EXTENSION OF SEWER 'LONE NO. 4, III SE, ]ER DISTRICT #3, IN THE CITY OF PALiiCAH,'KENTUCKY-, AT THE COST OF THE PRCPERTY 0"HERS THEREIN, AND PROVIDING THAT SUCH SEINER SHALL BE CON- STR[ICTED TDIDER THE PEOViSiONS OF THE TEN YEAR PAYI:fENT PLAN, AND NAI.IIN TITHE STREETS AND ALLEYS ALONG, UNDER AND T1iROUGH 1:9,IUH SAID SE'.!F.R SHALL BE CONSTRUCTED, AND SETTING OUT IN GENERAL TERMS THE P7MPE7TY BENEFIT CH,.REBY AND SUBJr',CT TO THE PA`1s1ENT OF 'ME COST OF RHER.EAS Sevier Zone #4, of Sevier District #3, has been extended so as to embrace the following additional area, or portion o the City of Paducah, in said Sewer Zone #4, to -wit: "Beginning ..t a point on the 13esterly boundary line of Zone #4, where the said boundary line would inter- sect the center line of the alley lying between Idadison and Harrison Streets; thence in a westerly direction 205.2 feet with the center line of said alley to the icsterly line of Lot ilio. 18 of Block No. 3, of Terrell's Fountain Park Addition; thence northerly along the said 1.7est line of Lot No. 18, and crossing Harrison Street and along the west line of Lot No. 47, and crossing the alley lying between Harrison and Clay .Streets and along the west line of Lot No. 18, and Block No. 2, and crossing Clay Street and along the viest line of Lot No. 4, of Block No. 4, said line being the east property line of 21st Street, if extended, to the center line of tie alley north oi:' Clay Street, a distance of approximately 801.75 feet, the south boundary line of Zone #4; thence easterly +ith the south line of Zone No. 4, approximately 205.2 feet to t -e west line of Zone No. 4; thence southerly with said line of Zone #4, and crossing Clay Street and the alley lying between Harrison and Clay Streets and Harrison Street to the center line of the alley between Madison and Harrison Streets, a distance of approxi- mately 801.75 feet to the point of beginning"; and, h'HEREAS the General Council or said City has adopted', a resolution declaring the construction oi' such sewers in said ex- tension of Sewer Zone No. 4, to be a necessity: NON, THEREFORE, BE IT ORDAINED BY THE GEN117Ri!L COUNCIL OF THE CITY 01' PA DUCAH, KENTUCKY: SECTION 1. That storm and sanitary sewers be constructed in, under and along the streets and alleys in the extension of Sewer Zone ,14, sub -divisions "A" and "B" in Sewer District #3, in the City of Paducah, Kentucky, as follows, to -wit: "On Harrison and Clay Streets, extending from the present terminus of the sewer laterals provided fox the Sewer Zone #4, in a westerly direction along each of said streets approximately 205.2 feet." V SECTION 2. The cost of constructing said sewers shall be apportioned equally against the abutting lots or parcels of land, according; to the number of feet abutting thereon, and shall be paid for by the owners. of said lots or parcels of ground abutting or bounding upon said streets, provided the cost of same shall not exceed $2.00 per abutting feet. In the event the cost of sand improvement shall exceed the sura' N of $2.00 per abutting foot, then all the lots or parcels of ground in said Zone as extended are hereby declared to be the property benefitted , and the entire cost of construction of said sewer shall be assessed against each of said lots or parcels of ground embraced therein in the proportion that the area in square feet of such lots or parcels of ground shall bear to the area in square feet of all of the lots or parcels of i ground located in said 'Zone extension; and the General Council shall fix and assess the amount of tax to be levied upon each of said lots or parcels in said 'Zone as required by law. SFCTION 3. The lots or parcels of ground which are hereby declared to be benefitted by the construction of said sever, and subfFot to the payment of cost of same, are located in said extension of %one Ido. 4, which is particularly described in the resolution establishing said Se,ier lone extension and hereinabove described. SECTION 4. Said sewer s4all be constructed in strict accordance with the plans, grades and specification^, prepared and furnished by the City Engineer of said City, and heretofore adopted by the General Council of -said City. S3CTION 5. The cost of construction of said sewers shall be in accordance with the bid heretofore accepted from the Koller Plumbing Company, and which bid has been accepted and confirmed by said Koller Plumbing Company for the extension herein provided for. SECTION 6. Said work shall be constructed under the supervision of the City Engineer and the Board of Public Works of said City, or their authorized agents, and the same shall commence and be completed in accordance with the provisions of the contract existing bet:een the City of Paducah, Kentucky, and the Koller Plumbing Company. SdCTION 7. The cost of the work herein provided .for shall be i paid wholly from the funds arising from special tax bills or assessments) made against the property located in said Sewer Zone extension, ex^ept that said contractor may be paid out of such bonds as may be issued according to law, and is provided in Sections 3101, 3102 and 3105 of the Kentucky Statutes.
