AN UiDINANCE CREATING SEVER ZONE #6, IN SUB -DIVISION %'" OF SE'r`;ER DISTRICT '#3, IN THE CITY OF PADUCAH, KENTUCKY, AND PROVIDING FOR THE CONSTRUCTION OF STORM aND SANITARY SEPiERS IN COMBINED FORM IN Sr_ID SE'!;'ER ZONE AT THE COST OF THE PROPERTY OV;NERS THEREIN, AND PROVIDING THAT SUCH SE'.'IERS SHALL BE CONSTRUCTED UNDER: THE PROVISIONS OF THE: TEN YEAR PAYIr!ENT PLAN, AND NAMING THE STREETS AND ALLEYS ALONG Ai:D UNDER ."HICH SAID SE":Eft SHALL BE CON`TRUCTED, l�ND SETTING OUT IPI GENERAL TERMS THE PROPERTY BENEFITTED THEREBY AND SUBJECT TO ASSESSMENT FOR THE PAYMENT OF THE COST OF SAI,:E. WHEREAS there has been created .and established in the City of Paducah, Kentucky, Sewer District #3, which has been divided into sub- divisions "A", "B" and "C"; and, 7VHEREAS a trunk line sewer has been constructed at the cost of the City of Paducah, in sub -division "A" of said Sewer District #3; and, WHEREAS the General Council of said City has heretofore adopted a resolution declaring the construction of such sewers in said Sewer Zone #6, in Sub -Division "et" of Sewer District #3, in said City, jto be a necessity; NOV.", THEREFORE, BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. There is hereby created Sewer Lone #6, in said Sub-divisi "A" of Sewer District #3, in the pity of Paducah, Kentucky, which is particularly described as follows, to -wit: "Beginning at a point 200 feel; South of the center line of Hinkleville Road and 154 feet west of the center line of 24th Street; thence ;,cstwardly on a line 200 feet south of and parallel to the center line of the Hinkleville Road to a point 48 feet west of the west line of 26th Street, extended; thence northwardly on a line 48 feet west of and parallel to the west line of 26th Street to the center line of the east and west alley in Block #7 of Thurman's NoblE Park Addition; 'thence westwardly on said center line of the east and west alley to the center line of the north and south alley ,just west of Block #7 of T%urman's Noble Park Addition; thence northwardly on said center line of the North and south alley 167.5 feet west of the west line with the center line of the alley between 26th Street and Thompson Avenue, lying I between Block No. 8 of Thurman's Noble Park Addition and Block No. 2 of P:adsworth Improvement Company's Addition,; thence North- wardly on the center line of said alley and the center line extended to the point of the intersection with the center lire of the alley first 'Y+est of Atkins Avenue, a line 173 feet west of and parallel to the west line of Atkins Avenue; thence northwardly on the center line of the alley first :vest of Adkins Avenue to its intersection with the center line extended of 13th Street; thence eastwardly on the center of 13th Street to a point 50 feet west of Atkins Avenue; thence northwardly on a line 50 .feet west of and parallel to the west line' of Atkins Avenue to the center line of Cairo Road; thence eastwardly on the center line of Cairo Road to itis intersection with the '^lest City Limits; thence northwardly on the ':est City Limits to a point at the intersection of the West City Limits line with a line 150 feet north of and parallel to the north line of Cairo Road; thence eastwardly on the line 150 feet north of and parallel to the north line of Cairo Road to the center line of Palm Street; thence southwardly on the center line of Palm Street and this line extended to a point 242.5 feet south of the center line of 13th Street; thence eastwardly on a line 242,5 feet south of and parallel' to the center line of 13th Street to a point 173 feet east of the east line of Bloomfield Avenue; thence southwardly along a line 173 feet east of and parallel to the east line of Bloomfield Avenue to the center line of Mildred Street; thence westwardly on the center line of Mildred Street to the point where it intersects the west boundary line of Thurmsn's Glenwood Addition; thence southwardly N0, 759 on the said west boundary of Thurman's Glenwood Addition tc the point of beginning." SECTION 2. i That Storm and Sanitary sevvers in combined form be construct along and under the streets and alleys, in said Sewer Zone ##6, in the City 8f Paducah, Kentucky, at the cost of the owners of property and the lots or parcels of ground located therein, and all of such lots or parcels of ground located in said zone are hereby declared to be the property benefitted and subject to assessment for the cost of suc' construction, and such streets and alleys along and under which said I sewers shall be constructed and named and described as follows, to-wi "On Mildred Street commencing at the manhole in 24th Street on the south line of Mildred Street and running thence eastwardly in P;:il3red Street to the center line of Bloomfield Avenue extended in Mildred Street. On Mildred Street commencing at the manhole in 24th Street on the sclatr line of Mildred Street and running thence ;:estwardly in Mildred Street to the center line of Atkins_venue. Oh Bloomfield Avenue commencing at the proposed sewer in Mildred Street and running thence northwardly to the south line of 13th Street. i On Langstaff Avenue commencing at the proposed sewer in Mildred Street and running thence north,::ardly on Langstaff Avenue and through private property to the center lire of Cairo Road. On Atkins Avenue commencing at the proposed sever in Yildred Street and running thence ncrthwardly to a point 50 feet south of the south line of Cairo Road. On 13th Street commencing at the proposed sever in Langstaff Avenue and running thence westwardly 350 feet on 13th Street. On Cairo Road commencing at the proposed sewer in Langstaff Avenue and extending through private property into the Cairo Road and running thence eastwardly on Cairo Road 625 feet. On Cairo Road commencing at the proposed sewer in Langstaff Avenue and extending through private property into Cairo Road and running thence westwardly on Cairo Road 430 feet. On Hinkleville :Road commencing at the manhole at the east line of 24th Street and running thence west;vardly to the center line of 26th Street. On 25th Street commencing at the proposed sewer in Hinkleville Road and running thence northwardly to a point 465 feet north of the center line of Kruger street. On 26th Street commencing at the proposed sewer in Hinkleville Road and running thence northwardly to a point 500 feet, north of the center line of Kruger Street. SECTION 3. The cost of the construction of said sewers shall be apportioned equally against the abutting lots or parcels of land, in said Sewer Zone #/6, as follows: :d G: NO. 760. 1st: All of the lots or parcels of ground bounding or abutting on the hereinabove named streets or alleys along or under which said sewers s) -all be constructed are hereby.declared to be the property benefitted thereby, and said cost shall be apportioned and assessed equally against said abutting lots or parcels of ground according to the number of abutting feet thereon, provided the cost of such construction shall not exceed $2.00 per abutting foot. 2nd.: In the event the cost of construction of said sewers shall exceed w2.00 per abutting foot along, said streets or alleys whereon said sewers shall be constructed, in said sewer zone, then such cost shall be apportioned against all of the lots or parcels of ground so benefitted by said construction, according to the area in square feet of the lots or land benefitted thereby. Notice is hereby given to the owners of all broperty in. said Sewer Zone #6, and all property bounding or abutting on said streets or alleys, that the cost of construction of said sewers will be assessed .against said property in the manner hereinabove provided, And said sewers shall be constructed in strict accordance with the plans ttnd specifications i provided by the City Lngineer of said City, and which have been heretofore adopted by the General Council of said City. SECTION 5. A blue print or plot showing the boundary of Sewer Zone #r6, and showing by name the streets embraced in said zone, and the line and course of the sewer to be constructed has heretofore been filed with the City Clerk of said City, and is now referred to and made part hereof. And for additional information, said blue print or plot will appear on file in the office of the City Engineer and may be inspected ad any time on application at that office. SECTION 6. Bids will be received for the construction of said sewers accordirp* to the plans and specifications provided therefor, and the contract for the construction of same shall be awarded to the lowest and best bidder, except the right is expressly reserved to reject any and all bids, within the discretion of the General Council, -nd it may accept any bid which appears to be for the best interest of the City of Paducah. SECTION 7. Said work shall be done under the direction and super- vision of the ',ity Engineer or the authorized engineer of said City, and the Board of Public Zorks of said City, or other authorized agents, and the same shall commence and be completed at the time designated by contract. NO. 761. SECTION S. The Contractor awarded the contract for the work herein provided shall be paid only from the funds arising_ from special tax I bills or assessments made against the property located in said serer zone, except said contractor may be paid out of such funds as may be issued according to lav: in accordance :IJitb the provisions of Section 3105, 3101 and 3102 of the Kentucky Statutes.
