AN ORDINANCE REGULATING TRAVEL AND TRAFFIC--TIIE USE OF STREETS BY VEIIICLES, STREET CARS AND PEDESTRIANS; CRE:,TING A CENTRAL TRAFFIC AND BUSINESS DISTRICT• ESTABLISHING BOULEVARDS, SAFETY ZONES, AND AUTHORIZING THE MARKING OF CROSSWALKS OR ANY ZONES HEREIN PROVIDED FOR, AND THE ERECTION OF SIGNS AND SIGNALS; REGULATING PARKhING, AND DESCRIBING THE STREETS OR PORTIONS OF STREETS THAT MAY BE USED FOR PARKING, AND THE MANNER OF UTILIZING SA1,1E, IN THE CITY OF P-iLUCAH, KENTUCKY; AND FIXING A PENALTY FOR ANY VIOLATION HEREOF. BE IT ORDAINED BY THF GENERAL COUNCIL OF THE CITY OF PADUCAH, KEiiTUCKY: SECTION 1. DEFINITIONS. Whenever in this ordinance the following terms are used, the•; shall be deemed and construed to have the meaning ascribed to them in this Section. STREET. Any place commonly used for the purpose of public travel excepting alleyways. ROAMIAY. That portion of a street between the regularly established curb lines. INTERSECTION. The area embraced within the prolongation of the property lines of two or more streets which join at an angle, whether or not one such street crosses another. CROSSWALK. �I That portion of the roadway included within the prolongation of sidewalk lines at street intersections, and such other places as may be designated by boundary lines upon the surface of the roadway. SAFETY ZONE. That portion of a roadway reserved for the exclusive use of pedestrians. LOADING ZONE. That space adjacent to a curb, reserved for the exclusive use of vehicles or street cars actually engaged in the loading or unloading of passengers or materials. 1 NO. 476. VEHICLE. Any device other than a street car, upon or by which any person or. ;( 0;'.;:, I material mag be transported upon a street, which shall include all agencies I for the transportation of persons or property over the public streets, except road -rollers and those vehicles traveling exclusively on rails. STREET CAR Any device traveling exclusively upon rails upon designated streets with the consent of the City. PEDESTRIAN. Any person afoot. OPERATOR. Any person who is in actual physical control of a vehicle or street car. RIGHT OF IVAY. The privilege of the immediate use of the street. ii PARK. To stand a vehicle for a period of time greater than is reasonably necessary for the actual loading or unloading of persons or materials, TRAFFIC. The lawful and orderly use of the streets for purposes of travel pedestrians, vehicles and street cars, both singly and together. CENTRAL TRAFFIC DISTRICT. All streets included in that portion of the City of Paducah, i bounded and described as follows: "Beginning at the southeast corner of the intersection of Washington and First Streets, and running westerly to the south- west corner of the intersection of 7th & Washington Streets; thence Northerly to the northwest corner of the intersection of 7th and Monroe Streets; thence easterly to the northeast corner of the intersection of Monroe and Second Streets; thence southerly, to the northeast corner of the intersection of Second and Jefferson Streets; thence easterly to the intersection of First and Jefferson Streets; thence in a southerly direction to the point of beginning:" BUSINESS. DISTRICT Any block in which fifty (50e) per cent or more of the frontage' E is used for retail or wholesale business purposes; and'ahen so established F by the General Council, any block immediately adjacent to such block may, in the discretion of the General Council, be embraced therein. NO .477. -- ---- --=w SECTION 2. AUTHORITY OF POLICE. '' .. Obedience to Police. Officers of the Police Department shall,i by voice, hand, electric signal or other signal, direct all traffic, sand it shall be unlawful for any person to refuse or fail to comply with any lawful order, signal or other lawful direction of a police i officer, and further provided, it shall be unlawful for any person other than an officer of the Police Department, or a person deputized by the Chief of Police, to direct or to attempt to direct traffic by voice, hand or other signal. SECTION 3. The General Council shall provide for the placing and maintenance of signs required under the provisions of this Ordinance, 11 and any provision of this Ordinance which requires the maintenance of a sign shall not be enforceable against the alleged violator, if, at I the time of the alleged violation, such sign be missing, effaced, mutilated, or defaced, so that an ordinarily observant person would not be apprised of the existence of same. SECTION 4. OBEDIENCE TO TRAFFIC SIGNALS. It shall be unlawful for any person to disobey the instructions of any mechanical traffic signal, lettered traffic sign or paint mark placed upon the surface of the roadway, in accordance with the provisions of this Ordinance, or any authorized barrier or sign erected by any of the public departments or public utilities of the ;City of Paducah. i �I SECTION 5. ( / :1w S :TRAFFIC SIGNAL LEGEND. The following signals for the direction of traffic are herebyq93a authorized: 6�q RED, when shown in any mechanical traffic signal, except in 'flashing signals, requires that traffic shall stop and remain standing. j GREEN, when shown in any mechanical traffic signal, requires that traffic shall move and remain in motion, except when stopped for the purpose of avoiding an accident or in case of other emergency, or when stopped at the command of a Police Officer. YELLOW OR BELLS; Yellow signal, or the ringing of bells in connection with any mechanical traffic signal shall indicate preparation for a change in the direction of traffic movement. When such signal is flashed, or the ringing of a bell is sounded, no traffic shall enter an intersection until a green or "Go" signal is shown. No. 476. SECTION 6. It shall be unlawful for any unauthorized person to erect or display any device upon or in view of any street, which device is an imitation of an official traffic sign, which directs or purports to direct the action of operators of vehicles, or the movement of traffic, or to wilfully deface, injure, move or interfere with any sign placed in compliance with the provisions of this Ordinance. SECTION 7. PEDESTRIANS: Use of Sidewalks, Crosswalks and Safety 'Zones. It shall be unlawful for the operator of any vehicle to drive into a safety zone or to drive into any sidewalk or crosswalk area, except at a regularly estqblished driveway or roadway. SECTION S. PEDESTRIANS RIGHT 0: V -1 -AY IN CROSS7,ALKS. In any crosswalk where traffic is not being directed by a Police Officer or by a traffic signal, pedestrians shall have the right of way over vehicles; provided, that any pedestrian desiring the right of way shall give warning of his intention to cross by raising the hand, palm out, toward approaching traffic. It shall be unlawful for the operator if any vehicle to drive into such crosswalk until such pedestrian shall have passed in front of said vehicle. SECTION 9. SCHOOL CROSSINGS. The Police Department is hereby authorized to mark with paint, I or other device, any crosswalks in the vicinity of public schools, where in the opinion of the Police Department, the crossing of such right of way by school children is deemed dangerous. Said Police Department is hereby further authorized and requi: i to place and maintain signs pointing in the direction of said school crossing, together with the words. "School Crossing", and hundred feet I; distant from each crosswalk established as above provided, and it shall 'ed be unlawful for the operator of any vehicle or street car to drive into a crosswalk where there is displayed a sign with the words, "School Crossing", when there is in said crosswalk, upon the side of the roadway i upon which said vehicle is traveling, any pedestrian engaged in crossing the street. W NO'. 419.' SECTION 10. 'i USE OF ROAD':7eY5. It shall be unlawful for any person to stand or walk in the roadway other than in a safety zone, or in a crosswalk, if such action 'interferes with the lawful movement of traffic, provided; that no pedestrian shall cross a roadway other than by a route at right angles to the curb, or by the shortest route to the opposite curb, and provided; further, that in the Central Traffic District no pedestrian shall cross a roadway other than by a crosswalk. SECTION 11. Police Required to Establish Crosswalks. The Police Department is hereby authorized and required to establish and maintain painted signs or other devices, or paint marks, upon the surface of the roadway, crosswalks approximately equal in width to the adjacent side walks at all intersections in the Central Traffic District and in all Business Districts, and in addition, may establish a crosswalk fifteen (15) feet in width as near the middle as is practicable of any block in said Central Traffic District exceeding four (400) hundred feet in' length. SECTION 12. Pedestrians to Obey Signals. At intersections where traffic is directed by a Police Officer or by a Traffic Signal, it shall be unlawful for any pedestrian to cross the roadway other than with released traffic. SECTION 13. Pedestrians Standing On Sidewalks. In the Central Traffic i District or any Business District, it shall be unlawful for any I pedestrian to stop or to stand on the sidewalk, except as near as is :physically possible to the building line or the curb line. ii SECTION 14. f RULES FOR DRIVING. ti o Turning. It shall be unlawful for the driver of anyn_cJ� v i vehicle to violate or fail to comply with any of the provisions herein-yao-G lyj after in this Section set forth; ' (A) When turning to the right at an intersection of public highways, vehicles shall keep to the right of the center, and in turning to the left, shall pass to the left side of the center, keeping, however, 'as far to the right as is possible so to do and still pass to the left of said center. For the purposes of this sub -section the "center" shall be held to meen the meeting point pff the medial lines of the two highways. NO. 480. N (B) No vehicle shall turn to the left at intersection of J Broadway at Second, Third, Fourth, Fifth, Sixth and Seventh Streets at any q U g}� time. (C) No vehicle shall be turned on Broadway from and including Second Street to the City Limits in such a manner as will cause the � �y�93 same to proceed in an opposite direction upon the street upon which said /1z io vehicle is traveling at the tin::e of entering said intersection. This is commonly known as making a "U" turn. c (D) Right turns may be made at any intersection outside the Central Traffic District at any time; provided, however, that the I operator shall not turn said vehicle to the right at any intersection i jor into an alley or driveway unless said vehicle is, at the time of I turning, in the line of traffic nearest the curb to the right of said vehicle. SPEED. No operator of a vehicle on a public highway shall drive at a greater speed than is reasonable and proper, having regard for the traffic and the use of the highway; Provided that (E) On Streets in the Business District, if the rate of speed for the passenger automobile shall exceed 15 miles an hour, it shall be prima facie evidence of unreasonable driving. I (F) On streets in the residence portion of said City, if the rate of speed of passenger automobiles shall exceed 20 miles an hour, it shall be prima facie evidence of unreasonable and improper driving. J (G) On streets or public highways outside of the business or �! residence districts of said City, if the rate of speed of passenger automobiles shall exceed 30 miles an hour, it shall be prima facie evidence of unreasonable and improper driving. (H) Trucks of the capacity of one ton or less as rated by the manufacturer and equipped with rubber tires, shall comply with the jprovisions of sub -sections "E", "F" and "G", hereabove set forth, excepts the respective speeds in each instance shall be ten, fifteen and twenty i; miles and hour. I (I) Trucks of the capacity of more than one ton, but less than two and three-quarter tons, as rated by the manufacturer and equipped with rubber tires, shall comply with the provisions of "E", "F° and °G", �i I except the respective speeds shall be twelve, fourteen and twenty miles an hour, (J) Trucks of the capacity greater than two and three quarter i tons as rated by the manufacturer and equipped with rubber tires, shall comply with the provisions of "E", "F" and "G" as aforesaid, except the is respective speeds shall be seven, eleven and fifteen miles an hour in each instance. I NO 48 ,__i (K) Trucks equipped with iron and steel tires and trucks . equipped with rubber tires, but touring or trailing vehicles with iron or steel tires, shall comply with the provisions of "E", "F" S11 and "G" aforesaid, except the respective speeds shall be six, eight, and ten miles an hour in each instance. (L) Trucks with capacities as set out in sub -section "H" and "I" pulling trailers of such capacity that the combined capacities mould be equal the capacities set -out in sub -sections "I" and "J" respectively shall comply with the provisions of said sub -sections "I" and "J" The provisions herein shall not apply to vehicles orined and operated by the Fire, Police and Hospital Departments of said City. I SECTION 15. It shall be unlawful for the operator of a vehicle to drive said vehicle out of an alley or driveway unless such vehicle has been brought to a complete stop immediately prior to crossing the sidewalk. SECTION 16. It shall be unlawful for any person to operate or to stand any vehicle on any street in such a manner as to obstruct the free use of such street. SECTION 17. I SCATTERING LOAD: It shall be unlawful to operate any vehicle so loaded or constructed that any part of its load is dropped upon the roadway. SECTION 18. 'r BOULEVARD RIGHT OF :7AY. Vehicles traveling in a lawful manner upon the following streets shall have the right of way over vehicles L=°G/a approaching from intersecting streets: Broadway to the City Limits. w`L Third Street from Kentucky Avenue to Broad Street; Jefferson Street from First to 18th Street; Kentucky Avenue from First to Ninth Street, inclusive, and Murrell Boulevard from Kentucky Avenue to Tennessee Street. Upon approaching any of the above named streets, it shall be unlawful for t'ne operator of any vehicle to fail to bring said vehicle to a complete stop at the limit line which the Police Department is hereby authorized and required to indicate by a sign or mark at the property line of the above mentioned streets; provided, however, that when the intersection is controlled by a Police Officer or by a Traffic Signal, no vehicle shall be stopped as above provided when a signal to proceed has been given. - NO. 482. SECTION 19. PROPER PLnCE To PARIS: All vehicles not in motion shall be placed with their right sides as near the right curb of the street as practicable. I STREET DIVIDED BY PARK'.7AY: On an avenue or street longitudinally divided by a parkway, walk, sukenway or viaduct, operators or drivers shall keep their vehicles to the right of such sub -division. SECTION 20. h: FOLLO'aING FIRE APYHRATUS PROHIBITED: i It shall be unlawful for the operator of any vehicle to follow any fire apparatus closer than one block, or to park any vehicle f. j within one (1) block where fire apparatus has stopped in answering a fire alarm. VEHICLES NOT TO PaSS OVER NOSE: Whenever any hose of the Fire Department is laid upon any public highway for the purpose of being used by the Department, it shall be unlawful to drive over same. SECTION 21. RIGHT OF l;•sY OF FUNERGL PROCESSIONS: Funeral processions shall have the right of way over all other traffic, except for ambulances in emergency cases and as otherwise hereinafter provided. SECTION 22. MOTORCYCLES aND BICYCLES: It shall be unlawful for the operator of any bicycle or ! motorcycle to carry any other person i1pon the bar, handle -bar, or tank of any such vehicle. SECTION 23. CLINGING TO MOVING VEHICLi?S: i It shall be unlawful for any person traveling upon any bicycle, motorcycle or any toy vehicle to cling to or attach himself or I his vehicle to any other moving vehicle or street car upon any roadway of the City of Paducah. SECTION 25. STkNDING FOR LO!iDING ONLY IN CERTAIN PLACES: It shall be unlawful for the operator of a vehicle to stop said vehicle for a period of time longer than is necessary for the loading or unloading of passengers or materials; provided, that the unloading of passengers shall not consume more than three (3) minutes, nor the loading or unloading of materials more than thirty (30) minutes in the following designated places: (A) In any loading zone. (B) At any curb within twenty-five (25) feet of the entrance to any hospital; (C) At any Curb within fifty (50) feet of the entrance to any Police or Fire Station. The Police Department is hereby authorized to determine the exact location of loading zones provided, that not more than one-half of the total curb length of any block in the Central Traffic District, or in any Business District, shall be reserved for loading zones, where, in said block, the distance between the curb line and the outer rail of any street car track is loss than fifteen feet, and that not more than one-fourth of the total length of any curb between street intersections in any other block in the Central Traffic District SECTION 24. G r` STOPPING, STPiNDING AND PARKING: N `' Standing Prohibited in Specified Places. Except to i avoid conflict with other traffic, or in compliance with the directoris of a Police Officer or a Traffic Signal, it shall be unlawful for the i i operator of a vehicle to stand said vehicle in the following places:) (A) In an intersection. (B) In any crosswalk. (C) :t any place in the roadway where the two right wheels of the vehicle are more than one (1) foot distant from the regularly established curb line, except on streets where provision has been made for angle parking in another section hereof. (D) In any place -here the standing of a vehicle will obstruc the use of any driveway. (E) At any curb within six. (6) feet of a fire hydrant. (F) At any place between a safety zone and the nearest curb, or any place within twenty feet of a point of the curb immediately j opposite the mid -block end of any safety zone. The Police Lepartment is hereby authorized and required to paint and maintain a line stenciled with white letters, "No Standing" upon the top of all curb lengths indicated in Sub -sections "E" and "F" of this Section. SECTION 25. STkNDING FOR LO!iDING ONLY IN CERTAIN PLACES: It shall be unlawful for the operator of a vehicle to stop said vehicle for a period of time longer than is necessary for the loading or unloading of passengers or materials; provided, that the unloading of passengers shall not consume more than three (3) minutes, nor the loading or unloading of materials more than thirty (30) minutes in the following designated places: (A) In any loading zone. Said Police Department is hereby further i authorized and required to paint and maintain a line stenciled in letters, i "Loading Only" upon the tops of all curbs and the places specified in j' this Section. SECTION 26. PARKING LIMITED IN SPECIFIED ZONES: Subject to the provisions in Sections 24 and 25 of this Ordinance, it shall be unlawful for the operator of any vehicle to nark same on Broadway from a point 160 feet west of the southwest corner of Second and Broadway Streets to 7th Street, inclusive, before the hour of 9:30 A. IL., and from 4:30 P. LI., to 6:00 P. M., on all days, except Saturday. On Saturday no parking shall be allowed before 9:15 A. M., and from 4:30 P. M., to 9:00 P. Id. On both sides of Broadway from First Street to a point 160 feet west of the southwest corner of the intersection of Second and Broadway Streets, parking is permitted for one hour from 5:00 A. M., -to 10:00 A. M., om all days except Saturdays. On Saturday parking is I permitted on said street fon one hour, from 5:00 A. M., to 6:00 P. Iii., and no narking thereon will be allowed on Saturday from 6:00 P. h., to 9:00 P. M. SECTION 27. Paring is prohibitedon the following streets and parts of streets: (1) On west side of First Street, twenty feet south from the Broadway property line. (2) On east driveway of Second Street, on east side of I street, fifteen feet south from Broadway property fine and fifteen feet north from the Kentucky Avenue line. (3) On west driveway of Second Street, on west side of street, fifteen feet south from Broadway property line and fifteen feet I;north from the Kentucky Avenue property line. i I, (4) On the east side of Third Street from Kentucky Avenue to Jefferson Street. I (5) On the west side of Third Street sixty feet south from Broadway property line. (6) On the south side of Broadway, one hundred and sixty feet west from Fourth Street property line. I (7) On the east side of Fourth Street, from Kentucky Avenue to Jefferson Street. NO. 48 5. (8) On the wes; side of Fourth Street, seventy feet north from Broadway property line. On west side of Fourth Street, fifty feet south of Broadway property line. (9) On the east side of Fifth Street, from Kentucky Avenue to Jefferson Street. (10) In front of Post Office on Broadway, between 6:00 A. 1.1.,; i and 6:00 P. M. (11) On South side of Broadway, fifty feet west from Fifth Street property line. (12) On North side of Broadway, fifty feet east from Fifth 1 Street property line. (13) Twenty feet from property lines at All other street intersections in the Central Traffic District not other:vise mentioned except on Second Street between Kentucky Avenue and ',Washington Street which shall be five feet therefrom, on account of reservation for express wagons. SECTION 28. Subject to the provisions of Sections 24 and 25 and 26 and 27, angle parking will be permitted on the following streets, or parts of streets: (1) On east driveway of Second Street, on east side of drive- n way, and on '.=rest driveway of Second Street, on the west side of drive- way at an angle of 45'�' for not more than one hour. SECTION 29. Right angle parking subject to the provisions of Sections 24,X7 Q-"- 25, 26 and 27, is hereby permitted on the following named streets or -��� 53z parts of streets: (1) On both sides of Kentucky Avenue from First to Third Street. (2) On both sides of Second Street from Kentucky Avenue to Washington Street. (3) On both sides of Second Street from Broadway to Monroe Streets. (4) On west side of Third Street from Washington to :Jefferson Streets. (5) On south side of Jefferson from First to Seventh Streets. (6) On west side of Fourth Street from Kentucky Avenue to Jefferson Street. (7) On west side of Fifth Street from Kentucky Avenue to Jefferson Street. (8) On both sides of Seventh Street from Kentucky Avenue to Jefferson Street. NO. 486. SECTION 30. Subject to the provisions of Sections 24, 25 and 26 and 27, parallel parking will be permitted on following streets: (1) On First Street south of Broadway. R (2) For commercial vehicles only on Second Street, on west side of east driveway and on east side of west driveway, provided wheels of cars are not more than six inches from the curb line of the market QIhouse. After regular market hours passenger vehicles or other vehicles may park in these places. (3) On both sides of Kentucky Avenue from Third to Seventh /.J Street. CEJ I (4) On North side of Jefferson Street from First to Seventh Streets. (5) On east side of Third Street, from Kentucky Avenue to Washington Street. (6) On both sides of Sixth Street from Kentucky Avenue to Hefferson Street. (7) On both sides of Broadway from First to Seventh Street subject to the provisions of Section 26 of this Ordinance. (8) All cars parked parallel must keep their right wheel8.wi1thin six inches of the curb. (9) The west driveway of Second Street from Broadway to Kentucky rivenue, will be used for south bound traffic only, and east i driveway of said street for north bound traffic only. SECTION 31. It shall be unlawful for the operator of any vehicle to park same other than in accordance with the provisions hereinabove set forth. Unless otherwise specified, parking is prohibited for twenty feet from the corner of each intersection. The Police Department is hereby authorized to paint marks, orl by other devices, to indicate the position of the above regulations. SECTION 32. PARKING VEHICLES FOR SALE: I; It shall be unlawful for the operator of any vehicle to park upon any street in the pity of Paducah any vehicle upon which there is a j; "For Sale" sign, or to park upon any street any vehicle for the purpose of displaying it for sale. SECTION 33. STREET CARS HAVE RIGHT OF ' iff BET'v'JEEN INTERSECTIONS: It shall be unlawful for the operator of any vehicle proceed- ing upon any street car tracks in front of a street car to fail to remove i! said vehicle from said tracks so soon as practicable after signal from I from the operator of said street car unless prevented by other vehicles or while awaiting a traffic signal. SECTION 34. It shall be unlawful for the operator of any train or trains of i! cars to operate the same in such a manner as to prevent the use of I street for purposes of travel for a period of time longer than five minutes. SECTION 35. STREET CAR SPEED: It shall be unlawful for the operator of any street car to drive said street car at a rate of speed faster than hereinafter in this Section provided: (1) Ten (10) miles per hour at obstructed ,grade crossings, when engaged in turning curves that are obstructed, when crossing obstructed highway crossings, when passing schools while persons are entering or leavint* the grounds and within the business district. (2) An average of twelve (12) miles per hour in residence districts. (3) Twenty-five (25) miles per hour at all places other than those specified in paragraphs 1 and 2 of this Section. SECTION 36. It shall be unlawful for the operator of any vehicle upon over -taking any running street car at a point within 100 feet of any ' approaching street intersedtion, to pass any street car; or to pass any street car which is stopped for the purpose of loading or unloading passengers until such vehicle has been brought to a complete stop to the rear of the nearest entrance of such street car, and said vehicle shall i remain standing until all doors of said street car shall have been closed or all passengers have boarded or alighted from street car, unless there is in the roadway a marked safety zone, in which case vehicles stopped in compliance with the provisions of this Section may proceed with dud regard to the safety of pedestrians in the roadway. Police Department is hereby authorized to place and maintain by the use of traffic buttons or painted lines, safety zones at all regular street car stops in the City of Paducah, where, in its discretion, safety zones are required for the safety of pedestrians. No. 486'. SECTION 37. BOARDING STREET CARS: It shall be unlawful for any person to board or alight from a street car or vehicle while said street car or vehicle is in motion. RIDING ON CAR STEPS: It shall be unlawful for any person to ride upon the fender or running board of any street car or vehicle. SECTION 39. EXCEPTIONS: That, notwithstanding any other Section of this Ordinance, the provisions of this Ordinance shall not apply to emergency vehicles of the Police Department, or of the Fire Department of the City of Paducah, nor to any public utility, while any such vehicle is actually engaged in the performance of emergency duties necessary to be performed by said public departments or by any such public utility. SECTION 40. 9 LI GHT S. Automobiles, bicycles and other vehicles are required to display lights as follows; (1) At the rear, one lighted lamp showing red, visible 200 feet away. (2) When in operation bicycles and two wheeled motor- cycles shall have at least one, and all other vehicles including three wheeled motorcycles, except horse drawn vehicles which shall display at least one light, shall have at least two lighted lamps in front, showing, white, or tinted other than red, and of sufficient power to clearly reveal substantial objects at least 250 feet away, except bicycles, buggies, wagons or horse-drawn vehicles, which are not required to have lights of such intensity. SECTIO14 41. CONSTRUCTION OF 03 DINjiNCE: Should any Section or provision in this Ordinance contained be construed or held by the Courts to be invalid, such decision shall not affect the remainder of this Ordinance. SECTION 42. PENALTY: NO. 489. Any person violating or failing to comply with any of the provisions of this Ordinance, (or any rule or regulation of the IPolice Department, adopted pursuant thereto) shall be gmilty of a i II misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Five ($5.00) Dollars, and not more than One Hundred ($100.00) Dollars, or by imprisonment in the City Jail for a period not to exceed fifty (50) days, or by both such fine and i imprisonment. SECTION 43. All ordinances and parts of ordinances in conflict herewith II are 4ereby repealed, and this Ordinance shall take effect and be in force from and after its passage, approval and publication.
