5'hIEREAS the General Council of the City of Paducah, Kentucl
has adopted a resolution declaring the construction of storm water
sewers in Zones "A" and "B", hereinafter particularly described, in
Sanitary Sewer Distxict #1, of the City of Paducah, Kentucky, to be a
necessity;. NO.':", THEREFORE,
KENTUCKY:
BE IT ORDAINED BY THE GENERAL COUNCIL OF THF CITY OF PADUCA
SECTION 1.
That Storm Water Sewers be constructed under and along t
streets and alleys in Storm 'Fater Sewer Zones "A" and "B", respectively,
and hereinafter particularly described, in Sanitary Sewer District #1
in the. City of Paducah, Kentucky, at the cost of the abutting propert
and property owners in said Zones, and all of the lots or parcels of

land located in said Zones "A" and "B" are hereby declared to be the
property benefitted and subject to assessment for the payment of the
I cost of such construction.

SECTION 2.
Said Storm Viater Sewer Zone "A", in Sanitary Sewer District
#1, in the 8ity of Paducah, Kentucky, is described as follows, to -wits
"Beginning at a point on the south property of Trimble
Street, said noint being 173.25 feet west of the west property
line of 9th Street; thence in an easterly direction and along
the south property line of Trimble Street, 2672.25 feet to the
east curb line of 3rd Street; thence in a southerly direction
and along the east curb line of 3rd Street, 585.75 feet to a
point 173.25 feet south of the south property line of Clay
Street, said point being the center of the block lying between
I, Harrison and Clay Streets; thence in an easterly direction
along a line, said line being the center of the block lying
between Harrison and Clay Streets, crossing 2nd Street, to the
low water mark of the Ohio River, a distance of approximately
735 feet; thence with the low water mark of the Ohio River
in a southerly direction approximately 4125 feet to a point
in the center of the block, lying between Madison and Harrison
Streets, said point being 173-25 feet south of the south
property lire of Harrison Street; thence in an easterly direction
along a line, said line being the center of the block lying
between Madison and Harrison Streets, recrossing 2nd Street
to the east curb line of 3rd Street, a distance of approximately
815 feet; thence in a southerly direction and along the east
curb line of 3rd Street 412.5 feet to a point 173.25 feet south
of the south property line of Madison Street, said point being
the center of the block lying between Madison and Monroe Streets;
thence in a westerly direction along a line, said line bding the,
center of the block lying between Madison grid Monroe Streets
2672.25 feet to a point 173.25 feet west of the west property line

lying between Monroe and Madison Streets; thence in a
northerly direction along a line, said line being 173.25
feet west of the west property line of 9th Street and parallel
thereto 1410.75 feet to the south property line of Trimble
Street, the point of beginning."
Said Storm Vater Sewer Zone "B", in said Sanitary Sewer
District #1, in said City, is described as follows, to -wit:
"Beginning at a point 173.25 feet north of the north
property line of Fdashington Street and 173.25 feet west of the
west property line of 9th Street, said point being the center
of the block lying between 7.ashington Street and Kentucky Avenue;
thence in an easterly direction and with a lire, said line being
the center of the block lying between Washington Street and
Kentucky Avenue, 1219.5 feet to a point 173.25 east of the east
property line of 7th Street, said point being the center of the
block lying between 6th and 7th Strects and Kentucky Avenue and
Washington Street; thence in a southerly direction along a line,
said line being the center of the block lying between 6th and
7th Streets, 412.5 feet to the center of the block lying between
6th and 7th Streets and 'hashington and Clark Streets; thence in
an easterly direction along a line, said line being the center
of the block lying between Washington and Clark Streets, approx-
imately 2620 feet to the low water mark of the Ohio River in a
southerly direction, approximately 4510 feet to a point 211.75
feet south of the south property line of Clvrk Street, said
point being in the center of the block lying between Clark and
Adams Streets; thence in a westerly direction along a line, said
line being the center of the block lying between Clark and Adams
Streets, a distance of approximately 600 feet to the center line
of 2nd Street; thence in a southerly direction and along the
center line of 2nd Street, 1329.5 feet to a pcint, said point
being 173.25 feet south of the south property line of the Ohio
River and the center of the block lying between Tennessee and
Ohio Streets; thence in a westerly direction along a line, said
line being the center of the block lying between Tennessee and
Ohio Streets, 3065.75 feet to a point, said point being 173.25
feet west of the west property line of 9th Street and in the
center of the block lying between Ohio and Tennessee Streets;
thence in a northerly direction along a line, said line being
173.25 feet west of the west property line of 9th Street and
parallel thereto, 2193.0 feet to a point 173.25 feet north of
the north property line of 4ashingcon Street and 173.25 .feet
west of the west property line of 9th Street, the point of
beginning."
Zone "A", hereinabove described, is located on the nort
side of Broadway Street, and Zone "B", hereinabove described, is locate
on the south side of Broadway Street, and both of said Zones are embrac
in Sanitary District I}1 as aforesaid.
SECTION 3.
Skid Storm .ater Sewers in Zone "A" shtal7; be construe
along and under the following named streets in the City of Paducah,
Kentucky, to -wit:
"On Harrison Street from the low water mark on the
Ohio River to the center line of 9th Street, crossing 2nd,3rd,
4th, 5th, 6th, 7th and 8th Streets and to the center line of 9th
Street, and taking care of the drainage of each of said inter-
sections.

On 3rd Street from the sewer in the center lineof
Harrison Street to the center line of Clay Street; and on
Clay Street from the center line of 3rd Strect and the center
line of 9th Street, crossing 4th, 5th, 6th2 7th and 8th Streets,
and to the center line of 9th Street, and taking care of the
Storm Water at each of said intersections.
On 3rd Street from the sewer sY�the center line of
Harrison Street to the center line of Madison Street, and on
Madison Street from the center line of 3rd Street and the center '
line of 9th Street, crossing 4th, 5th, 6th, 7th and 8th Streets,
and to the center line of 9th Street, and taking; care of the
drainage of storm water at each of said intersections."
Said sborm water sewers in Zone "B" shall be ernstructed
and under the following named streets, in the City of Faducah, Ky.,

"On V--ashington Street from the -nest property line of
7th Street to the center line of 9th Street; on 8th Street
from the center line of +.ashington Avenue to the center line
of Clark Street.
On Clark Street from the low water mark on the Tennessee
River to the center line of 9th Street, said line crossing 1st,
2nd, 3rd, 4th, 5th, 6th, 7th and 8th Streets, and taking care of
�i the drainage of storm water at each of the said intersections.
On 2nd Street from the center line of Clark Street to
the center line of Ohio Streets, crossing Adams and Jackson
Streets and to the center line of Ohio Street, and takhng care
of the drainage at each of said intersections.
On Adams Street from the sewer in the center line of 2nd
Street to the center line of 9th Street, crossing 3rd, 4th, 5th,
6th, 7th and 8th Streets, and to the center line of 9th Street,
and taking care of the drainage of storm grater at each of said
intersections.

On Jackson Street from the sewer in the center of
2nd Street to the center line of 9th Street., crossing 3rd, 4th,
5th, 6th, 7th and 8th Streets and tc the center line of 9th
Street, and taking care of the drainage at each of said inter-
sections.
On Ohio Street from the sewer and center line of 2nd
Street to the center line of 9th Street, crossing 3rd, 4th, 5th,
6th, 7th and 8th Streets, to the center line of 9th Street, and
taking care of the storm water at each of said intersections."
SECTION 4.
The cost of construction of said storm water sewers in sai<
Sever Zones "A" and "B", respectively, shall be apportioned against
all of the property in said sewer zones as follows:
1st: All lots or parcels of ground abutting or bounding 11
on the streets in each of said storm water sewer zones "A" and "B" i
are hereby declared to be the property benefitted thereby, and said
cost shall be apportioned and assessed equally against said abutting

lots or lands according to the number of feet abutting thereon, pro-
vided the cost of said construction shall not exceed $2.00 per abut•;,ine
feet.

2nd: In the event the cost of the construction of said
storm water severs shall exceed $2.00 per abutting foot along said
streets whereon said sewers shall be constructed in each of said
sewer zones, then such cost shall be apportioned against all of the
C lots or parcels of land in each of said sewer zones so benefitted,

according to the area in square feet of the lots or lends embraced
therein.

SECTION 5.
q Said sewers shall be constructed in strict accordance
with the mens, grades, specifications and profile as prepared and I,
furnished by the City Engineer of said City of Paducah, and adopted I

by the General Council of said City,
NO. 756.
Bids shall be received for the construction of said sewers
according to the plans,specifications and profile, and contract therefor
shall be awarded t6 the lowest and best bidder, except the right is
expressly reserved to reject any and all bids, within the discretion of the
general Council, and it may accept any bid which appears to be for the
best interest of the City of Paducah.
SECTION 7.
The Board of Public °!orks of said City is hereby authorized
and directed to advertise for bids for the construction of said sewers, `
and said Board shall report the bids received by it, w1th its recommenda-
tion for the acceptance of any of same or the rejection of all of same.
SECTION 8.
Said work shall be constructed under the direction and super-
vision of the pity Engineer and the Board of Public Yorks of said City,
or their authorized agents, and the same shall commence and be completed
at d time designated by contract.
SECTION 9.
The contractor awarded the contract for the work herein
nrovided, shall be paid only from the funds arising from special tax
bills or assessments made against the property located in said Sewer
Zone, except that said contractor may be paid out of such bonds as may
be issued according; to law, and as provided in Sections 3101, 3102 and
3105 Kcntucky Statutes.

This ordinance shall take effect and be in force from a
after its passage, approval and publication.
