRUCT
TION OF CURBS AND GUTTERS WHEREVER NECESSARY; AS SHWON ON PLANS, IN AC-
CORDANCE WITH THE PLANS AND SPECIFICATIONS PROVIDED THEREFOR BY THE CITY
ENGINEER OF SAID CITY, AT THE COST OF THE ABUTTING PROPERTY OWNERS, AND
PROVIDING THAT THE COST OF SUCH CONSTRUCTION MAY BE PAID UNDER THE PRO-
VISIONS OF THE TEN YEAR PAYMENT PLAN; and,
WHEREAS, it was provided in such ordinance that the cost of

construction of said roadway, together with the necessary Tanholes, in-
takes, catch basins and sewer pipe connections, and also the reconstruction
of curbs and gutters wherever necessary, be paid for by the abutting pro -
party owners on both sides of said streets, except that portion to be paid
by the City of Paducah as required by law; and,
WHEREAS, pursuant to said ordinance a contract was entered into
I between the Southern Roads Company, of Birmingham, Alabama, and the City
of Paducah, on the 10th day of May, 1927, for the construction of same; ani,
WHEREAS, said contract has been completed and duly accepted
by the General Council on the First day of August, 1927, pursuant to the

recommendations of the Board of Public Works of said City; NOW,
THEREFORE,
BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF

PADUCAH, KENTUCKY:
SECTION 1.
That all property on both sides of Fountain Avenue (17th Street),
from the north property line of Broadway to the south property line of
Monroe Street, in the City of Paducah, Kentucky, be, and the same is, here,
by assessed for the cost of construction of a hard surface roadway, con-

SECTION 2.
That the funds derived from the assessment of said property
shall be used for the purpose of paying off the snecial tax bills
issued against said property, or such bonds as may be issued by the
City of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky
Statutes.
SECTION 3.
That pursuant to Section 3101 of the Kentucky Statutes, said
tax assessment may, at the option of the property owners, be payable
in cash �Yithout interest within thirty days from the date of passage
and publication of this Ordinance, or in ten annual installments,
provided the property owners within thirty days enter into a written
agreement with said City, in accordance with the provisions of said
Section 3101 of the Kentucky Statutes.
SECTION 4.
In order to provide the funds for the Immediate payment of
the cost of that portion of the special assessments herein provided
for, which may be paid on the ten year installment plan, as herein=
above provided, the City of Paducah may issue and sell improvement
bonds, and to secure the payment of such bonds, there is hereby pledged
such taxes and liens on the property assessed herein for the payment
of principal and interest, but such bonds shall not be sold for less
than par, and the proceeds derived therefrom shall be applied ex-
c=usively to the payment of the cost of such construction as herein-
above provided; and such bonds, if issued, shall bear interest and
shall be payable in accordance with the provisions of Sebtion 3101
of the Kentucky Statutes.

as particularly shown by the City Engineers estimate of said cost
filed and apnroved by the General Council of.said City, and which will
I appear on file in the offices of the City Clerk and City Engineer,
respectively, and which are now referred to and made part hereof.
SECTION 2.
