KES, MAN -HOLES, DRAIN nDQ AS' ER PIPES AND DRIVE-1`iAYS, IN ACCORD NNE :,ITH THE PLANS AND SPECIFICATIONS PROVIDED THEREFOR BY THE CITY mNGINEER, AT THE COST OF 41 ABUTTING PROPERTY OONERS, AND PROVIDING THAT THE DOST OF SUUH CONSTRUCTION I`:.Y 3E PAID IN ACCORDANCE +'ITH THE PROVISIONS OF C_i-, TEN YuAR Pn:7Is;ENT PLAN. BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Caldwell Street from the East properpy line of 12th Street to the west property line of Caldwell Avenue, (or 13th Street), thence on Caldwell Avenue from the South property line of said Avenue to the East line of the right-of-way of N. C. & St. Louis Railway Company, in the City of Paducah, Kentucky, be improved by the construction of a hard surface road -way and curbs and gutters, togetner with all necessary intakes, man- holes, drain and sewer pipes and drive -ways, in accordance with the plans and specifications provided therefor by the Ctty Engineer, and which plan and specifications will appear on file in the office of said engineer, and are now referred to and made part hereof as if specifically set forth herein. S;;CTION 2. Said construction stall be made under the direction and supervision of the City Engineer and Board of Public -orks of said City, and shall commence at the time designated by contract for the performance thereof and be completed on or before December 1, 1926. SECTION 3. The cost of such construction shall be paid for wholly by the prpperty owners fronting or abutting thereon, to be apportioned to and assessed against the property and the property owners abutting thereon, according to the number of abutting feet thereon, except that portion to be paid by the City of Paducah as required by law. SECTION 4. The contractor awarded the contract for the improve- ment herein provided for shall be paid in accordance with the terms and Provisions of Section 3096, 3100, 3101 and 3102 of the Kentucky Statutes. NO. 647. SECTION 5. The Mayor of said City is hereby authorized and directed to execute,contract and accept bond required to be exocu ted by the contractor awarded the contract for such construction. SECTION 6. Bids shall be received for the improvement herein prov for, in accordance with the plans and specifications made and provi therefor by the City Engineer, and the; constract therefor shall be awarded to the lowest and best bidder, except the right is reserved to reject any and all bids within the discretion of the General Council, and it may accept any bid which appears to be for the best i interest of said City. SECTION 7. The Board of Public Viorks is hereby authorized to advertise for bids for the construction of said improvement, and to make report of same to the General Council, together with its recom- mendation for the acceptance of any of same, or the rejection of all of same.
