JEFFERSON STREET TO THE SOUTH PROPERTY LINE OF MONROE STREET, TOGETHER WITH i ALL NECESSARY MANHOLES, INTAKES, CATCH BASINS eND SEV,'ER PIPE CONNECTIONS, IPI THE CITY OF PADUCAH, KENTUCKY, THE SUM OF 01.21 PER ABUTTING FOOT, FOR THE COST OF CONSTRUCTION OF SAID IMPROVEMENT, EXCEPT THAT PORTION TO BE PAID BY THE CITY OF PADUCAH, KENTUCKY, AND PROVIDING THAT SAID COST MAY BE PAID IN 10 ANNUAL PAYVENTS, BEING ONE EACH YEAR FOR THE PERIOD OF TEN YEARS. WHEREAS, the General Council of the City of Paducah has heretofore, to -wit: On the 10th day of September 1926, adopted an ordi- nance, entitled, "AN ORDINANCE PROVIDING FOR THE IMPROVEMENT OF 24TH STREET FROM THE NORTH PROPERTY LINE OF JEFFERSON STREET TO THE SOUTH PROPERTY LINE OF MONROE STREET , IN THE CITY OF PADUCAH, KENTUCKY, BY THE GRADING AND GRAVELING OF SAME, TOGETHER '"ITH ALL NECESSARY MANHOLES, INTAKES, CATCH BASINS AND SEWER PIPE CONNECTIONS, IN ACCORDANCE 11:'ITH THE PLAITS AND SPECIFICATIONS PROVIDED BY THE CITY ENGINEER, AT THE COST OF THE ABUTTING PROPERTY OWNERS, AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION MAY BE PAID IN ACCORDANCE WITH THE PROVISIONS OF THE TEN YEAR PAYA:ENT PLAN'; and, WHEREAS in accordance with said ordinance it was pro- j I vided that the cost of grading and graveling of said street be paid for I by the abutting property owners on both sides thereof, except that portion) to be paid by the City of Paducah, Kentucky, as required by law; and, WHEREAS pursuant to said ordinance a contract was entered into on the 28th day of September, 1926, and between Adams and Gholson, of Paducah, Kentucky, and said City of'Paducah, for the construc- tion thereof; and, WHEREAS said construction has been completed and duly accepted by the General Council on the 20th day of December, 1926, pursuant to recommendation of the Board of Public Works of said City„ NOV.', THEREFORE, BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That all property on both sides of 24th Street from the north property line of Jefferson Street to the south property line of ftnroe Street, in the City of Paducah, Kentucky, as specifically shown by the City Engineer's estimate of same, be, and•the same is hereby assessed Por the cost of construction by grading and graveling of said street, Lncluding all necessary manholes, intakes, catch basins and sewer pipe .onnections used in said construction, in the sum of $,1.21 per abutting ..loot. NO. 781. SECTION 2. That the funds derived from the assessment of said property shall be used for the purpose of paying off the special tax bills issued against said property, or such bonds as may be issued by the City of Paducah pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, said tax assessment may, at the option of the property owner, be paid in cash without interest within thirty days from the date of passage and publication of this ordinance, or in ten annual install- ments, provided the property owner shall before the expiration of I thirty days enter into a written agreement with said City in accor- dance with the provisions of the Section 3101 of the Kentucky Statutes. SECTION 4. y In order to provide funds for the immediate payment of the cost of that portion of the special assessment herein pro- vided for, which may be paid for on the installment plan, as herein- above provided, the City of Paducah may issue and sell improvement bonds, and to secure payment of such bonds there is hereby pledged I such taxes and liens on the propeg�v�,.assessed herein for the pay- ment of the principle and interest, but such bonds shall not be sold' for less than par, and the proceeds derived therefrom shall be applied exclusively to the payment of the cost of such construction as here- inabove provided, and such bonds, if issued, shall bear interest and shall be payable -in accordance with the provisions of Section 3101 of the Kentucky Statutes.
