WHEREAS, the General Council of the City of Paducah has
heretofore, to -wit; on the 4th day of September 1924, adopted an ordinance
entitled "AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF CONCRETE SIDEWALKS
AND GUTTERS, AND CURBS OF EITHER CONCRETE OR GRiiNITE, ACCORDING TO 'PHE BID
ACCEPTED, INCLUDING ALL INTERSECTIONS NOT HERETOFORE CONSTRUCTED, AS SHOO

BY THE PLANS OF THE CITY ENGINEER THEREFOR, TOGETHER '.'LITH ALL NECESSARY
MANHOLES, INTAKES, CATCH BASINS, CAST IRON DRAIN PIJIYES AND SEWER PIPE
CONNECTIONS, ON THE FOLLOWING NAMED STREETS, TO-IVIT: ON THE SOUTH SIDE

WITH THE PLANS AND SPECIFICATIONS FURNISHED BY THE CITY ENGINEER OF Si+ID

CITY, AT THE COST OF THE ABUTTING PROPERTY OIVNERS, AND PROVIDING THAT TIIi;.
COST OF SAME MAY BE; PAID IN ACCORDANCE WITH THE PROVISIONS OF THE 10 YEAR,
PAYMENT PLAN"; and,
WHEREAS, In accordance with said ordinance it was provided
that the cost of construction of said concrete sidewalks, curbs, and
gutters be paid for by the abutting property owners on both sides thereof;
except that portion to be paid by the City of Paducah, Kentucky, as

required by law; and,
WHEREAS, pursuant to said ordinance a contract was entered
\into on the 5th day of September, 1924, between George F!. Katterjohn,
Jr., of Yaducah, Kentucky, and said City for the construction thereof;
and,
WHEREAS, said contract has been completed except that portior

of same which has been held up by order of the City Engineer of said
City on account of the fill required, and for the completion of which
the time has been extended by order of said General Council, and the
same has been duly-.e.ccepted by the General Council on the 20th day of
April, 1925, pursuant to the recommendation of the Board of Public
Works of said City;
NOW, THEREFORE, BE IT ORDAINED BY THE GENERAL COUNCIL OF THE
CITY OF PADUCAH, KENTUCKY:
SECTION 1.
All property on the south side of Burnett Street from the
west property line of 10th Street to the east curb line of 14th Street;
on the no?•th side of Burnett Street from the west curb line of 10th
Street to a point where Burnett Street intersects the north property i
line of Trimble Street; both sides of 13th Street from the north I
property line of Burnett Street to the south property line of Faxon
Street; both sides of 13th Street from the north property line of i
Jefferson Street to the south curb line of Trimble Street, in the City
of Paducah, Kentucky, as shorn by the City Engineer's estimate of
cost of same, be, and the same is, hereby assessed for the cost of
construction of conefete sidewalks, curbs and gutters, together with
all necessary manholes, intakes, catch basins, cast iron drain pipes,
and sewer pipe connections as follows:

said cost in the office
of said City Engineer, now referred to and made part hereof.
SECTION 2.
That the funds from the assessment of said property shall
be used for the purpose of paying 6ff the special tax bills issued
against said property, or such bonds as may be issued.by the City of
Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes.

SECTION 3.
That pursuant to Section 3101 of the Kentucky Statutes, said
tax assessment may, at the option of the property owners, be payable
in cash without interest within 30 days from the date of the passage and
publication of this ordinance, or in ten annual installments, provided the
property owners shall before the expiration of said 30 days enter into an
agreement in writing with said City, in accordance with the provisions of
Section 3101 of the Kentucky Statutes.
SECTION 4.
In order to provide a fund for the immediate payment of the
cost of that portion of the special assessment herein provided for, which
may be paid for on the installment plan, as hereinbefore provided, the City
of Paducah, Kentucky, mar issue and sell imporvementA' bonds, and to secure
the payment of such bonds there is hereby pledged such taxes and liens on
the property assessed herein for the payment of the principal and interest,
but such bonds shall not be sold for less than par, and the proceeds derived
therefrom shall be applied exclusively to the payment of the cost of said
construction as hereinlaefore provided, and such bonds if issued, shall
bear interest and shall be payable in accordance with the provision of
Section 3101 of the Kentucky Statutes as amended by Act of 1910.
SECTION 5. _
This ordinance shall take effect and be in force from its
passage, record and publication.
