WHEREAS, the General Council of the City of Paducah has heretofore, after adoption of resolution as required by law, duly adopted. I an ordinance, entitled, "AN ORDINANCE PROVIDING FO"3 THE CONSTRUCTION OF STORId AND SANITARY SF1".'F,RS IN SE1."ER Z(!NE I.O. 4, SUB -DIVISION "A", SE -VIER DI`;TRICT NO. 3, IN 'THE CITY OF PADUCAH, KENTUCKY, AT THE COST OF THE ABUTTING PROPERTY OP{NXRS THEREIN, AND PROVIDING THAT SAID SEWER SHALL BE CONS-7UCTED UPON THE TEN YEAR PAYP,fENT PLAN, AND NAMING THE STREETS AND ALLEYS ALONG, UNDER AND THROUGH WHICH SAID SEWERS SHALL BE CONSTRUCTED, AND SETTING OUT IPI GENERAL TERES THE PROPERTY BENEFITTED THEREBY, AND SUBJECT' TO THE PAYMENT OF THE COST OF SAJ,&', wnl-ich was duly adopted May 11th, 1925, wherein it is provided, among other things, that storm and sanitary sewers be constructed in said sewer zone therein described by metes and bounds, and hereinafter described, and wherein the streets and alleys on and along which said sewer shall be constructed are named and designated as follows to -wit: I "On 25th Street, commencing at the praposed sewer on Jefferson Street and running thence southwardly on 25th Street, a distance of 370 feet from the center line of Jefferson Street. On 24th Street, commencing at the present trunk line sewer on 24th Street and the Hinkleville Road, and running thence north- wardly along 24th Street, crossingLindsey and Kruger Streets and to the south property line of Mildred Street, a total distance of approximately 1625 feet from the center line of the Hinkleville Road. On 23rd Street, commencing at the proposed sewer on Jefferson Street and running thence southwardly on 23rd Street to the center line of an alley, which lies between Jefferson Street and Broadway and which runs parallel thereto, a distance of 220 feet from the center line of Jefferson Street to the center line of said alley. On 23rd Street, commencing at the proposed sewer on Kentuck� e cent Avenue and running thence northwardly on 23rd Street to th er line of an alley w�ich lies between Broadway and Kentucky Avenue and which runs parallel thereto, a distance of 206 feet from the center line of Kentucky Avenue to the center line of said alley. On 23rd Street, commencing at the present trunk line sewer on tle Hinkleville Road and running thence northwardly on 23rd Street, crossing Lindsey and Kruger Streets and to the center line, of Mildred Street, a total distance of approximately 1612 feet from the center line of the Hinkleville Road to the center line ofl Mildred Street. On 22nd Street, commencing at the present trunk line sewer on the Hinkleville Road and running t1ence northwardly on 22nd Street, crossing Lindsey and Kruger Streets and to the center line' of Mildre:l Street, a total distance of 1583 feet from the center line of the Hinkleville Road to the center line of Yildred Street.) On C Street, commencing at the proposed sewer on Guthrie Avenue or 19th Street, and running thence southwardly on C Street to the center line of Vheeler Avenue, a distance of 540 feet from the center line of Guthrie Avenue or 19th Street, to the center line of 17heeler Avenue. On B Street, commencing at the proposed sewer on Wheeler Avenue and running thence northwardly on B Street, a distance of280 feet from the center line of V -*6 eler Avenue. On 6Jheeler Avenue, commencing at the proposed sewer on B Street and running thence northwestwardly to the center line of "C" Street, a distanbe of 396 feet from the center line of B Street. On Guthrie Avenue or 19th Street, commencing at the pre trunk line sewer at the center line of Jackson Street and running thence southeastwardly along Guthrie Avenue or 19th Street, crossing 0, B and A Streets, to a point 40 feet north- westward from the center line of the Mayfield Road or Goebel Avenue, a total distance of approximately 1324 feet from the center line of Jackson Street. In an alley lying between 17th and 19t1- Streets and running parallel thereto, commencing at a point in said alley at a distance of 130 feet southward from the center line of Jeffe*,son Street and running thence southwardly along thealley on a line 211 feet westward from the center line of 17th Street, and parallel thereto, a distance of 195 feet to a point 90 feet northward from the center line of Broadway, crossing an intersecting alley which lies between Broadway and Jefferson Street and wbrich runs parallel thereto. On 16th Street, commencing at the proposed sewer on Clack Street and running thence southwardly on 16th Street, a distance of 350 feet from the center line of Clark Street. On 16th Street, commencing at the present trunk line sewer on Clay Street and running thence southwardly on 16th Street, crossing Harrison and 14adison Streets to the center line of Monroe Street, a distance of approximately 1233.6 feet. On 15th Street, commencing at the present trunk line sewer on Clay Street and running thence southwardly on 15th Street, crossing Harrison, Madison and Monroe Streets to a point 190 feet southward from the center line of Monroe: Street, a total distance of approximately 1455 feet. On Jackson Street, commencing at the end of the present trunk line sewer at the intersection of Guthrie Avenue, 19th Street and Jackson Street, and running thence southwardly and south - westwardly, conforming to the angle in Jackson Street, crossi.n,r,. 20th Street to the center line of 21st Street, a distance of approximately 937.8 feet. On Monroe Street, commencing* at the present trunk line sever on 19th Street and running thence eastwardly on Yonroe Street to the center line of 17th Street, a distance of approximately 722.5 feet. On the west side of Lang Park Circle at Madison Streetr; commencing at the end of the proposed sewer on Madison Street, which point is on the center line of Madison Street 495 feet eastward from the center line of 19th Street and running thence southeastwardly along the driveway of the Circle on a bearing of apnroximately South 57 degrees east, a distance of 120 feet from the center line of Madison Street at a distance of 495 feet eastward from the center line of 19th Street. On Madison Street, commencing at the proposed sewer on 16th Street and running thence westwardly on 2:;adison Street to a point in the driveway of Lang Park Circle, a distance of 520 feet from the center line of 16th Street. On the east side of Lang Park Circle at Madison Street, commencing at the end of the proposed sewer on Madison Street, which point is on th_'e'center line of Madison Street 520 feet westward, from the center line of 16th Street and running thence southeastwardly along the driveway of the Circle on a bearing of approximately South 7 degrees east, a distance of 160 feet from the center line of Madison Street at a distance of 520 feet westward from the center line of 16th Street. That in the event the cost of said improve- ` mens: should exceed X2.00 per abutting foot, then all of the lots or parcels of ground in said Ione are declared to he the property benefitted, and the entire cost of said sewer shall be assessed againit each of said lots or parcels of around embraced in said zone in the proportion that the area of square feet of such lots or par -els of ground shall bear to the area of square feet of all of the lots or parcels of ground located in said zone; and further that the General) Council shall fix and assess the amount of tax to be levied upon each, of said lots or parcels of ground in said zone as required by law; and, V,1HEREAS, pursuant to said ordinance a contract was entered into on the 8th day of August, 1925, between the Koller Plumhina Company, of Ponca City, Oklahoma, and the City of Paducah, Kentucky, for the construction of said sewers; and, VIHEREAS, the cost of construction of said sewers was in excess of N2.00 per abutting foot, and therefore migst be assessed against all the property in said sewer zone upon area basis as herein- ; .above mentioned; and, WHEREAS, said sewer construction has been completed and duly accepted by the General Council on the 2nd day of May, 1927, pursuant to the recommendation of the Board of Public V;orks of said City; BE IT ORDAINED BY THE BENERAL COUNCIL OF ThE CITY OF PADUCAII, KENTUCKY: SECTION 1. That all of the lots or parcels of ground located in said sewer Zone No. 4, as hereinabove described, be, and the same are hereby I' i assessed for the cost of construction of said sewer at the rate of i 4.020103059 per square feet as particularly shown by the estimate of such cost prepared and t certified by the official engineer in charge 6 of and directing same, which has been duly filed and approved by the i i General Council of said City, and which report and estimate shows alli of the lots or parcels of around assessed for such cost and the amount of same, and the same is now referred to and made part hereof, and , I will appear on file in the offices of the City Clerk and the City y iEngineer. � �SECTION 2. That the funds derived from the assessment of said property shall be used for the purpose of payinc, off the special tax bills issued against said property or such bonds as may be issued by the City of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky ■ r ■ NO. 900. STATutes. SECTION 3. That nursuant to Section 3101 of the Kentucky Statutes, said tax assessment may, at the option of the nroperty owncr, be paid in cash without interest within thirty days after date of the passage and publication of this ordinance, or in ten annual installments, provided the nroperty owner shall before the expiration of said thirty days enter into a written agreement with said City in accordance with the provisions of Section 3101 of the Kentucky Statutes. SECTION h. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein provided for representing the amount which the property owners have elected to pay on the installment plan, as hereinabove provided, the City of Paducah may issue and sell improvement bonds, and to secure the payment of said bonds, there is hereby pledged such taxes and liens on the property assessed herein for the payment of principal and interest, but such bonds shall not be sold for less than par, and the proceeds derived therefrom I i shall be a'onlied exclusively to the payment of the cost of such construction as hereinabove provided; and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes. SRCTIOid 5. The Assessment ordinance heretofore adopted Larch 31st, 1927, is h-reby repealed, and this ordinance shall take effect and be in force from and 'after its passage, approval and publication..
