A RESOLUTION DECLARING THE CONSTRUCTION OF SANITARY
SEWERS IN SEWER ZONE THREE, IN SUB -DIVISION A AND B, SEWER DISTRICT
NUMBER THREE, TO BE A NECESSITY, AND SETTING OUT, IN GENERAL TERMS,
THE PROPERTY SUBJECT TO THE PAY1,1ENT OF THE COST OF SAME.
WHEREAS; There has been created and established
in the City of Paducah, Kentucky, Sewer District No. 3, which has
been divided into Sub -Division A, B, and C; and,
WHEREAS; There is being constructed, in said
Sewer District, trunk line sewers at the cost of the City of
Paducah, 'Kentucky, which trunk line sewers have now been completed;
and,
-F WHEREAS, There has been created and established,
Sewer Zone Number Three, in Sub -Division A.apd.B,• Se,ffei District No.
3, by an Ordinance adopted by the Board of Commissioners on the 23rd
day of February 1923, wherein said Zone is described by metes and
bounds, and is hereinafter described, and a plot of`1which Stone
appears on file in the office of the City-Engineer•of the City of
Paducah, Kentucky, and may be inspected by anyone making application
therefor at said office; and,
WHEREAS; Sewer Zone Number Three in Sub -Division
A and B, Sewer District No. 3, is not provided with sewers and is in
a thickly populated territory, and in order to provide adequate
sewers for the property owners in said Zone, it is hereby deemed

and declared a necessity by the General Council of the City of

Paducah, Kentucky, that sanitary sewers be constructed in said zone
in order to provide adequate sewerage for the property owners re -
i
siginjin said Zone; NOW, THEREFORE,
BE IT RESOLVED BY THE GENERAL COUNCIL OF THE CITY
OF PADUCAH, KENTUCKY:
--SECTION I.
That it is hereby declared a necessity by the
General.Council of the City of Paducah, Kentucky, in order to
secure adequate sewerage, and in order to protect the health of the
j citizens residing in sewer zone Number Three, Sub=Division A and B
Sewer District Number Three, that sanitary sewers he constructed
and laid out at the cost of the lots of parcels of land henefitted

thereby, and all of the lots or parcels of land embraced in said
Zone are hereby declared to be the property benefitted, and subject
to be assessed for the cost of constructing said sewers.
--SECTION 2.__
Said Sewer Zone Number Three of Sub -Division
A and B of Sewer District Number Three, in which said sewers are to be
constructed is described by metes and bounds as follows, to -wit:
"Beginning at the intersection of the center
line of Brakeman Avenue and Baumer Avenue; thence with
the center line of Baumer Avenue, in a westward direction;
to a point 150 feet east of the intersection of the
center line of Baumer Avenue and the south property line
of that part of Smithland Avenue North of Baumer Avenue;
thence at right angles southward 197 feet; thence at
right angles westward 189 feet; thence deflecting 107
degrees 13 minutes to the left, 140 feet; thence deflec-
ting 84 degrees 53 minutes, to the right, 183.2 feet;
thence deflecting 97 degrees 27 minutes, to the left,
318 feet; thence deflecting 90 degrees to the right,
188.4 feet, to a point in the center of the Mayfield
Road, 175 feet southward from the center line of
Wheeler Avenue, measured along said center line of the
hayfield Road; thence at -.-right angles southward with
the center of the Layfield Road 225 feet; thence at
right angles westward 190 feet; thence at right
angles northward, parallel to the Mayfield Road, to
a point on the south property line of an alley, if
extended, said point being 210 feet, more or less,
south of the south property line of Wheeler Avenue;
thence westward with the south property line of said
alley 680 feet, more or less, to the center of B
Street; thence northward with the center of,B Street
to a point on the center line of an alley, said point
being 338 feet north of the center line of Wheeler
Avenue; thence at right angles eastward with the
center line of said alley 396 feet to the center of
A street; thence at right angles northwmrd with the
center of A Street 21 feet; thence at right angles
eastward 193 feet to the center of an alley; thence
at right angles northward with the center of said
alley 96 feet to a point 59 feet south of the south
property line of Guthrie Avenue; thence at right
angles eastward, parallel to Guthrie Avenue 163 feet,
to the west property line of the Illayfield Road;
thence northward with the west property lines of the
Mayfield Road and Goebel Avenue 159 feet to a point
40 feet north of the north property line of Guthrie
Avenue; thence at right angle8 westward 163 feet
to the center of an alley; thence at right angles
northward with the center line of the alley and
said center line extended, 720 feet more or less,
to the center line of Worten Avenue, if extended;
thence at right angles eastward along the center line
of Worten Avenue, if extended, 203 feet to the east
property line of Goebel Avenue; thence at right angles
northward with the east property line of Goebel -venue
126 feet to a point 106 feet north of the north
property line of Worten Avenue; thence deflecting
90 degrees 18 minutes, to the right in an easterly
direction and following the rear boundaries of lots
fronting on Morten .=venue 186 feet; thence deflecting
12 degrees 46 minutes, to the right, continuing to
follow the rear boundaries of lots fronting on Worten
Avenue, 132.5 feet; thence deflecting 28 degrees 10
minutes, to the right, continuing to follow the rear
boundaries of lots fronting on Borten Avenue 329.7
feet, to the center of Tennessee Street; thence de-
flecting 85 degrees 3B minutes, to the left, in an
easterly direction along the center line of 'Tennessee
Street 126 feet, more or less, to a point 221 feet
from the east property line of S9orten Avenue; thence
at right angles in a southerly direction 155 feet; thence•,
at right angles westward 95 feet to the center of an
alley, a point 126 feet east of the east property
line of Worten Avenue; thence at right angles south-
ward on line with the center of said alley to the
center of Brakeman Avenue; thence southward along
the center of Brakeman Avenue, to the point of be-
ginning.

"Beginning at a point on the east property
line of the Mayfield Road 300 feet north of the north
property line of Cedar Avenue, said 300 feet being
measured along said east property line of the Idayfield
No. 2B7.
Road; thence southward along the east property
line of the Mayfield Road 100 feet; thence at
right angles westward to a point 168 feet west-
ward from the west property line of the I.iayfield
Road; thence at right angles southward on a line
parallel to the 1:11ayfield Road, to a line which
runs at right angles to the hayfield Road and
which intersects the east property line of said
road 300 feet southward from a point where the
east property line of said road is intersected
by the south property line of Quarles Avenue;
thence at right angles eastward to a point 168
feet eastward from the east property line of
said road, said 168 feet being measured parallel
to auarles Avenue; thence at right angles north-
ward on a line parallel to the 1.1ayfield Road, to
a point 300 feet northward from the north prop-
erty line of Cedar Avenue, said .300 feet being
measured parallel to the Mayfield Road; thence
westward, parallel to Cedar Avenue, to the point
of beginning ".
I! --SECTION 3. --
Said sewers shall be constructed along and under
the following named streets and alleys in Sevier Zone No. 3, in
Sub -Division A and B Sewer District No. 3, and the cost of same
shall be apportioned against all the property in said sewer `Lone
as follows:
(1) All the lots or,parcels of land bounding or
abutting on the hereinafter named streets, alleys or highways

along or under which such sewers shall be constructed are hereby
declared to be the property benefitted thereby, and said cost
shall be apportioned and assessed equally against said abutting

j lots or lands according to the abutting feet thereon, provided
i
that the costs of said construction does not exceed °;2.00 per
abutting foot.
(2) In the event the cost of construction of said
sewer shall exceed °12.00 per abutting foot, along said streets,
alleys or highways whereon said sewer shall be constructed, then
such cost shall be apportioned against all of the lots or lands
insaid sewer zone benefitted by said sewer, according to the area
in square feet of the lots of lands so benefitted.
And which streets, alleys or highways along which
said sewer shall be constructed are described as follows, to -wit;
On A Street, commencing at the proposed
sewer on 'o7heeler Avenue, and running thence north-
wardly on A Street to a point 300 feet from the
center line of wheeler Avenue,

On Goebel Avenue, commencing at the end of
the present trunk line sewer on Goebel Avenue,
which point is 73 feet northward from the center
line of Guthrie Avenue, and running thence north-
wardly on Goebel Avenue to a point 70 feet south-
ward from the center line of worten Avenue, a
distance of 623 feet from the point of beginning.
The beginning of said sewer being at a point on
Goebel Avenue, 73 feet northward from the center
line of Guthrie Avenue, and the end of said sewer
being at a point 696 feet northward from the center
line of Guthrie Avenue.
On Tennessee Street, commencing at the end of
the present trunk line sewer at the intersection of
Goebel Avenue, Tennessee Street and the Iayfield Road,
at a distance of 73 feet northward from the center line
of Guthrie _venue, and running thence northeastwardly
on Tennesee Street to a point 350 feet from the point
of beginning.
On Tennessee Street, commencing at the proposed
sewer on Worten Avenue, and running thence southwest-
wardly along Tenaessee Street, a distance of 348.2 feet
from the center line of Worten Avenue.
On Tennessee Street, commencing at the proposed
sewer on l'lorten Avenue', and running thence northeast-
wardly along Tennessee Street, a distance of 232 feet
from the center line of Worten _.venue.
On Smithland Avenue, commencing at the proposed
sewer in a Street or alley known as Baumer Avenue, and
running thence northeastwardly aloijg Smithland Avenue
to a point 360 feet from the center line of a street
or alley known as Baumer Avenue.
On Worten Avenue, commencing at the proposed
sewer on Smithland Avenue and running thence northwest-
wardly along Worten Avenue, crossing Tennessee Street
to a point 532 feet on Worten Avenue Northwastwardly
from the center line of Tennessee Street, said point
being at a distance of 60 feet eastward from the center
line of Goebel Avenue.
On Smithland Avenue, commencing at the proposed
sewer on `ilorten Avenue,.and running thence northeast-
wardly along Smithland venue to a point in the center
line of Brakeman Avenue, a distance of 140.88 feet
from the center line of 'Torten Avenue.
On Brakeman :venue, commencing at the present
trunk line sewer at a point on Brakeman revenue 601.82
feet southward from the center line of Smithland Avenue
and ri�nr g thence northwardly on Brakeman Avenue to the
—center of Smithland Avenue, a distance of 601.82 feet
from i'N point where the present trunk line sewer
crosses Brakeman Avenue to the center line of Smith -
land Avenue.
On Baumer Avenue, commencing at the present trunk
line sewer on Baumer Avenue, at a distance of 570 feet
southeastwardly from the center line of Smithland Avenue,
and running thence northwestwardly along Baiuner Avenue
to the center line of Smithland Avenue, a distance of
570 feet from the point where the present trunk line
sewer crosses Baumer Avenue to the center line of
Smithland Avenue.
On Guthrie Avenue, east of the Mayfield Road,
commencing at the present trunk line sewer on the
Layfield Road, and running thence eastwardly on
Guthrie Avenue East of the Bayfield Road, a distance
of 325 feet from the center line of the Bayfield Road.
On Wheeler Avenue, commencing at the present
trunk line sewer on the Layfield Road, and running'
thence westwardly on Wheeler Avenue, c sssing�A Street
to a point 320 feet westward from the center line of
A Street, a total distance of approximately 725 feet.
All the above described lateral sewer lines are to
be constructed with 6 inch house connection service lines extending
from the sewer proper, to the property lines of all property abutting
onthe streets or alleys on which the above described lateral sewers are I
to be built, in such manner as to properly serve the property benefitted.
6 inch house connection service lines are to be con -
strutted from the present sewer lines, (built under the .1,600,000 bond
issue) to the property lines of all abutting property on the following

streets or alleys in such manner as to properly serve the property
benefitted.
On the hayfield Road from a ppint 340 feet north-
ward from the center line of Cedar Avenue; thence
southward along the I,iayfield Road to a point 3,iO
feet southward from the center line of Quarles
Avenue.
On the I:Iayfield Road and that portion of the
Mayfield Road known as Goebel Avenue, from a point
40 feet northward from the north property line of
Guthrie 3 enue, thence southwardly along the
hayfield load to a point 400 feet southward from
the center line of Wheeler Avenue.

Along the present trunk line sewer from the
intersection of the center lines of the Mayfield
Road and Wheeler "venue, end running thence east-
wardly North 88 degrees` along the present trunk
line sewer, a distance of 188.4 feet from the east
property line of the hayfield Road.
along the present trunk line sewer, commencing
at a point on the center line of Baumer ::venue at a
distance of 570 feet southeasterly from the center
line of Smithland ;venue, and running thence North
88 degrees, East along the trunk line sewer to the
center line of Brakeman ;venue, a distance of 60
feet from the center line of Baumer r --venue, to the
center line of Brakeman :venue.
SECTION 4.
Notice is hereby given to the owners of all prop-
erty in said 'Lone, and all property bounding or abutting on any of
said streets, alleys or highways, that the cost of construction of
said sewer will be assessed against such property in the manner
named hereinabove provided.
--1ECTION--5.
A Blue print or plat showing the boundary of Sewer
Zone No. 3, naming and showing the streets embraced in said Zone,
and showing the line and course of the sewer to be constructed here-
under, is filed herewith and made a part hereof, marked exhibit "A".
--SECTION 6 --
For additional information of the public and owners
of property in said ,one, a blue print or plat showing the boundary
of said sewer Zone and showing t$e s treets embraced therein, and
the line and course of the sewer constructed hereunder,.will be
found on file in the office of the City Engineer of the City of
Paducah, and may be inspected at any time upon application at said
office.
--SECTION 7 --
The resolutions heretofore adopted by the General
Council on April 21st, 1923, and October 16th, 1924, respectively, or
any previous resolutions in conflict herewith, are hereby repealed, and
this resolution shall take effect, and be in force from and after its
passage, approval and publication.
