NOBLE CONVEYING A CERTAIN STRIP OF GROUND FOR THE EXTENSIO11 OF KENTUCKY AVENUE IN THE CITY OF PADUCAH, KENTUCKY; CONFIRMING f+NDS RATIFYING THE OBLIGATIONS AND AGREEMENTS IN SAID DEED CONT_1INED TO j BE PERFORIdED BY SAID CITY, AND PROVIDING THAT THE SAID W. Y. NOBLE, i HIS SUCCESSORS AND ASSIGNS, SHALL HAVE THE RIGHT TO USE AND MAINTAIN' A SPUR OR S111ITCH TRACK RUNNING ACROSS KENTUCKY AVENUE. BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PA DUCAHI KENTUCKY: SECTION 1. I That the City of Paducah does hereby accept a certain deed dated February 4, 1926, from 17. Y. Noble to the City of Paducah, which deed has been recorded in Deed Book 149, page 225, McCracken County Court Clerk's Office, in which deed strips of ground are conveyed to the City of Paducah for the purpose of extending Kentuc Avenue between 11th and 12th Streets in said City, subject to the i terms and conditions set out in said deed, which terms and conditions the City hereby accepts and binds itself to observe and perform, and; in consideration of such deed, the said `'1. Y. Noble and his heirs and assigns who shall own any part of the tract of land now owned by the said Noble, and lying directly North of the tracts conveyed �! to the City by the above mentioned deed, shall always have the right I� to use Kentucky Avenue for the purpose of maintaining and using a spur or switch track of the Illinois Central Railroad Company, or I lother Railroad Company, over and across Kentucky Avenue between 11th and 12th Streets, such •switch or spur track to enter the property of the said Noble, his heirs and assigns, at the Point where the present switch or spur track now enters said tract of land. SECTION 2. This Ordinance shall be effective after its passage, approval and publication, i ®..
