IIAN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON BOTH SIDES OF 12TH STREET, FROM THE SOUTH PROPERTY LINE OF BROADWAY TO THE NORTH PROPER TY LINE OF KENTUCKY AVENUE; 13TH STREET, FROM THE NORTH PROPERTY LINE OF JEFFERSON STREET TO THE NORTH PROPERTY LINE OF MONROE STREET; MONROE � STREET FROM THE WEST PROPERTY LINE OF 12TH STREET TO THE EAST PROPERTY LINE OF 13TH STREET, IN THE CITY OF PADUCAH, KENTUCKY, FOR THE COST OF CONSTRUCTION OF A HARD SURFACE ROAD,JAY, CONSISTING OF A CONC?:�ETE FOUNDATION '".'ITH A.SHEET ASHPHALT TOP AS SHOI.9N ON PLANS; THAT PORTION TO BE PAID FOR BY THE CITY OF PADUCAH, KENTUCKY, AND PROVIDING THAT SAID COST MAY BE PAID IN TEN ANNUAL INSTALLMLNTS UPON COMPLIANCE 17ITH THE PROVISIONS OF' THE KENTUCKY STATUTES APPLICABLE THERETO. I WHEREAS, the General Council of the City of Paducah, Kentucky, has heretofore, to -wit; on the 25th day of February, 1927, adopted an ordinance, entitled, "AN ORDINANCE PROVIDING FOR THE IMPROVEMENT OF 13TH STREET, FROM THE NORTH PROPERTY LINE OF JEFFERSON STREET TO THE NORTH PROPERTY LINE OF MONROE STREET; MONROE STREET, FROM THE ''Eglt� PROPERTY LINE OF 12TH STREET TO THE FAST PROPERTY LINE OF 13TH STREET; 12th Street FROI4 THE SOUTH PROPERTY LINE OF BROADI'!AY TO THE NORTH PROPERTY LINE OF KENTUCKY AVENUE, IN THE CITY OF PADUCAH, KENTUCKY, BY THE CONST?UCTION OF A HARD SURFACE ROAUSAY, IN ACCORDANCE WITH THE PLANS AND SPECIFICATIONS PROVIDED THEREFOR BY THE CITY ENGINEER, AND WHICH PLANS AND SPECIFICATIONS WILL APPEAR ON FILE IN THE OFFICE OF THE CITY ENGINEER, AT THE COST OF' THE ABUTTING PROPERTY OWNERS, AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION MAY BE PAID IN ACCORDANCE LITH THE PROVISIONS OF THE TEN YEAR PAYMENT PLAN;" and, WHEREAS, it was provided in s,,,id ordinance that the cost of construction of a hard surface roadway, be paid for by the abutting property owners on both sides of said street, except that portion to be paid for by the City of Paducah as required by law; and, WHEREAS, pursuant to said ordinance a contract was entered into on the 18th day of March, 1927, between D. J. Ryan Construction Company of Davenport, Iowa, and the City of Paducah, Kentucky, fmr the construction of same; and, WHEREAS, said cnntr�L4 hn�ybeen completed and duly accepted by the General Council on the 6tfi`d6yJof June, 1927, pursuant to a recommendation of the Board of Public Works of said City, NOW, THEREFOHE,I BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That all: of the property on both sides of 12th Street from the south property line of Broadway to the North property line of Kentucky Avenue; 13th Street from the north property line of Jefferson Street to i the north property line of Monroe Street; Monroe Street from the west property line of.' 12th Street to the east property line of 13th Street, NO. 935. in the City of Paducah, Kentucky, be, and the same is hereby assessed for the cost of construction of a hard surface roadway consisting of a concrete foundation with a sheet asphalt top, as shown on plans as I'i follows: 12th Street from the south property line of Broadway to the north property line of Kdntucky Avenue per lineal foot $3.9142396. 13th Street from the north property line of Jefferson Street to the north property line of Monroe Street per lineal foot, $,4.9022424. Monroe Street from the west property line of 12th Street to the east property line of 13th Street per lineal foot, `5.2428529, as particularly shown by the City Engineer's estimate of said cost, filed and aprroved by the General Council of said City, and which will appear on file in the offices of the City Clerk and the City Engineer respec- tively, and which is now referred to and made part hereof. SECTION 2. That the funds derived from the assessment of said property shall be used for the purpose of paying off the special tax bills issued against said property, or such bonds as may be issued by the City of Paducah Kentucky, pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, said tax assessments may, at the option of the property owners, be payable in cash without interest within thirty days from the date of passage u and publication of this Ordinance, or in ten annual installments, provided the property owners.within thirty days enter into a written I agreement with said City, in accordance with the provisions of said Section 3101 of the Kentucky Statutes. SECTION 4. In order to provide the funds for the immediate payment of the cost of that portion of the aliec�ial assessments herein provided for:, which may be paid on the ttti-;.yemi installment plan, as hereinabove provided, the City of Paducah may issue and sell improvement bonds, ^as to secure the payment of such bonds, there is hereby pledged such taxes and liens on the property assessed herein for the payment of principal and interest, but such bonds shall not be sold for less than par, and the proceeds derived therefrom shall be applied exclusively to the payment of the cost of such construction as hereinabove provided; and such bonds, if issued, shall bear interest and shall be payable in aceprdance with the provisions of Section 3101 of the Kentucky Statutes.
