AN ORDINANCE ASSESSINd THli ABUTTING PROPERTY ON BOTH SIDES
OF CALDNELL STREET, FROM THE EAST PROPERTY LINE OF 12TH STREET TO THE
WEST PROPERTY LINE OF CALDNELL AVENUE ( 13TH STREET);, THENCE, ON
CALD'"JELL AVENUE, FROM THE SOUTH PROPERTY LINE OF SAID CALD'.";ELL AVENUE,
TO THE EAST LINE OF THE RIGHT-OF-WAY OF THE N. C. AND ST. L. R. R.
COMPANY, IN THE CITY OF PADUoAH, KENTUUKY, FOR THE DOST OF CONSTRUCTIION
OF A HARD SURFACE ROAD."JAY CONSISTING OF A CONCRETE FOUNDATION WITH A
SHEET ASPHALT TOP, AND CURBS AND GUTTERS AS SHOWN ON PLANS, TOGETHER
WITH THE NECESSARY MANIIOLES, INTAKES, DRIVEWAYS AND DRAINAGE CONNECTIONS,
EXCEPT THAT PORTION TO BE PAID FOR BY THE CITY OF PADUCAH, KENTUCKY,
AND PROVIDING THAT SAID COST MAY BE PAID IN TEN ANNUAL INSTALLMENTS
UPON COMPLIANCE I'-!ITH THE PROVISIONS OF THE KENTUCKY STATUTES APPLICABLE
THERETO.
WHEREAS, the General Council of the City of Paducah,
Kentucky, has heretofore, to -wit; on the 20th day of May, 1926,
adopted an ordinance, entitled, "AN ORDINANCE PROVIDING FOR THE
IMPROVEMENT OF UALDJELL STREET, FROhI THE EAST PROPERTY LINE OF 12TH

STREET TO THE ':;'EST PROPERTY LINE OF SAID CALDJJELL AVENUE ( 13TH STREET);
THENCE ON CALD.'JELL AVENUE, FROM, THE SOUTH PROPERTY LINE OF SAID
CALD'.;ELL AVENUE TO TIIE FAST LINE OF THE RIGHT -OF -PLAY OF THE N. C. &
ST. LOUIS RAILWAY, IN THE CITY OF PADUCAH, KENTUCKY, BY THE CON-
STRUCTION OF A HARD SURFACE ROADWAY, AND CURBS AND GUTTERS, TOGETHER
WITH ALL NECESSARY MANHOLES, INTAKES, DRAIN AND SEVJER.PIPES AND DRIVE-
WAYS, IN ACCORDANCE WITH THE PLANS AND SPECIFIC,TIONS PROVIDED THERE-
FOR BY THE CITY ENGINEER, AT THE COST OF THE ABUTTING PROPERTY Ol°;NEP.S
AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION MAY BE PAID IN
ACCORDA UE ,7ITH THE PROVISIONS OF THE TEN YEAR PXUI$NT PLAN." and,
WHEREAS, it was provided in said ordinance that the cost of
construction of said right-of-way and curbs and gutters, togethe r
with necessary manholes, intakes, driveways and drainage.connections,i
be paid for by the abutting property owners on both sides of said
streets, except that portion to be paid by the City of Paducah as
required by law; and,

WHEREAS, pursuant to said ordinance a contract was entered
into on the 15th day of July, 1926, between the D. J. Ryan Construction
Company of Davenport, Iowa, and the City of Paducah, Kentucky, for
the construction of same; and,
WHEREAS, the said contract has been completed and duly
accepted by the General Council on the 6th day of June, 1927, pursuant
to recommendation of the Board of Public Works of said City, NOT!,
THEREFORE:

BE IT ORDAINED BY THE GENHFUt,L COUNCIL OH' THE CITY OF
PADUCAH, KE14TUuKY:
SECTION 1.
That all of the property on both sides of Caldwell Street, from
the east property line of 12th Street to the west property line of
Caldwell Avenue (13th Street); thence on Caldwell Avenue from the south
property line of said Caldwell Avenue to the east line of the right-of-
way of the N. C. and St. L. R. R. Company, in the City of Paducah, Kentu�ky,
be, and the same is hereby assessed for the cost of construction of a hard
surface roadway consisting of concrete foundation with sheet asphalt top,
and curbs and gutters as shown on plans, togetherwith all necessary manholes,
intakes, driveways and drainage connections as follows:
Caldwell Street , from the east property line of 12th Street
to the west oroperty line of Caldwell Avenue, paving per abutting
foot ........ $5.207842; curbs and gutters, per abutting foot ... $1.05748
Caldwell Avenue, from the south property line of Caldwell Street
to the east line of the right-of-way of the N. C. and St. L. R. R. Compaly,
paving per abutting foot........ 15.024466; curbs and gutters, per
abutting foot ......... $1.0838993, as particularly shown by the City
Engineer's Estimate of said cost, filed and approved by the General
Council of said City, and which will appear on file in the offices of the
City Clerk and City Engineer, respectively, and which is now referred tol
and made part hereof.
SECTION 2.
That the funds derived from the assessment of said property
shall be used for the purpose of paying off the special tax bills issued
against said property, or such bonds as may be issued by the City of
Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes.
SLCTION 3.
That pursuant to Section 3101 of the Kentucky, Statutes, said
tax assessments may, at the option of the property owners, be payable in
cash without interest within thirty days from the date of passage and
publication of this Ordinance, or in ten annual installments, provided
the property owners within thirty days enter into a written agreement
with said City, in accordance with the provisions of said Section 3101
of the Kentucky Statutes.
SECTION 4.
In order to provide the funds for the immediate payment of
the cost of that portion of the special assessments herein provided for
which may be paid on the ten year installment plan, as hereinabove pro-
vided, the City of Paducah may issue and sell improvement bonds, and to
secure the payment of such bonds, there is hereby pledged said taxes and

liens on the property assessed herein for the payment 'o£ principal and
interest, but such bonds shall not be sold for less than par, and the
proceeds derived therefrom shall be applied exclusively to the payment
of the cost of such construction as hereinabove provided; and such
bonds, if issued, shall bear interest and shall be payable in accor-
dance with the provisions of Section 3101 of the Kentucky Statutes.
SECTION 5•
This Ordinance shall
take effect and be in force from and
