WHEREAS, The General Council of the City of Paducah,
Kentucky, has heretofore, to -wit; on the 20th day. of May, 1926,
adopted an ordinance, entitled, "AN ORDINANCE PROVIDING FOR THE

PADUCAH, KENTUCKY, BY THE CONSTPUCTION OF A HARD SURFACE ROAD -TRAY,
TOGFTHER 6FITH ALL NECESSARY MANHOLES, INTAKES-, SEWER PIPES AND DRIVE -
NAYS IN ACCORDANCE :"ITH PLANS AND SPECIFICATIONS PROVIDED THEREFOR BY
THE CITY ENGINEER, AT THE COST OF TP.E ABUTTING PROFERTY OWNERS, AND
PROVIDED THAT THE COST OF SUCH CONSTRUCTION MAY BE PAID IN. ACCORDANCE
`ITH THE PROVISIONS OF THE TEN YEAR PAYMENT PLAN"
and,
1,7HEREAS, it was provided in such ordinance that the
cost of construction of said road -way, together with the necessary

manholes, intakes, driveways and drainage connections be paid for by
the abutting property owners -on both sides of said street, except that
portion to be paid by the City of Paducah as required by law; and,
WHEREAS, pursuant to said ordinance a contract was

entered into on the 15th day of July, 1926, between the D. J. Ryan
iConstruction Company, of Davenport, Iowa, and the City of Paducah,
Kentucky, for the construction of same; and, i
I' WHEREAS, said contract has been completed and duly
accepted by the General Council on the 20th day of December, 1926,

I pursuant to the recommendation of the Board of Public ZForks of said
City: NOS'!, THEREFORE,
BE IT ORDAINED BY THE GENERAL COUNCIL OF.
THE CITY OF PADUCAH, KENTUCKY:

SECTION 1.__

That all property on both sides of Clements Street
from the North property line of Bridge Street to the south property
line of Meyers Street in the pity of Paducah, Kentucky, be and the
same is, hereby assessed for the cost of the construction of a hard
surface road -way, consisting; of concrete foundation with the sheet

asphalt top wherever constructed, as shown on plans, together with all
necessary manholes, intakes, drive -ways and drainage connections, as
follows:

as particularly shown by the City Enpineer's estinate of said cost,
filed and approved by the General Council of said City and which will
appear on file in the offices of the City Glerk and the City Engineer,
respectively, and which is now referred to and made part hereof.
SECTION 11:
That the funds derived from the assessment of said property
shall be used for the purpose of pnyir_g off special tax bills issued
against said property or such bonds as may be issued by the City of
Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes.
SECTION 111;
That pursuant to Section 3101 of the ••entucky Statutes, said
tax assessments may, at the option of the property owner: be
paid in cash
without interest within thirty days from the date of passage and publication
of this ordinance, or in ten annual installments, provided the property
owners within thirty days enter into a written agreement with said City,
in accordance with the provisions of said Section 3101 of the Kentucky
Statutes.
SECTION 1V:
j In order to provide £he funds for the iTmediate payment of
the cost of that portion of the special assessments herein provided for,
which may be paid on the ten year installment plan, as hereinabove pro-
vided, the City of Paducah may issue and sell improvement bonds, and to
�I secure payment of such bonds, there is hereby pledged such taxes and
I
liens on the property assessed herein for the payment of principal and
interest, but such bonds shall not be sold for less than par, and the
proceeds derived Therefrom shall be applied exclusively to the payment
of the cost of such construction as heroin above provided; and such
bonds, if issued, shall bear interest and shall be payable in accordance
with the provisions of Section 3101 of the Kentucky Statutes. ,

SECTION V:
This ordinance shall take effect and be in force from
and after it's passage, approval and publication.
