COST OF SAPS ," which Was duly adopted on the 29th day of November, 1924,
wherein i is specified, among other things, that sanitary sewers be
constructe o and along the following named streets in said sewer zone,
in the 6ity o,. Paducah, Kentucky, to -wit:
"12th Street from present sewer at 12th and Caldwell
Streets northwardly to a point near Norton Street, a distance
of 350 feet from Caldwell Street.
11th Street from Husbands Street northwardly to a point
near Norton Street, a distance of 770 feet.
10th Street from Husbands Street northwardly to a point
near Norton Street, a distance of 770 feet.
10th Street from Husbands Street southwardly to a point
in Elizabeth Street, or Elizabeth Street, if extended, a distance
of 1670 feet.
9th Street from Husbands Street northwardly to a poiint near
Norton Street, a distance of 763 feet.

point 190 feet eastward from Caldwell Avenue to a point 190
feet westward from Caldwell Avenue.
Caldwell Avenue from Caldwell Street to a point 830 feet
southward from Caldwell Street and from Brown Street otherwise
known as Union Street northwardly, a distance of 298.42 feet
from the center line of Brown Street, otherwise known as Union
Street.

"Brown Street and that part of Brown Street known
as Union Street from Caldwell Avenue to Green Street.
Little Avenue, and that part of Little Avenue occupied
by the railroad tracks from the center line of Brown Street,
otherwise known as Union Street westward to a point in the
western right-of-way line of the Nashville, Chattanooga and
St. Louis Railway, which point is 132.5 feet westwardly from
the center line of Brown Street, otherwise known as Union Street."
Also the following additional lines necessary for the
extension and connection of said sewers in said sewer zone
#2, to -wit:
"On Caldwell Street; beginning at the manhole in 10th
Street and running thence westwardly in Caldwell Street, a
i distance of 300 feet.
On private property west of 3rd Street, commencing at
a manhole on the Relocation Island Creek Sewer at a point
179.5 feet east of 3rd Street; thence north 712 feet and south
298 feet.
On private property east of 3rd Street, commencing at
the manhole at the intersection of 4th Street and Broad Alley;
thence, northwardly 396 feet.
In alley between 9th and 10th Streets south from
Bachman Street, commencing at the manhole in Bachman Street at i
the alley between 9th and 10th Streets; thence south 190.5
feet, thence west 62.8 feet.
In Norton Street, commencing at the manhole in 5th
Street; thence west on Nlrton Street 300 feet," and,
WHEREAS, in accordance with said ordinance, it was
provided that the cost of construction of said sewers be paid by the
owners of lots or parcels of ground abutting or abounding upon said
streets and alleys, provided the cost of same does not exceed $2,00
per abutting foot, and all the lots or parcels of ground in said zone
are declared to be benefitted, and the entire cost of the construction
of said sewers shall be assessed against eacU of said lots or parcels
of ground located and embraced in said zone in the proportion that the
area in square feet of said lots or parcels of ground located in said'
zone; and the General Council shall fix and assess the amount of tax: on
each of said lots or parcels of ground in said zone as required by
law; and,
WHEREAS, Dursuant to said Ordinance a contract was
entered into on the 4th day of August, 1925, between the Koller
Plumbing Company of Ponca City, Oklohoma, and the City of Paducah,
Kentucky, for the construction of said sewers; and,
WHEREAS, the cost of construction of said sewers is
less than $2.00 per abutting foot; and,
WHEREAS, said sewer construction has been completed and,

duly accepted by the General Council on the 28th day of March, 1927,
pursuant to the recommendation of the Board of Public Works of said
City,
BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY
OF PADUCAH, KENTUL;KY:
NO. 954.
SECTION 1.
Tnat all of t',,e property located on both sides of each and
all of the streets hereinbefore described, be, and the same is hereby
assessed with the cost of construction of said sewers at the rate of
$1.2443679 per lineal foot as particularly shown by the estimate of such
cost prepared by the official engineers in charge of same and duly filed
and approved by the General Council of said City, and which estimate shois
all the lots or parcels.of ground assessed for such cost and the amount of
same, and is now referred to and made part hereof, and same will appear
on file in tine office of the City Clerk and the City Engineer.
SECTION 2.
That the funds derived from the assessment of said proper
shall -be used for the purpose of paying off the special tax bills issued
against said property or such bonds as may be issued by the City of
Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes
SECTION 3.

That pursuant to Section 3101 of the Kentucky:,Statutes, said
tax assessment may, at the option of the property owner, be paid in cash
without interest witnin thirty days after date of the passage and publication

of this ordinance, or in ten annual installments, proviided the owner
shall before the expiration of said thirty days enter into a written
agreement with said City in accordance with the provisions of Section 3101
of the Kentucky Statutes.
SECTION 4.
In order to provide a fund for the immediate payment of
the cost of that portion of the special assessments herein provided for,
representing the amount which the property owners have elected to pay
on the installment plan, as hereinabove provided, the City of Pad;cah
may issue and sell improvement bonds, +nd to secure the payment of said
bonds, there is hereby pledged such ta",xes and liens on the property
assessed herein for the payment of principal and interest, but such bondsl
small not be sold for less than par, and the proceeds derived therefrom

shall be applied exclusively to the payment of the cost of such construct9
as hereinabove provided; and such bonds, if issued, shall bear interest
and shall be payable in accordance with the provisions of Section 3101 of
Kentucky Statutes.

This ordinance shall take effect and be in force from and
after its passage, approval and publication.
