BE IT ORDAINED BY THE G'rNEETIAL COUIICIL OF TIE CITY OF
PADUCIH, KENTUCKY:

SECTION 1.

That Section 37 of an ordinance, entitled, "_h ordinance
to create and establish a franchise to construct, own, acquire, mair,i
twin and use a water works plant and water distributing system :°rithi
the corporate limits of Paducah, and investing the purchaser thereof
with the rights, power and privileges herein set forth, and imposing
upon such purchaser the duties and responsibilities set out in this
ordinance", adontcd by the General Council of the City of Paducah on
the 22nd day of May, 1926, be and the same is hereby amended as
follows; by striking out from said Section 37 the following words,
to -wit:

"On 6th Street from '.'Washington to Ohio Street, size 16
inches", and by inserting in lieu thereof the following words, to-wi-
"On 6th Street from V.1ashington Street to Caldwell
Street, size 16 inches", so that said Section as amended shall read
as follows:
"SECTION 37.
The purchaser agrees to re -enforce the distributing system,
install meters and a second intake, end make other construction herein
outlined, at a total cost of approximately Three Hundred and Ten
Thousand ($310,000.00) Dollars and complete same as promptly as
possible, but not to exceed two and one half years after the passar;e
�! of this Ordinance. Mains shall be laid in substantial conformity

Purchaser shall at all times operate its plant and entire
system economically and efficiently. Purchaser shall have and maintain as
near as possible, at all times during this franchise, a plant and equipment
and machinery that shall conform to modern, efficient and economical water
works practice; but in making such conformation, purchaser may consider
the condition, adaptability of machinery- than in use, applicability of
new inventions or new machinery or process to local conditions number of
customers, prospective growth of plant and customers, and probable
financial return, resulting from such increased investment. if the
purchaser fails in any of the obligations imposed upon it under this
section, all costs, expense or outlay sustained by purchaser in connecti
with the item or items involved in such failure shall be disallowed
as a part of operating cost or as an addition to property value for rate
making or depreciating purposes."
BE IT FURTHER ORDAINED that the Paducah 'later Company, the
owner of the franchise so adopted by the General Council of said City,
on the 22nd day of May, 1926, be and it is hereby directed not to lay a
12 inch water main on Ohio Street from 6th Street to 13th Street, ond,
BE IT FURTHER ORDHINED that said Paducah ':later Company is
directed and authorized to lay a 12 inch rater main on Cal dwell Street
from 6th Street to the Union Station, and to lay an S inch water main
on the street immediately North of the Illinois Central Railroad !
Company's "Y", which street is an extension of Coxey Street, from the
Union Station to the intersection of Lincoln .Avenue and Coxey Street, and

BE IT FURTHER ORDAINED that in all other respects the
franch�,se of the Paducah 'hater Company, established under said ordinance;
shall be binding upon said Paducah hater Company and the City of Paducah
according to the terms therein sot forth.

This amendment is adopted by the General Council of the City
of Paducah, with the knowledge and consent of the Paducah Clater
Company,
This ordinance shall take'effect and be in force from and
