ORDINANCE DECLARING THAT A GASOLINE FILLING.STATION, I'MEN LOCATED
NEAR A SCHOOL BUILDING, OR IN THE RESIDENTIAL SECTION OF THE CITY
OF PADUCAH, KENTUCKY, IS 1iGAIPiST THE PUBLIC PEACE, PUBLIC MORALS,
PUBLIC HEALTH, PUBLIC SAFETY, AND A NUISANCE, AND PROHIBITING THE
LOCATION, CONSTRUCTION, OR BUILDING OF A GASOLINE FILLING STATION
IN THE CITY OF PADUCAH, KENTUCKY, EXCEPT UNDER THE CONDITIONS HERE-
INAFTER SET OUT, AND PRESCRIBING THE CONDITIONS UNDER W!rIICH AN OIL
STATION MAY BE BUILT, LOCATED, OR CONSTRUCTED Iii' THE CITY OF PADUCAH,

KENTUCKY, AND FIXING A PENALTY FOR THE VIOLATION HEREOF.
BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADUCL
K,"]NTUCKY:

First. That a gasoline filling station in the residential l
section of the City of Paducah, Kentucky, or withd)n two (2) squares
of a public school in the City of Paducah, Kentucky, be and the same
is hereby declared to be against the public peace, public morals,
ipublic health, public welfare, of the City of Paducah, Kentucky, and
a nuisance and that no filling station be permitted to be located,
established, or built in the City of Paducah, Kentucky, except as

hereinafter provided.

Second. No gasoline filling station shall be located,
built, or established within the City Limits of the City of Paducah,
Kentucky, until the person, firm or corporation desiring to locate,

build or establish same shall have applied in writing to the Mayor
M
and General Council of the City of Paducah, Kentucky, for a permit
to locate, build, or establish such gasoline filling station, which
application for said permit shall contain the name of the person, firm,
or corporation, desiring to locate, build or establish said oil station,
,and the exact location where same.is proposed to be located, built or
!jestablished, and which application shall be filed with said Mayor and
�General Council for a period of two (2) weeks before such permit shalli
!be granted by the Mayor and General Council, and the notice of the
(filing of same, together with the name of the person, firm, or
;corporation desiring to locate, build or establish same, together with
the proposed place where said gasoline filling station is proposed to
be located, built, or established, shall be published in a newspaper of
igeneral circulation published in the City of Paducah, Kentucky, for
three (3) issues ,just previous to the meeting at which said application
(,shall stand for hearing, and the Mayor and Gdneral Council shall hear

Isaid application and all objections to the location, building or
,establishment thereof at the next regular meeting of said General
Council, afte`r'�jaid application has been on file for a period of two
(2) weeks, as herein provided, and if it appears to said Mayor and
General Council that the establishment or location of said gasoline

filling station at the place proposed, is against the public health,
public morals, public interest of the City of Paclicah, Kentucky, or a
nuisance, it shall refuse to issue a permit for the location, establishment
or building thereof, provided, however, that no permit shall be issued for
the location, establishment, or the building of a gasoline oil or filling'
I station within two squares of any public school building in the City of
Paducah, Kentucky.
Any.building permit heretofore issued by the fire chief of
the City of Paducah, Kentucky, or that may be hereafter issued by him for
a gasoline filling station shall not authorize the building or location
of such gasoline filling station until the person, firm or corporation,
locating or building same shall have first procured a permit as herein
j provided.
Any violation of this ordinance, or any provision thereof,
by any person, firm,or corporation, shall be guilty of.a misdemeanor and
shall be fined not less than Twenty -Five Dollars (25.00) or more than One
Hundred Dollars ($100.00), for each and efery offense, and each and every
day shall constitute a separate offense,
This ordinance hhall .take effect and be in force on and after
its passage, approval and publication.
