AN ORDINANCE ASSESSING THE ABUTTING PROPERTY FOR THE 003 i OF CONSTRUCTION OF SANITARY SY.VERS IPI SEl'/]'sH '7,ONE ##3, IN SUB -DIVISIONS i A A14D B'IN SE:7ER DISTRIUT ##3, IN THE CITY OF PADUCiiH, KENTUCKY, AND PROVIDING THAT THE P 1YI.IENT OF SUCH COST MAY BE MADE IN TEN ANNUAL i INSTALLMENTS, BEING ONE Et:CH YEAR FOR A PERIOD OF TEN YEARS, UPON EXECUTION BY THE PROPERTY OV,'NT,�RS OF 11GREEMEIIT REQUIRED BY LAIV. WHEREAS the General Council of the City of Paducah has heretofore, after the adoption of resolution as required by law, on the 11th day of May, 1925, adopted an ordinance, entitled, "An ordinance providing for the construction of sanitary sewers in sewer ##3, Sub -divisions A and B, Sevier District ##3, in the Uity of Paducah, Kentucky, at the cost of the property owners therein, and providing that said sewers shall be constructed upon the ten year payment plan, and naming the streets add alleys along, under and through which said sewer shall be constructed, and setting out in general terms the property benefited thereby and subject to the payment of the cost of same"; and specifying, among other things, that sanitary sewers be constructed on and along the following named streets, in said sewer zone, in the Cite of Paducah, to -wit: On A Street; on Goebel Avenue; on Tennessee Street; on Morten Avenue; on Brakeman Avenue; on Baumer Avenue; on Guthrie Avenue; on Wheeler Avenue; on Mayfield Road, as particularly described and designated by an ordinande entitled, 'I "An ordinance providing for the construction of sanitary sewers in Sewer Gone #3, Sub -divisions A and B, Sewer District f#3, in the City of Paducah, Kentucky, at the cost of the property ownerstherein, and providing that said sewers shall be constructed upon the ten year payment plan, and naming the streets and alleys along, under and through which said sewer shall be constructed, and setting out in general terms the property benefited thereby and subject to the payment of the cost of same," adopted by the General Council of said City, on the 11th day of May, 1925, and which is now referred to and made part hereof, for the particular description of the property subject to the payment of the " cost of said sewers; and, WHEREAS, in accordance with said ordinance, it was provided that the cost of construction of said sewers be paid by the jl j. owners of lots or parcels of ground abutting or bounding upon said streets, provided the cost of same does not exceed $2.00 per -abutting foot; and further that in the event the cost of said improvement shall exceed $2.00 per abutting foot, tnen all the lots or parcels of ground in said zone are declared to be benefited, and the entire cost of the construction of said sewers shall be assessed tagainst,',each of said lots or parcels of ground located and embraced in saiTP•zone in the proportion that the area in square feet of such lbts or parcels of ground shall bear to the area in square feet of all lots or parcels of ground located in said zone; and the General Council shall fix and assess the amount of tax on each of said lots or parcels of ground in said zone as required by law; and, MIEREAS pursuant to said ordinance, a contract was entered into on the 8th day 'of August, 1925, between the Koller Plumbing Company of Ponca City, Okla., and said City of Paducah for the construction of said sewers; and, INHEREAS by ordinance of said City a portion of said Sewer Zone ##3 was eliminated, so as not to require the laying of sewers along certain streets embraced in the line of the property acquired by the Chicago, St. Louis and New Orleans Railroad Company, for the construction of shops and ,yards; and, WHEREAS, the cost of construction of said sewers is less than $2.00 per abutting foot; and, '.'.WHEREAS, said sewer construction has been completed and duly accepted by the General Council on the 7th day of June, 1926, pursuant to the recommendation of the Board of Public ,Norks of said City; NOW, THERE- FORE, BE IT ORDAINED BY THE GENLRnL COUNCIL OF THE CITY OF PADUCAH, KF.1,rTU CKY: i SECTION 1. That all of the property located on both sides of the Mayfield Eoad, Wheeler Avenue, Guthrie Avenue, Goebel Avenue, Tennessee Street and "A" Street in said Sewer Zone #3, except such portionll as has not been served by sewers by reason of the elimination ordinance aforesaid, affecting only the property wiahin the boundary of said railroad shop -yards, be, and the same is hereby, assessed with the cost of con- struction of said sewers at the rate of $.852864 per lineal foot, as particularly shown by the estimate of such costs prepared by the official engineers in charge of same, and filed, received and apnroved by the General Council of said City, and which estimate shows all the lots or parcels of ground assessed for such cost, and the amount of same, and is now referred to and made part hereof, and the same appears on file in the offices of the City Clerk and the City Engineer of said City. SECTION 2. That the funds derived from the assessment of said property shall be used for the purpose of paying off the special tax bills issued against said property, or such bonds as may be issued by the City j of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, said tax assessment may, at the option of the property owner, i be paid in cash without interest within thirty days from the date of the passage and publication of this ordinance, or in ten annual installments, provided the property owner shall before the expiration of said thirty days; ,nter into a written agreement with said City in accordance with the pro- ✓isions of Section 3101 of the Kentucky Statutes. SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herei provided for, representing the amount which the property owners have elected to pay on the installment plan, as hereinabove provided, the City of Paducah may issue and sell improvement bonds, and to secure the payment of said bonds, there is hereby pledged such taxes and liens on the property assessed herein for the payment of principal and interest, but such bonds shall not be sold for less than par, li and the proceeds derived therefrom snail be applied exclusively to I the payment of the cost of such construction as hereinabove pro- vided; and such bonds, if .issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes.
