ANORDINANCEASSESSING THE ABUTTING PROPERTY FOR THE COST OF i THE CONSTRUCTION OF STORM AND SLNITARY SEWERS, IN SEWER 90NE //5, • ;. SUB -DIVISION "A", SEWER DISTFICT #3; IN THE CITY OF PADUCAH,KRNT11CKY, AND PROVIDING THAT THE PAYMENT OF SUCH COST MAY BE MADE) IN TEN APINUlL INSTALLMENTS, BF'ING ONE EACH YEAR FOR A PERIOD OF TEN YEARS, UPON EXECUTION BY THE PROPERTY OWNERS OF AGREEf`ENT REQUIRED BY LASS. WHEREAS, the General Council of the City of Paducah has here- tofore, after adoption of resolution as required by law, duly adopt ed an ordinance, entitled, "AN ORDINANCE PROVIDING FOR THE CON- STRUCTION OF STORM AND SANITARY SEWERS, IN SEWER %ONE' #5, SUBDIVISION "A", SE'."ER DISTRICT #3, IN THE CITY OF PADUCAH, KENTUCKY, AT THE COST OF THE PROPERTY O"'NERS THEPEIN AND PROVIDING THAT THE SAID SE":ERS SHALL RE OONSTRUCTED UPON THE TEN YEAR PAYMENT PLAN, AND NADIING THE STREETS AND ALLEYS ALONG, UNDER hND THROUGH 7.HICH SAID SE15'ERS SHALL BE CONSTRUCTED, AND SETTING OUT IN GENERAL TERMS THE PROPERTY BENEFITTED THEREBY, AND SUBJECT TO THE PA`MENT OF THE; COST OF SAKE,'` which was duly adopted on the 11th day of December, 1924, wherein it is specified among other things, that storm and sanitary sewers be constructed on and along'the following named streets in said sewer zone, in the city of Paducah, Kentucky, to -wit: I "Rushing Street from Tully Avenue in a westerly direction to a point near Flournoy Street, a distance of 354.5 feet. 14th Street from Trimble Street in a westerly I direction to a point near Flournoy Street, a distance of i 1003.3 feet. Tully Avenue from 14th Street in a southerly direction to Rushing Street, a distance of 395 feet. In alley between 13th Street and 14th Street parallel thereto from Faxon in a westerly direction to a point near Willett Street, a distance of 370 feet. i In alley between 13th and 14th Street, and parallel thereto from Faxon in an easterly direction tr a point jnear Flournoy Street, a distance of 379 feet. Flournoy Street from the existing sewer at 11th and Flouf)noy Street southward to the existing sever on Flournoy, a distance of 154.6 feet. Ellis Street from 11th Street southward to 12th Street, a distance of 407.1 feet. Burnett Street from 7th Street southward to 8th Street, a distance of 491.9 feet. Burnett Street from 7th Street northward to 6th Street, a distance of 499 feet. Across private property from the 81 foot existing sewer at 10th and Flournoy.Streets southward to Flournoy Street and southward to Flournoy Street to 11th Street. 11th Street from Flournoy Street to Palm. Street. Burnett Street from 12th Street to the intersection of Burnett,Trimble and 15th Street. Across private property and City property from a point in the 81 foot existing sewer at 10th. dnd Flournoy Streets south- ward along the line of the 8 foot existing sewer to 12th Street and Burnett Street." WHEREAS, in accordance with said ordinance, it was provided that the cost of construction of said sewers be paid by the owners of lots or parcels of p7round abutting or bounding upon said streets and i alleys, provided the cost of same does not exceed x$2.00 per abutting j foot, and all the lots or parcels of ground 6n said zone are declared to. be benefitted, and the entire cost of the construction of said sewers shall be assessed against each of said.lots or parcels of ground loca.tedl and embraced in said zone in the proportion that the area in square j feet of said lots or parcels of ground shall bear to the area in square feet of lots or parcels of ground located in said zone; and the General Council shall fix and assess the amount of tax on each of said lots or parcels of ground in said zone as required by lav:; and WHEREAS, pursuant to said Ordinance a contract was entered into on the 8th day of August, 1925, between the Koller Plumbing Company,, of Ponca City, Oklohoma, and the City of Paducah, Kentucky, for the construction of said sewers; and, WHEREAS, the cost of construction of said sewers is less than $2.00 per abutting foot; and, 1MEREAS, said sewer construction has been completed and duly accepted by the General Council on the 3rd day of January, 1927, pursuant to the recommendation of the Board of Public Works of said City; BE IT ORDAINED BY TITh; GENERAL COUNCIL OF THP: CITY OF' , PADUCAH, KhVTTUCKY: SECTION 1. That all of the property located on both sides of each and NO. 793. all of the streets hereinbefore described, be, and the same is hereby i assessed with the cost of construction of said sewers at the rate of 1.9803739 per lineal foot as particularly shown by the estimate of such cost prepared by the official engineers in charge of same and I duly filed and approved by the General Council of said Uity, and whict estimate shows all the lots or parcels rf ground assessed for such cost and the amount of same, and is now referred to and made part hereof and same will appear on file in the office of the 'ity (Ilerk and the City Engineer. SECTION 2. That the funds derived from the assessment of said nroperty shall be used for the purpose of paying off the special tax bills issued against said property or such bonds as may be issued by the C1 Y of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutp� s. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, said tax assessment may, at the option of the property owner, be paid in cash without interest within thirty days after date of the passage and publication of this ordinance, or in ten annual installments, provided the property owner shall before the expiration of said thirty days enter into a written agreement with said City in accordanpe with the provisions of Section 3101 of the Kentucky Statutes. SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein provided for, representing the -mount which the property owners have elected to payl on the installment plan, as hereinabove provided, the City of Paducah may issue and sell improvement bonds, and to secure the payment of said i bonds, there is hereby pledged such taxes and liens on the property assessed herein for the payment of principal and interest, but such i bonds shall not be sold for less than par, and the proceeds derived therefrom shall be applied exclusively to the payment of the cost of such construction as hereinabove provided; and such bonds, if issued; shall bear interest and shall be payable in accordance with the pro- visions of Section 3101 of the Kentucky Statutes.
