WHEREAS, the General Council of the City of raducah has here- tofore, after adoption of resolution as required by law, duly adopted an ordinance, entitled, "Ali O_'ZDINANCE PROVIDING ZO-i THE CONaTRUCTION OF STOild,l WATER SE',JERS IN Sr ER ZONE 110. 8, SUB -DIVISION "B", IN SANITARY DISTRICT NO. 3, IN THE CITY OF PADUCAH, :2N2UCZY, AT THs COST OF '.HE ABUTTING PiiOPERTY Oti'iNERS TH i2EIN, AND PROVIDING THAT SAID SEWER SHALL BE CONSTRUCTED UP014 THE TEN YEAR PAYI:IENT PLAN, AIM NA1,1ING THE SMEETS AND ALLEYS ALONG, UNDER AND THROUGH WHICH SAID SEWERS SHALL BE CONSTRUCTED, AND SETTING OUT IN GENERAL TERLS THE PstOPERTY BENEFIT^^T D THEREBY, AND SUBJECT TO THE. PAYIIENT OF Tim' COST OF SMITE," which was duly adopted October .22nd, 1926, wherein it is provided, among other things, that storm water sewers be constructed in said sewer zone therein described by metes and bounds, and hereinafter described, and wherein the streets and alleys on and along which said sewer shall be constructed are named and designated as follows, to -wit: "On Caldwell Street commencing at the east property line of 12th Street and running thence eastwardly on Caldwell Street to a point 20 feet east of the west line of 8th Street in Caldwell Street. Oh 11th Street commencing at the proposed sewer in Caldwell Street and running thence southwardly to a point in Husbands Street 425 feet from the proposed sewer in Caldwell Street. On 11th Street commencing at the proposed sewer in Caldwell Street and running thence northwardly in 11th Street to a point 4�5 feet from the proposed sewer in Caldwell Street. On 10th Street commencing at the proposed sewer in Caldwell Street and running thence northwardly in 10th Street to a point 445 feet from the proposed sewer in Caldwell Street. On 10th Street commencing at the proposed sewer in Caldwell Street and running thence southwardly in 10th Street to a point 300 feet, measured on 10th Street south of the center of Bachman Street. On 9th Street commencing at the proposed sewer in Caldwell Street and running thence northwardly in 9th Street to a point 445 feet from the proposed sewer in Caldwell Street. On 9th Street commencing at the proposed sewer in Caldwell Street and running thence southwardly in 9th Street to a point in the center line of Rachman Street as it is platted east of 9th Street. No. 923. On 8th Street commencing at the proposed sewer in Cald- well Street and running thence northwardly to a point in 8th Street 445 feet from the proposed sewer in Caldwell Street. On 8th Street commencing at the proposed sewer in Cald- well Street and running thence southwardly to a point in 8th Street 430 feet from the proposed Sevier in Caldwell Street. On Husband Street commencing at the proposed sewer in 8th Street and running thence eastwardly to a point in 7th Street 412 feet from the proposed Sevier in 8th Street. On 7th Street commencing at the proposed Sevier in Husbands Street and running thence southwardly to a point in 7th Street 460 feet from the proposed sewer in Husband Street". WHEREAS, said Sevier Zone No. 8, as described in said Ordinance is particularly described as follows, to -wit; "Beginning at the intersection of the center line of Caldwell and 12th Streets; thence on the center line of 12th Street, in a northwardly direction, to a point 180 feet north of the north line of Ualdwell Street; thence in an eastwardly direction on a line 180 feet north of and parallel to the north line of Caldwell Street to the center line of the alley in Block No. 11, and running North and South between 12th and 11th Streets; thence in a northwardly direction on the center line of said alley and the center line of the alley in Block No. 10 to a point 192 feet north of the north line of Norton Street; thence in an eastwardly direction on a line 192 feet north of and parallel to the north line of Norton Street to the center line of 10th Street; thence in a southwardly direction on the center line of 10th Street to a point at the intersection of the center line of 10th Street and the east and west alley in Block No. 2 between Norton and )ones Stredts• thence in an eastwardly direction on said center line of the alley in Block Ido. 2, and this center line extended to a point 173.25 feet east of the east line of 8th Street; thence southwardly from this point on a line 173.25 feet east of and parallel to the east line of 8th Street to a point 173.25 feet north of the north line of Husbands Street; thence in an eastwardly direction on a line 173.25 feet north of and para_ 11el to the north line of Husband Street to a point 173.25 feet east of the east line of 7th Street; thence southwardly on a line 173.25 feat east of and parallel to the east line of 7th Street to a point on the center line of I,Iurray Avenue - thence in a westwardly direction on the center line of Murray Avenue, and this center line extended to the center line of the north and south alley between 7th and 8th Streets; thence in a southwardly direction on the center line of the said allay to a point 240 feet north of the north line of Bachman Street; thence in a westwardly direction on a line 240 feet north of and parallel to the north line of-)achman Street to the i center line of the north and south alley between 8th and 9th Streets; thence in a southwardly direction on said Center II line and this line extended to the center line of the east and wast alley between Bachman and fisher jtreats; thence in I' a westwardly direction on the center line of said alley to the center line of 9th Street; thence on the center line of 9th Street to a point 167,5 feet south of the south line of Bachman Street; thence in a westwardly direction on a line 167.5 feet south of and parallel to the south line of Bachman Street to a point 174 feet east of the east line of 10th. Street; thence southwardly on a line 174 feet east or and parallel to the east line of 10th Street to a point on the north line of .Elizabeth Street; thence in a wast,vardly direction on the north line of Elizabeth Street and said j north line extended to a point 150 feet west of the wast line of 10th Street; thence in a northwardly direction on a line 150 feet west of and parallel to the west line of 10th Stru t to a point 146 feet south of the south line of usband Street; thence in a westerardly direction on a line 14' feet south of and parallel to the south line of-and-=paralla1 to the south 4ins--o€- husbands Street to a point 172.5 feet west of the west line of 11th Street; thence in a northwardly direction NO. 924. on a line 172.5 feet west of and parallel to the west line of 11th Street to a point 180 feet south of the south line of Caldwell Street; thence in a westwardly direction on a line 180 feet south of and parallel to the south line of Caldwell Strout to a point on the center line of Caldwell Street; thence north- aardly on the center line of Caldwell Street to the point of beginning," and iVH',Ii AS, in accordance with said ordinance, it was provided that lIthe cost of constructing said sewers shall be apportioned equally to the abutting property or parcels of land according to the number of feet abutting thereon, provided the cost of same should not exceed .,2.00 per abutting foot. That in the event the cost of said improvement should exceed ?2.00 per abutting foot, than all of the lots or parcels of ground in said Zone are declared to be the property benefitted, and the entire cost of said Sevier shall be assessed against each of said lots or parcels of ground embraced in said Zone in the proportion that the area in square feet of such lots or parcels of ground shall bear to the area in square feet of all of the lots or parcels of ground located in said Zone; and further that the General Council shall fix and assess the lamount of tax to be levied upon each of said lots or parcels of ground in said Zone as required by law; and, I WH-Eii AS, bursuant to said ordinance a contract was entered into I on the 19th day of January 1927, between the I;ic2elvey Construction Company, of St. Louis, Missouri, and the City of raducah, _,entucky, for the construction of said sewers; and, WHEREAS, the cost of construction of said sewers was in excess i of `'?2.00 per abutting foot, and therefore must be assessed against all of the property in said sewer zone upon an area basis as hereinabove mentioned; and, WHEREAS, said Sevier construction has been completed and duly accepted by the General Council on the 16th day of may 1927, pursuant to the recommendation of the Board of Public 1I1orks of said City; BE I'T ORDAINED BY TIE GEMEiAL COU14CIL Or THE CITY OF �4DUCAH; XENTUC: Y. SECTION 1. That all of the lots or parcels of ground located in said sewer Zone -No. 8, as hereinabove described, be, and the same are hereby assessed for the cost of vonstruction of said sewers at the rate of x.013310044 per square foot as particularly shown by the estimate of such cost pre_ pared and certified by the official engineer in charge of and supervising;' same, which has been duly filed and at:proved by the General Council of said City, and which report and estimate shows all of the lots or parcels' of ground assessed for such cost and the amount of same, and the same is now referred to and made part hereof, and will appear on file in the No. 925. Offices of the City Clerk and the City Engineer of said City. SECTION 2. That the funds derived from the assessment of said property ;shall bg used for the purpose of paying off the special tax trills !issued against said property or such bonds as may be issued by the City of Paducah, Kentucky, pursuant to Section 3101 of the fentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Zentucky Statutes, said tax assessment may, at the option of the property owner, be paid in cash without interest within thirty days after date of the passage and publication of this Ordinance, or in ten annual installments, provided the property owner shall before the expiration of said thirty days, enter into a written agreement with said City in accordance with the provisions of Section 3101 of the Zentucky Statutes. SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein provided for representing the amount which the property owners have elected to pay 'I on the installment plan, as hereinabove provided, the City of raducah.l may issue and sell improvement bonds, and to secure the payment of said bonds, there is hereby pledged such taxes and liens on the property assessed herein for the payment of principal and interest, j but such bonds shall not be sold for less than par, and the proceeds I ,!derived therefrom shall be applied e.rclusively to the payment of the cost of such construction as hereinab)ve provided; and such bonds, i£ issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the i:entuctiy Statutes.
