AN ORDINANCE PROVIDING FOR THE IMPROVEMENT OF TRIMBLE STREET BY THE CONSTRUCTION OF CONCRETE SIDEWALKS ON BOTH SIDES THEREOF FROM THE WEST PROPERTY LINE OF 9TH STREET TO THE EAST PROPERTY LINE OF 10TH STREET, AND ON THF SOUTH SIDE THEREOF FROM THE WEST PROPERTY LINE OF 10TH STREET TO THE EAST PROPERTY LINE OF 16TH STREET, AND ON THE; NORTH SIDE THEREOF FROM THE WEST PROPERTY LINE OF 10TH STREET TO THE EAST CORNER OF OAK GROVE CEMETERY, EXCEPT THE INTERSECTIONS HERETOFORE CONSTRUCTED AND EXCEPT THAT PORTION THEREOF ABUTTING CALD.'!ELL PARK, WHICH HAS HERETOFORE BEEN IMPROVED; ALSO BY THE CONSTRUCTION OF CONCRETE GUTTERS AND CURBS OF EITHER CONCRETE OR G"ANITE, ACCORDING TO BID ACCEPTED, FROM THE WEST PROPERTY LINE OF 9TH STREET TO THE EAST PROPERTY LINE OF 10TH STREET, TOGETHER F4ITH ALL NECESSARY MANHOLES, INTAKES, SE�'1ER CONNECTIONS AND DRIVEWAYS, IN THE CITY OF PADUCAH, KENTUCKY, IN ACCORDANCE PITH THE PLANS AND SPECIFICATIONS PROVIDED THERFEOR BY THE CITY ENGINEER, AT THE COST OF THE ABUTTING PROPERTY OWNERS, AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION YAY BE PAID IN ACCORDANCE WITH THE PROVISIONS OF THE TEN YEAR PAYMENT PLAN. BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PA WuAH, KENTUCKY: SECTION 1. That Trimble Street from the west property line of 9th Street to the east property line of 10th Street, on both sides thereof, and thence on the south side thereof from the west property line of 10th' Street to the east property of 116th Street, end on the north side thereo from the west property line of 10th Street to the east corner of Oak Grove Cemetery, except the intersections heretofore constructed, and except that portion thereof abutting; Caldwell Park which has heretofore been improved; also by the construction of concrete gutters and curbs either of concrete or granite according to bid accepted, from the west property line of 9th Street to the east property lone of 10th Street, together with all necessary manholes, intakes, sewer connections and driveways, in the City of Paducah, Kentucky, in accordance with the plans and specifications provided therefor by the City Engineer, and whi plans and specification appear on file in the office of the City Enginee.7, and are now referred to and made part hereof as if specifically set fora} herein. SECTION 2. Said construction shall be made under the supervision and direction of the City Engineer and Board of Public Works of said City, and shall commence and be completed at the time designated by con tract. SECTION 3. The cost of such construction shall be paid for wholly by the property owners fronting thereon, to be apportioned to and assessed No. 849. against the prope^ter and the property owners abutting, thereon, acc I ing to the number of abutting feet thereon, except that portion to paid by the City of Paducah as is required by law. SECTION 4. 11 The contractor awarded the contract for the improvement herein provided for shall he paid in accordance with the terms and provisions of Sections 3096, 3100, 3101 and 3102 of the Kentucky i Statutes. I SECTION 5. The Mayor of said City is hereby authorized and directed f to executed contract and accept bond required to be executed by the contractor awarded the contract for such construction. I SECTION 6. I Bids shall be received for the improvement herein pro- vided for in accordance with the Plans and specifications made and Provided therefor by the City Engineer, and the contract therefor sha be awarded to the lowest and best bidder, except the right is reserve to reject any and all bids within the discretion of the General Council, and it may accept any bid which appears to be for the best I 1; interest of said City. l SECTION 7. The Board of Public Works is hereby authorized to i advertise for bids for the construction of said improvement, and to make report of same to the General Council, together with its recom-i mendation for the acceptance of any of same, or the rejection of all of same.
