HomeMy WebLinkAboutOrdinances Book 8, Page 767, No Ordinance NumberAN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON BOTH SIDES IOR 13TH STREET FROM THE NORTH PROPERTY LINE OF MONROE STREET TO THE kEST PROPERTY LINE OF ZILLETT STREET, IN PHE CITY OF PADUCAH, KENTU FOR THE COST OF CONSTPUCTION OF A HARD SURF4CE ROAD -WAY CONSISTING OF A CONCRETE FOUNDATION VITH A SHEET ASPHALT TOP, AND CURBS AND GUTTERS SHOWN ON PLANS, TOGEThRF 1ITH NECESSrRY VANHOLES, INTAKFS, DRIVE-'r:='.YS AND DRQNAGE CONNECTIONS, EXnEPT THAT PORTION TO BE PAID FOR BY THE CITY OF PADUCAH, KENTUCKY, AND PROVIDING THAT SAID COST MAY BE PAID IN TEN ANNUAL INSTnLLYENTS UPON COMPLIANCE TITH `_iIE PROVISIONS OF THE KENTUCKY STSTUTES APPLICABLE THERETO. ii ";iHEREAS the General Council of the City of Paducah, Kentuc' has heretofore, to -wit; on the 20th day of May, 1926, adopted an. ordinance, entitled, "AN ORDINANCE F'POVIDING FOR THE IMPROVVIENT ,OF 13TH STREET FROM THE NORTH PROPERTY LINE OF JEFFERSON STREET TO THE ':':iST PROPERTY LINE OF C;ILLETT STREET, IN THE CITY OF PADUCAH, KENTUCKY, BY THE CONSTRUCTION OF A HARD SURFACE ROAD -`PLAY AND ALL NEC- ESSARY CURBS AND GUTTERS, TOGETHER TITH NECESSARY YANPOLES, INTAKES, DEs.IrAGE CONNECTIONS AND DRIVETAYS, IN ACCORDANCE TITH THE PLANS AND SFECIFICATIONS PROVIDED THEREFOR BY THE CITY ENGINEER, AND WHICH PLANS AND SPECIFIuATIOES 'A'ILL APPEAR. ON FILE IN THE OFFICE OF THE CITY ENGINEER, AT TEL COST OF THE ABUTTING PROPERTY OI.NERS, AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION MAY BE PAID IN ACCORDANCE TITH THE PROVISIONS OF THE TEN YEAR, PlUnENT BLAN.";"and, WHEREAS, it was provided in such ordinance that the cost c :construction of said road -way, curbs and ,gutters, together with necessary manholes, intakes, drive -ways and drainage connections, be paid for by the abutting property owners on both sides of said street, 4 xcept that portion to be paid by the City of .Paducah as required by ,!'law; and, WHEREAS, pursuant to said ordinance a contr=ct was entered, ,S 01 iinto on the 15th day of June, 1926, between the D. J. Ryan Construction � 'Company, of Davenport, Iowa, and the City of Paducah, Kentucky, for the :construction of same; and, WHE.R!AS, there was by ordinance duly adopted by the General ,!Council of said City on the 8th day of October, 1926, eliminated from ;jsaid contract the block of such construction lying between Jefferson q and Monroe Streets; and, WHEREAS, said contract has been completed and duly accepted n i by the General Council on the 35th day of No -ember, 1926, pursuant to !recommendation of the Board of Public Forks of said City, NOW, THER&ORE, BE IT ORDAINED BY THF; GENERAL COUNCIL OF 'PHE CITY OF PADUCAH, KENTUCKY: NO. 768. SECTION 1. That all the property on both sides of 13th Street from the North property line of Monroe Street to V -.e west properi.y line of i'iillett Street, in the City•of Paducah, Kentucky, be, and the same is, hereby assessed for the cost of construction of a hard surface road --.,.,ay consisting of a concrete I foundation with the sheet asphalt top, and curbs and gutters wherever constructed, as shown on plans, together with all necessary manholes, intakes, drive -ways and drainage connections, as follows; From the north pr perty line of i,`.onroe M-reet to the south property line of Yadison Street, per lineal foot, $4.99886 From the north property line of Nadiscn Street to the south property line of Harrison Street, per lineal foot, 5.00915 From the north property line of Harrison Street to the south property line of Clay Street, per lineal foot, 4.97878 From the north proper -6y line of Clay Street to the south property line of Trin.ble Street, per lineal foot, 4.98988 From the north property line of Trimble Street to the south property line of Burnett Street, paving, per abutting foot, 5.01603 Curb and gutter, per abutting foot, 1.04952 Expansion ,joints, .02103 From the north property line of Burnett Street to the South property line of Flournoy Street, paving, 5.04788 From the north property line of Flournoy Street to the south property line of.Faxon Street, pavinE, abutting foot, 5.03571 From the north property line. of Faxon Street to the south property line of Willett Street, paving, abutting? foot, 5.00506 Curb and gutter, per abutting foot, 1.04964' "�- Expansion joints, " " " .01258 as particularly shown by the City Engineer's Estimate of said cost, filed and apnroved by the General Council of said City, and which will appear on file in the offices of the City Clerk and the City Engineer, respectively, ttnd which is now referred to and made part hereof. SECTION 2. That the funds derived from the assessment of said property shall be used for the purpose of paying off the special tax bills issued against ba -id property, or such bonds as may be issued by by the City of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, said tax assessments may, at the option of the property owner, be payable in cash without interest within thirty days from the date of passage and publication rf this ordinance, or in ten annual installments, provided NO. 769 the property owners within thirty thirty days enter into a written agreement with said City, in accordance v.ith the provisions of said Section 3101 of�thc Kentucky Statutes. SECTION 4. In order to provide the funds for the immediate payment of the cost of that portion of the special assessments herein pro- vided for, which may be paid on the ten year installment plan, as i hereinabove provided, the City of Paducah may issue and sell improver, bonds, and to secure the payment of such bonds, there is hereby pledged such taxes and liens on the property assessed herein for the payment of principal and interest, but such bonds shall not be sold for less than par, and the proceeds deriv,d therefrom shall be i, ii applied exclusively to the payment of the cost of such construction li as hereinabove provided; and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of II Section 3101 of the Kentucky Statutes.
