HomeMy WebLinkAboutOrdinances Book 8, Page 670, No Ordinance NumberNO. 670: AN ORDINANCE ASSESSING THE ABUTTING PROPERTY FOR THE COST OF THE CONSTRUCTION OF �ANITARY SEWERS IN SEWER ZONE #1, IN SUB -DIVISION "C", SEWER DI STRICT #3, IN THE CITY OF PADUCnIi, KENTUCKY; AND PROVIDING THAT THE PAYMENT OF THE COST OF SUCH CONSTRUCTION MAY BE MADE IN `CEN ANNUAL INSTALLMENTS, UPON THE EXECUTION BY THE PliOPERTY O'7NERS OF AGREEMENT RERUIRED BY LAW. WHEREAS the General Council of the City of Paducah has heretofore, after adoption of resolution as required by law, duly adopted an ordinance, entitled, "An ordinance providing for the construction of sanitary sewers in Sewer Zone #1, Sub -Division "C", Sewer District #3, in the City of Paducah, Kentucky, at the cost of the property owners therein, and providing that the said sewers shall be constructed upon the ten year payment plan, and naming the streets and alleys along, under and thru which said sewers shall be constructed, and setting out in , general terms the property benefited thereby, and subject to payment of the cost 4 same", which was duly adopted on the 11th day of May, 1925, wherein it is specified, among other things, that sanitary sewers be constructed on and along the following named streets, in said sewer zone, in the City of Paducah, Kentucky, to -wit; On Ashcraft Avenue commencing at the proposed sewer on Bridge Street or the Benton Road, and running thence Northward on Ashcraft Avenue, crossing Sowell Street to a point 500 feet Northward from the south property line of Sowell Street, a total distance of approximately 1225 feet. On Hays Avenue, commencing; at the proposed sewer on Bridge Street or the Benton Road, and running thence Northward on Hayes Avenue, a distance of 600 feet from the center line of Bridge Street or the Benton Road. On Hayes Avenue, commencing at the proposed sewer on Yeiser Street and running Southwardly along Hayes Avenue, crossing Powell Street to a point 450 feet South of the center line of Powell Street a total distance of approximately 925 feet. On Ashcraft Avenue, commencing at the present trunk line sewer on Bridge Street or the Benton Road, and running thence Northwardly on ;ishbrook Avenue from the center line of Bridge Street or the Benton Road, to the center line of Sowell Street, a distance of approximately 500 feet. Farley Place, commencing at the present trunk line sewer on Meyers Street and running thence Southwardly on Farley Place, a distance of 770 feet from the center line of Uieyers Street. On Jarrett Street commencing at the proposed sewer on Powell Street and running thence Northwardly on Jarrett Street, a distance of 494,25 feet from the center line of Powell Street. .,{ Jarrett Street commencing at the proposed sewer on Powell•.Str-eet and running thence Southwardly on Jarrett Street, a distance of 342.05 feet from the center line of Powell Street. On Bridge Street, or th Benton R ad c mmencing at the end of the present trunk Tine sewer o$ ridge Street, or the Benton Road, at the center line of Vasseur Avenue, and running Southward along Bridge Street or the Benton Road to the point of intersection of the center lines of Bridge Streets, or the Benton Road and Mill Street a total distance of approximately 2296 feet. NO. 671. On Bridge Street, or the Benton Road, commencing; at the present trunk line sewer on Clements Street and running thence Northwardly on Bridge Street, or the Benton Road, crossing Kinkead Avenue and crossing Jarrett Street to a point 120 feet North of the center line of Jarrett Street, a total distance of approximately 525 feet. On Powell Street, commencing at the proposed sewer on Ashbrook Avenue and running thence VIestwardIty on Powell Street, a distance of 300 feet from the center line of Ashbrook Avenue. it On Powell Street, commencing at the present trunk j line sewer on Clements Street and running thence Westwardly on Powell Street, a distance of 321 feet to the center line of Jarrett Street. I On Yeiser Street, commencing at the present trunk line sewer on Clements Street, and running thence Eastwardly on Yeiser Street, crossing �,00dward Street, irshbrook Avenue, Cooley Avenue and Hayes Avenue, to a point 150 feet Eastward from the center line of Hayes Avenue, a total distance of apnroximately 1050 feet. On Short Street commencing at the end of the present trunk line sewer on 1.9eyers Street, which point is 440 feet Eastward from the center line of 16+oodward Street and running ii from this point (the end of the present trunk line sewer), thence VIestward along Meyers Street to the center line of Dull Street, a total distance of approximately 2000 feet; that portion of the sewer on Meyers Street to a point 440 feet Eastward from the center line of Woodward Street to a point 770 feet Eastward from the center line of Woodward Street; a distance of 330 feet, being outside Zone Now 1, of subdivision "C", Sewer District No. 3. On Sowell Street commencingr at the proposed sewer on Ashbrook Avenue and running thence Westwardly a distance of 105.65 feet from the center line of Ashbrook Avenue. On Ashbrook Avenue commencing at the proposed sewer on Yeiser Street and running thence Southwardly on Ashbrook Avenue, crossing Powell Street to a point 500 feet Southward from the center line of Powell Street, a total distance of apnroximately 975 feet. On Woodward Street commencing at the proposed sewer on Yeiser Street and running thence Northwardly on I'loodward Street, to a point 250 feet Northward from the center line �i of Yeiser Street. I' On Woodward Street from the present trunk line sewer on Meyers Street and running thence Southwardly on Woodward Street, a distance of 675 feet from the center line of 7'eyers Street. All the above lateral sewer lines are to be constructed with 6 inches house service lines extending from the sewer proper to the property lines of all property abutting on the streets or alleys in which the above described lateral sewers are to be built in such manner as to properly serve the property benefitted. Six inch house service lines are to be constructed II from the present sewer lines -built under the 5$600,000.00 bond issue- to the property lines of all abutting property on the following streets or alleys in such manner as to properly serve the property benefitted. On Meyers Street from a point 435 feet Northward from the center line of Farley Place to a point 440 feet Southward from the center line of l+oodward Street, a total distance of approximately 1600 feet. i On Clements Street from the center line of iLeyers Street to the center line of Bridge Street or the Benton i, Road. i On Bridge Street, or the Benton Road, from the center line of Clements Street to the center line of Vasseur Avenue, and which ordinance is now referred to and made part hereof, for the particular description of the property subject to the payment of the cost of said sewers; and, I NO. 672. WHEREAS in accordance with said ordinance, it was provided that the cost of tine construction of said sewers be paid by the owners of lots or parcels of ground abutting or bounding upon said streets, provided the cost of same does not exceed $$2.00 per abutting.foot, then all the lots or parcels of ground in said zone are declared to be benefitted, and the entire cost of the construction of said sewers shall be assessed against each of said lots or parcels of ground -located and embraced in said zone in the proportion that the area: i in square feet of such lots or parcels of ground shall bear to the area in square feet of all lots or parcels of ground located in said zone; and the General Council shall fix and assess the amount of tax on each of said lots or parcels of ground in said zone as required by law; arid,' '.'•.RiEREAS pursuant to said ordinance, a contract was entered into on the 8th day of August, 1925, between the'Koller dumbing Company,' of Ponca City, Okla., and the City of, Paducah for the construction of said sewers; and, WHEREAS said sewer construction has been completed and duly accepted by the General Council of said City on the 7th day of June, 1926, pursuant to the recommendations of the Board of Public ':forks of said City; and, INHEREAS the cost of the construction of said sewers is less than ?2.00 per abutting foot; BE IT ORDAINED BY THE GENERAL COUNCIL 0? THE CITY OF PADUOliH, KENTUCKY: SECTION 1. That all the property located on both sides of each and all the streets hereinabove described, be and the same -is hereby, assessed with the cost of construction of said sewers at the rate of 1.130306 per lineal foot, as particularly shown by the estimate of such cost prepared by the official engineers in charge of same, and duly filed and approved by the General Council of said City, and which estima e shows all the lbts or parcels of ground assessed for such cost, and the amount of same', and is now referred to and made part hereof, and the same vrill appear on file in the offices of the City Clerk and the City Engineer. SECTION 2. That the funds derived from the assessment of said property shall be used for the purpose of paying off the special tax bills issued against said property, or such bonds as may be issued by the City of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes. n SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, said tax assessment may, at the option of the property owner, be paid in cash without interest within thirty days from the date of the passage and publication of this ordinance, or in ten annual installments, provided the property owner shall before the expiration of said thirty days enter into a written agreement with said City in accordance with the provisions of Section 3101 of the Kentucky Statutes. SECTION 4° In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein provided for, representing the amount which the property owners have elected to pay on the installment plan, as hereinabove provided, the City of Paducah mgy issue and sell improvement bonds, and to secure the payment of said bonds, there is hereby pledged such taxes and liens on the property assessed herein for the payment of principal and interest, but such bonds shall not be sold for less than par, and the proceeds derived therefrom shall be applied exclusively to the payment of the cost of such construction as hereinabove provided; and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the 3entucky Statutes.
