PIPE CONNECTIONS AND PROVIDING THAT THE COSTS OF SUCH CONSTRUCTION IS CHARGEABLE TO AND ASSESSED AGAINST THE PROPERTY ABUTTING THEREON AND RECEIVING THE BENEFIT OF SAME; AND ASSESSING THE PADUCAH RAILWAY COMPANY $2. 31518818 PER LINEAR FOOT? IN ACCORDANCE WITH LA -Vi AND THE TERMS OF ITS FRANCHISE, AS PARTICULARLY SHOWN BY THE CITY ENGINEERS ESTIMATE OF SUCH COSTS ON FILE, IN HIS OFFICE, AND PROVIDING THAT SUCH COSTS MAY BE PAID IN TEN ANNUAL INSTALLI+IENTS;.BEING ONE EACH YEAR FOR A PERIOD OF TEN YEARS. PROPERTY LINE OF 1VASHIXG-- TON STREET TO THE NORTH PROPERTY LINE OF CLARx STREET AND ON THIRD STREET FROM THE NORTH PROPERTY LINE OF MONROE STREET TO THE SOUTH PROPERTY LINE OF MADISON STREET, IN THE CITY OF PADUCAH, KENTUCKY, AT THE COST OF TEE ABUTTING PROPERTY OI;NERS, AND PROVIDING TH),T SA::E SHALL BE CONSTRUCTED UPON THE TEN YEAR PAYI,L NT PLAN"; and, WHEREAS, in accordance with said ordinance it was provided that the cost of construction of said streets be paid fon by the abutting Property Owners on both sides thereof, except that portion to be paid by the City of Paducah, Kentucky, and except that portion to be paid by the Paducah Railway Company as required by law and the provisions of its franchise; and, 'ViHEREAS, pursuant to said ordinance a contract was entered into on the day of June, 1923, by and between Yancey & Johnson, of Paducah,. Kentucky, for the construction thereof; and, WHEREAS, said contract has been completed and duly accepted by the General Council of the City of Paducah, Kentucky, on the 16th day of June, 1924, pursuant to the recommendation made therefor by the Board of Public Works of said City; NOVi, THEREFORE, BE IT ORDAINED BY TIIE GENERAL COUNCIL OF THE CITY OF PADUCA1% KENTUCKY: SECTION 1. That all of the property on botl: sides of the folloti'iing named streets in the City of Paducah, Iientucky, to -wit: Fourth Street from the North property line of Monroe Street to the South property line of Madison Street; Fourth Street from the South property line of Washington Street to the North property line of Clark Street ; Washington Street from the West property line of Fifth Street to the East property line of 6th Street; Monroe Street from the West property line of 5th Street to the East property line of 6th street; Monroe Street from the West property line of 5th Street to the East propebty line of 6th Street; Monroe Street from the West property line of 6th Street to the East property line of 7th Street; Kentucky Avenue from the ",ost No. y inances- property line of 9th Street to the East property line of 10th Street, or Murrell Boulevard; Tennessee Street from the West property line of Murrell Boulevard, or 10th Street, to the West property line of 12th Street; Monroe Street from the Ylest property line of 9th Street to a line parallel to and five feet eastwardly from the center of the East track of the I. C. R. R. Company, near 10th Street; I4onroe Street, from a line parallel to and five feet westwardly from the center of the West track of the I. C. R. R. Company, near 10th Street, to the East property line of 11th Street, and from the 'lost property lire of 11th Street to the East property line of 12th Street; 2nd Street from the South property line of Washington Street to the North property line of Clark Street; 3rd Street from the North property line of i;ionroe Street to the South property line of Lladison Street, be and the same is hereby assessed for the costs of construction of the driveway with concrete on said Streets, the sum of $4.856974 per abutting foot, as particularly shown by the estimate of such cost on file in the office of the City Engineer, now referred to and made a part hereof; and the Paducah Railway Company now owns and operates a line of rail -,';ay on and over said improved street on 11th Street from the South property line of Tennessee Street to the North property lire of said Street, and on 4th Street from the North property line of I,Ionroe Street to the South property line of Madison Street, and it, is assessed therefor in the sum of "2.31518618 per linear foot, and being a total sum of X963.16, as its proportionate part of the cost of said construction*" as required by franchise and the laws applicable thereto, which is also shown on said Engineer's Estimate of dost, on file in his office as aforesaid, and the tax is hereby levied upon all of the property, assets and franchise of all kinds whatsoever of said Paducah. Rai.lvey Company within the corporate,limiys,of said City, and said tax shall be due and payable at the same tithe anti in the same manner, and shall bear interest in like manner as such taxes assessed against the abutting property. SECTION 2. That the funds derived from the assessment of said property shall be used for the purpose of paying off the special tax bills issued against said property, or such bonds as may be issued by the City of Paducah, pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, said tax assessment may, at the option of the property owners, be payable in cash without interest, within 30 days from the date of the passage and recording of this ordinance, or in ten annual installments, provided No. V, Ordinances the property owners shall before the expiration of said 30 days enter into an agreement in writing with said City, in accordance with the provisions of said Section 3101 of the Kentucky Statutes. SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessment herein provided for, which may be paid for on the installment payment plan, as hereinbefore provided, the City of Paducah may issue and sell improvement bonds, aldd to secure the payment of which bonds there is hereby pledged, such taxes and liens on the property assessed herein for the payment of the principal and interest, but such bonds shall not be sold for less than par, and the proceeds thereof shall be applied exclusively to the pay- ment of the cost of said construction as hereinabove provided, and such bonds, if issued, shall bear interest and shall be payable in accor- dance with the provisions of Section 3101 of the Kentucky Statutes, as amended by Act of 1910. SECTION 5. This ordinance shall take effect and be in force after its passage, record and publication.
