AN ORDINANCE FURTHER AMENDING SECTION 37 OF AN ORDINANCE
ENTITLED "AN ORDINANCE TO CREATE AND ESTABLISH A FiuiA:CHISE TO CONSTRUCT,
OWN, ACQUIRE, MAINTAIN AND USE A 'PLATER .7ORKS PLANT AND WATER DISTRIBUTING
SYSTEM "'ITHIN THE CORPORATE LIMITS OF PADUCAH AND INVESTING THE PURCHASER
THEREOF WITH THE RIGHTS, POl^IERS AND PRIVILEGES HEREIN SET FORTH AND IMPOSING
UPON SUCH PURCHASER THE DUTIES AND RESPONSIBILITES SET OUT IN THIS ORDINANCE",
ADOPTED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, ON THE 22ND DAY
OF MAY, 1926, AND 'PPHICH ORDINANCE WAS AMENDED ON THE 19TH DAY OF JULY,
1926?
KENTUCKY:
BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH,
1.
That Section 37 of an Ordinance entitled "An Ordinance to
create and establish a franchise to construct, own, acquire, maintain and
use a water works plant and water distributing system within the corporate
limits of Paducah, and investing the purchaser thereof with the rights,
power and privileges herein set forth, and imposing upon such purchaser
the duties and responsibilities set out in this Ordinance" adopted by the
General Council of the City of Paducah, on the 22nd day of May, 1926, as
amended July, 1926, be and the same is hereby amended, by adding thereto:
the following-, words, to -wit;
"Provided the purchaser shall not be required
to complete the second intake mentioned in this
Section until December. 1st, 1929."
So that said Section as amended will read as follows:
SECTION 37.
The purchaser agrees to re -enforce the distributing system,
install meters and a second intake, and make other construction herein
outlined, at a total cost of approximately Three Hundred and Ten Thousanc
($310,000.00) Dollars and complete same as promptly as possible, but not
to exceed two and one-half years after the passage of this Ordinance.
Mains shall be laid in substantial conformity with the following:

Purchaser shall at all times operate its plant and
entire s73tem economically and efficiently. Purchaser shall have and
imaintain as near as possible, at all times during this franchise, a
plant and equipment and machinery that shall conform to modern,
i efficient and economical water works practice; but in making such
conformation, purchaser may consider the condition, adaptability of
machinery then in use, applicability of new inventions or new machine
or process to local conditions, number of customers, prospective
growth of plant and customers, and probable financial return, resulti
from such increased Investment.
If the purchaser fails in any of the obligations impose
upon it under this Section, all costs, expenses or outlay sustained
by purchaser in connection with the item or items involved in such
failure shall be disallowed as a part of operating cost or as an
addition to property value for rate making or depreciating purposes.
BE IT FURTHER ORDAINED that the Paducah Water Company,
the owner of the franchise so adopted by the General Council of
said City, on the 22nd day of Yay, 1926, be and it is hereby directed
not to lay a 12 inch water main on Ohio Street from 6th Street to
13th Street, and,
BE IT FURTHER ORDAINED that said Paducah Water Company
is directed and Quthorized.to lay a 12 inch water main on Caldwell
Street from 6th Street to the Union Station, and to lay an 8 inch
water main on the street immediately North of the Illinois Central
Railroad Company's "Y" which street is an extension of Coxey Street,
from the Un6on Station to the intersection of Lincoln Avenue and
Coxey Street, and

BE IT FURTHER ORDAINED that in all other respects
the Franchise of the Paducah Water Company, established under sadid
Ordinance, shall be binding upon said Paducah ';dater Company and the
City of Paducah, according to the terms therein set forth .
This amendment is adopted by the General Council of the
City of Paducah, with the knowledge and consent of the Paducah Water)
Company.

PROVIDED the purchaser shall not be required to complete
the second intake mentioned in this section until December 1st,
1929.
This ordinance shall take effect and be in force from and l�
after its passage, approval and publication.
