04 A RESOLUTION DECLARING THE CODSTRUCTION OF SANITARY SE'1,EHS IN
SEV-ER ZONE NURBER THREE, IN 3uBi+LIVISIONS A AND B, SE6ER DISTRICT
NUMBER THREE, TO BE A NECESSITY, AND SETTING OUT, IN GENERaL TERMS,
THE PROPERTY SUBJECT TO THE PAIieEET OF THE uOST OF SANTE.
SiHEREAS, There has been created and established, in the City
of Paducah, nentucky, Sewer District No. 3, which has been divided into
Sub -Divisions A. B and C; and,
i;HEHEAS, There is being constructed, in said Sewer District
trunk line sewers at the cost of the City of Paducah, nentucxy, which
trunk line sewers have now been completed; and,
iHEREAS, there has been created and established, Sewer Zone Num-
ber Three, in Sub -Divisions A and B, Sewer District No. 3 by an Ordinance
adopted by the Board of Commissioners on the 23rd day of February 1923,
wherein said Zone is described by metes and bounds, and is hereinafter
described, and a plot of which zone appears on file in the office of the
City Engineer of the city of Paducah, nentucky, and may be inspected by
anyone making application therefor at said office; and,
r',HEREAS, Sevier Zone Number Three in Sub -Divisions A and B,
Sewer District No. 3, is not provided with sewers and is in a thickly
populated territm y and in order to provide adequate sewers for the
property owners in said Zone, it is hereby deemed and declared a necessi-
ty by the General Council of the City of Paducah, nentucky, that sanitary
sewers be constructed in said Zone in order to provide adequate sewerage
for the property owners residing in said Zone; Now, Therefore -
BE IT RESOLVED BY '1HE UENERAL COUNCIL 0 F THE CITY OF PADUCAH,
&EN TUCxY:
SECTION I.
That it is hereby declared a necessity by the General Council
of the Cit; of Paducah, nentucky, in order to secure adequate sewerage,
and in order to protect the health of the citizens residing in Sevier
Zone Number Three, Sub -Divisions A and B, Sewer District Number Three,
that sanitary sewers be constructed and laid out at the cost of the lots
or parcels of land benefitted thereby, and all of the lots or parcels of
land embraced in said Zone are hereby declared to be the property bene-
fitted, arid subject to be assessed for the cost of constructing said
sewers.
SECTION 2.
Said Sevier Zone Number Three of Sub -Divisions A and B of Sewer
District Number Three, in which said sewers are to be constructed is de-
scribed by metes and bounds as follgw s, to -wit:

"Beginning at the intersection of the center line of
Brakeman avenue and Baumer Avenue; thence with the center line of
Baumer Avenue, in a westward direction, to a point 150 feet east
of the intersection of the center line of Baumer Avenue and the
south property line of that part of Smithland avenue north of
Baumer avenue; thence at right angles southward 197 feet; thence
at right angles westward 169 feet; thence deflecting 107 .degrees
13 minutes to the left, 140 feet; thence deflecting 84 degrees 53
minutes, to the right, 183.2 feet; thence deflecting 97 degrees
27 minutes, to the left, 318 feet; thence deflecting 90 degrees
to the right 188.4 feet, to a point on the center of the Mayfield
Road, 175 feet southward from the center line of Wheeler Avenue,
measured along said center line of the Mayfield Road; thence.at
right angles southward with the center of the Mayfield Road 225
feet; thence at right angles westward 190 feet; thence at right
angles northward, parallel to the Mayfield Road, to a point on
the south property line of an alley, if extended, said point being
210 feet, more or less, south of the south property line of ioheeler
avenue; thence westward v-ith the south property line of said alley
660 feet, more or less, to the center of B. street; thence north-
ward with the center of B. street to a point on the center line of
an alley, said point being 338 feet north of the center line of
'nheeler avenue; thence at right angles eastward with the center
line of said alley 396 feet to the center of A street; thence at
right angles northward with the center of A- street 21 feet; thence
at right angles eastward 193 feet to the center of an alley; thence
at right angles northward with the center of said alley 96 feet to
a point 59 feet south of the south property line of Guthrie avenue
thence at right angles eastward, parallel to Guthrie Avenue 163
feet, to the 'vest property line of the Mayfield Road; thence North-
-ward with.the west property lines of the Mayfield Road and Goebel
Avenue 159 feet to a point 40 feet north of the north property
line of Guthrie Avenue; thence at right angles westward 163 feet
to the center of an alley; thence at right angles northward with
the center line of the alley and said center line extended, 720
feet, more or less, to the center line of Porten avenue, if ex-
tended; thence at right angles eastward along the center line of
.orteh Avenue, if extended, 203 feet to the east property line of
Goebel avenue; thence at right angles northward with the east
property line of Goebel Avenue, 126 feet to a point 106 feet
north of the north property line of horten :venue; thence deflecting
90 degrees 18 minutes, to the right in an easterly direction and
following the rear boundaries of lots fronting on Piorten avenue
196 feet; thence deflecting 12 degrees 46 minutes, to the right,
continuing to follow the rear boundaries of lots fronting on Porten
Avenue, 132.5 feet; thence deflecting 2; degrees 10 minutes,
to the right, continuing to follow the rear boundaries of lots
fronting on +,orten Avenue 329.7 feet, to the center of Tennessee
Street; thence deflecting 85 degrees 38 minutes, to the left, in
an easterly direction along the center line of Tennessee street
126 feet, more or less, to a point 221 feet from the east property
line of horten Avenue; thence at right angles in a southerly di-
rection 155 feet; thence at right angles westward 95 feet to the
center of an alley, a point 126 feet east of the east property
line of P+ortan Avenue; thence at right angles southward on line
with the center of said alley to the center of Brakeman avenue;
thence southward along the center of Brakeman Avenue, to the point
of beginning."
AND FURTHERMORE .
"beginning at a point on the east property line of the May-
field road 300 feet north of the north property line of Cedar Avenue
said 300 feet being measured along said east property line of the
Mayfield road; thence southward along the east property line of
the Mayfield Road; 100 feet; thence at right angles westward
to a point 168 feet westward from the west property line of the May-
field road; thence at right angles southward on a line parallel to the
Mayfield Road, to a line which runs at right angles to the Mayfield
Road and which intersects the east property line of said road 300 feet
southward from a point where the east property line of said road is inter-
sected by the south property line of Quarles avenue; thence at right
angles eastward to a point 168 feet eastward from the east property
line of said road, said 168 feet being measured parallel to Quarles
Avenue; thence at right angles northward on a line parallel to the May-
field road, to a point 300 feet northward from the north property line
of Cedar Avenue, said 300 feet being measured parallel to the Mayfield
Road; thence westward, parallel to Cedar Avenue to the point of
beginning-"

SECTION 3.

Said zone embraces the hereinafter named streets and alleys and
all of the property in said zona that is benefitted by said sewer does
not abutt on said streets and alleys; some of said property not abutting
on any of said streets or alleys so named.
Said sewers shall be constructed along and under the following
named streets and alleys in Sewer Zone No. 3 in Sub -Divisions A and B
Sewer District No. 3, and the cost of same shall be apportioned against
all the property in said Sevier Zone as follows:
(a) All the lots or parcels of land bounding or abutting on the
hereinafter named streets, alleys or highways along or under which such
sewers shall be constructed are hereby declared to be the property bene-
fitted thereby, and said cost shall be apportioned and assessed equally
against said abutting lots or lands according to the abutting feet there-
on, provided that the costs of said construction does not exceed X2.00:
per abutting foot.
(b) In the event the cost of construction of said sewer shall ex -
teed $2.00 per abutting foot along any of said streets, alleys or high-
ways whereon said sewer shall be constructed, then such cost shall be ap-
portioned against all of the lots or lands in said Sever Zone, which
are hereby declared to be equally benefitted by said sewer according to
the area in square feet of the lots or lands so benefitted.
(c) Vlith reference to all the lots or lands not bounding or abut-
ting on the said streets, alleys or highways along and under which said
sewer shall be constructed, the cost of same shall be apportioned
against all of such lots or lands according to the area in square feet.
and which streets, .alleys and highways along which said sewer
shall be constructed are described as follow, to -wit:
"A" street from Wheeler Avenue Northwardly to a point near an
alley, said alley being about 160 feet from Guthrie avenue, a distance
of 300 feet.
Goebel avenue from a point about 40 feet north of the north prop-
erty line of Guthrie avenue in a northerly direction to a point near
'-orten avenue, a distance of. 623 feet.
Tennessee street from a point in Goebel avenue near a street or
alley xnown as Baumer avenue; in a northeasterly direction, a distance
of 350 feet.
Tennessee street from Y'orten avenue in a southwesterly direction
a distance of 348.2 feet.
Tennessee street from torten avenue northeasterly direction, a
distance of 231.8 feet.
Smithland avenue from a point in a street or alley, known as
Baumer avenue in a northeasterly direction, a distance of 360 feet.
Y+orten avenue from Smithland avenue in a northwesterly direction
to a point near Goebel avenue, a distance of 897.3 feet.
Smithland avenue from Brakeman avenue to o+orten avenue in a
southwesterly direction a distance of 140.S6 feet.

Ordinances
Brakeman avenue from a point near the intersection of Brakeman
avenue and Baumer avenue at the, existing 24 inch sewer in a northwardly
direction to Smithland avenue a distance of 601.82 feet.
Baumer avenue from a point near the intersection of Baumer avenue
and Brakeman avenue at the existing 24 inch sewer in a northwesterdly
direction to Smithland avenue, a distance of 570.7 feet.
Guthrie avenue east of the Mayfield road from Mayfield road in
an easterly direction to a point near the intersection of Smithland avenue
if extended, a distance of 325 feet.
V.heeler avenue from the Mayfield road in a eesterly direction to a
point near B. street a distance of 725 feet.
All the above described lateral sewer lines are to be connected
with 6 inch house connection service lines extending from the sewer proper
to the property lines of all property abutting on the streets or alleys
in which the above described lateral sewers are to be built in such man-
ner ea to properly serve the property benefitted.
Six inch house connection service lines are to be constructed from
\ti the present sewer lines (built under the .600.000 bond issue) to the
property lines of all abutting property on the following streets or alleys

Clayfield road from a point 300 feet north of Cedar gvenue southward
to a point 300 feet south of quarles avenue.

Mayfield road and that portion of the Mayfield road known as
Goebel avenue from a point 40 feet north of Guthrie avenue southward to
a point 400 feet south of 'hheeler avenue.

Wheeler avenue, if extended, from the Mayfield road eastward to a
point 188.4 feet eastward from the Mayfield Road.
y ; SECTION 4.
Notice is hereby given to the owners of all property in said Zone,
�I land all property bounding or abutting on any of said streets,alleys or high-
2� sways, that the cost of construction of said sewer will be assessed against
C'�, Isuch property in the manner hereinabove provided.
SECTION 5.
A Blue print or plat showing the boundary of sewer zone No. 3 nam-
Lng and showing the streets embraced in said Zone, and showing the line
\\1d d course of the sewer to be constructed hereunder, is filed herewith
and made a part hereof, marked exhibit A.

SECTION 6.
F4 , For additional information of the public and owners of property in
j said zone, a blue print or plat showing the boundary of said sewer zone

ewer to be constructed hereunder, will be found on file in the office of
,the city engineer of the city of Paducah, and may be inspected at any time n\
on application at said office.
