AN ORDINANCE ASSESSING THE ABUTTING PROPERTY FOR THE
COST OF THE CONSTRUCTION OF' STORM AND SANITARY SEV.'ERS, IN SE:I'ER ZONE
#4, SUB -DIVISION "e", SEWER DISTRICT #3, IN THE CITY OF PADUCAH,
KENTUCKY, AND PROVIDING THAT THE PAYMENT OF SUCH COST MAY BE MADE IN
TEN ANNUAL INSTALLMENTS, 3EING ONE EACH YEAR FOR A PERIOD OF TEN
YEARS, UPON EXECUTION BY THE PROPERTY OWNERS OF AGREEMENT REQUIRED
BY LAW.
WHEREAS, The General Council of the City of Paducah
has heretofore, after adoption of resolution as required by law, dul:

DIVISION "A", SEWER DISTRICT #3, IN THE CITY OF PADUCAH, KENTUCKY,
AT THE COST OF THE PROPERTY 011TIERS THEREIN AND PROVIDING THAT THE SA:

SEWERS SHALL BE CONSTRUCTED UPON THE TEN YEAR PAYMENT PLAN, AND
NAUING THE STFF.ETS AND ALLEYS ALONG, UNDER AND THROUGH 'F'HICH SAID
SEWERS SHALL BE; CONSTRUCTED, AND SETTING OUT IN GENERAL TERMS THE
PROPERTY BENEFITTED THEREBY; AND SUBJECT TO THE PAYMENT OF THE COST
OF SAME", which was duly adopted November 29th, 1924, wherein it is
specified among other things, that storm and sanitary severs be
constructed on and along the following named streets in said sewer
zone'; in the City of Paducah, Kentucky, to -wit:
"Twenty-fifth Street from Jefferson Street southwardly
to the north property',)line of Broadway, a distance of 349.2 feet
Twenty-fourth Street, from Hinkleville Road northwardly
to Mildred Street, a distance of 1625 feet.
Twenty-third Street from Jefferson Street, southwardly to
an alley between Jefferson Street and Broadway, a distance of
192.5 feet.
Twenty-third Street from Kentucky Avenue northwardly to an
talley between Kerltucky Avenue and Broadway, a distance of 206.3
feet.
Twenty-third'Street from Hinkleville Road, northwardly to
Mildred Street, a distance of 1612 feet.
Twenty-second street from Hinkleville Road, northwardly to
Mildred Street, a distance of 1583 feet.
An alley between 20th Street and 21st Street and running
parallel thereto from Clark Street to a point near Adams Street,
a distance of 357.9 feet.

WHEREAS, in accordance with said ordinance, it was provided
that the cost of construction of said sewers be paid by the owners of
lots or parcels of ground abutting or bounding upon said streets and alleys,
provided the cost of same does not exceed $}2.00 per abutting foot, and

all of the lots or parcels of ground in said zone are drclared to be
benefitted, and in the event said cost of construction does exceed $2.00
per abutting, foot, then that the entire cost of the construction of said
sewers shall be assessed against each of the lots or parcels of ground
located and embraced in said zone in the proportion that the area in square
feet of such lot or parcel of ground shall bear to area in square feet
embraced in said sewer zone; and further that the General Council shall
fix and assess the amount of tax on each of said lots or parcels of ground
in said zones as required by law; and,
WHEREAS, pursuant to said Ordinance a contract was entered into
on the Sth day of August, 1925, between the Koller Plumbing Company, of
Ponca City, Oklahoma, and the City of Paducah, Kentucky, fbr the construction•
of said sewers; and,
WHEREAS, the cost of construction of said sewers is more than
$2.00 per abutting foot; and,
WHEREAS, said sewer construction has been completed and duly!
accepted by the General Council on the 21st day of ?.,',,arch, 1927, pursuant
to the recommendation of the Board of Public Works of said City;
BE IT ORDAINED BY THFI GENERAL COUNCIL OF THI CITY OF PADUCAH.I
KENTiTCKY:
SECTION 1.
That all of the property located on both sides of each and
all of the streets hereinbefore described, be, and the same is hereby
assessed with the cost of construction of said sewers at the rate of
$0.026103059 per square foot as particularly shown by the estimate of
such cost prepared by the official engineers in charge of same and duly
filed and approved by the General Council of said City, and which estima e
shows all the lots or parcels of ground assessed for such cost and the amqunt
of same, and is now referred to and made part hereof and same will appear
on file in the office of the City Clerk and the City Engineer.
SECTION 2.
That the funds derived from the assessment of said property
(shall be used for the purpose of paying off the special tax bills issued

iagainst said property or such bonds as may be issued by the City of Paducah,
Kentucky, pursuant to Section 3101 of the Kentucky Statutes.

SECTION 3.
That pursuant to Section 3101 of the Kentucky Statutes,
'said tax assessment may, at the option of the property owner, be paid in
(cash without interest within thirty days after date of the passage and

publication of this ordinance, or in ten annual installments, pro-
vided the property owner shall before the expiration of said thirty
days enter into a written agreement with said City in accordance wit
the provisions of Section 3101 of the Kentucky Statutes. '
IISECTION 4.

for representing the amount which the property owners have elected
Ito pay on the installment plan, as hereinabove provided, the City of
, Paducah may issue and sell improvement binds, and to secure the pay-
ment of said bonds, there is hereby pledged such taxes and liens on
the property .assessed herein for the payment of principal and
i' interest, but such bonds shall not be sold for less than par, and the
proceeds derived therefrom shall be applied exclusively to the paymer�
Iof the cost of such construction as hereinabove provided; and such
bonds, if issued, shall bear interest and shall be payable in accord 1,
with the provisions of Section 3101 of the Kdntucky Statutes.
SECTION 5.
This ordinance shall take effect and be in force
from and after its passage, approval and publication.
