AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF STORM AND SANITARY
SE49ERS IN SEWER ZONE NO. 5, SUB -DIVISION A, SEWER DISTRICT NO. 3,
IN THE CITY OF PADUCiffi; KENTUCKY, AT THE COST OF THE PROPERTY OWNERS
THEREIN? AND PROVIDING THAT SAID SEWER SHALL BE CONSTRUCTED UPON THE
itTEN YEAR PAYTIENT PLAN, AND NAMING THE STREETS AND ALLEYS ALONG, UNDER
AND THROUGH ;',HICH SAID SEYdERS SHALL BE CONSTRUCTED, AND SETTING OUT
IN GENERAL TERT4S THE PROPERTY BENEFITTED THEREBY AND SUBJECT TO THE
PAYMENT OF THE COST OF SANTE.

WHEREAS, The Board of Commissioners of Paducah, Kentucky,
adopted an ordinance on February 23rd, 1923, dividing part of Sub -
Divisions A, B and C, in Sewer District No. 3, into five sewer zones
for the purpose of constructing sewers therein, so as to provide
adequate sewers for the property owners within said zones; and,
WHEREAS, Since the adoption of the aforesaid ordinances
the City of Paducah has by a vote abandoned. ;he Commission Form of
Government, and has returned to the old form of Aldermanic Government,
and by the express provisions of the law the acts, ordinances and laws,
enacted under either form of government remain in force under the
succeeding form of said government; and,
!^IHEREAS, The General Council of said City has adopted a
resolution declaring the construction of such sewers in said sewer
zone No. 5 to be a necessity; NOW, THEREFORE,
BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF
PADUCAH, KENTUCKY.
SECTION E.

the streets, alleys and highways, in Sewer Zone No. 5, in Sub -Division
A, Sewer District No. 3, in the City of Paducah, Kentucky, as follows,

to a point near Flournoy Street, a distance of 354.5 feet.

or alleys in which the above described sewers are to be built, in such

manner as to properly serve the property benefitted.
Six inch house connection service lines are to be
constructed from the present sewer lines (built under the $600,000
Bond Issue) to the property lines of all abutting property on the folio
Streets or alleys, in such manner as to properly serve the property
benefitted. )
Across private property from the 8-1/2 foot existing sewer
at 10th.and Flournoy Streets southward to Flournoy Street and
southward on Flournoy Street to 11th Street.
11th Street from Flournoy Street to Palm Street.
Across private property and city property from a point in
the 8-1/2 foot existing sewer at 10th and Flournoy Streets aouthwazd
along the line of the 8 Ot foot existing sewer to 12th and Burnetti
Streets.
Burnett Street from 12th Street to the intersection of
Burnett, Trimble and 15th Streets,
SECTION 2.
The cost of constructing said sewers shall be apportioned ,
equally against the abutting lots or parcels of land, according to
number of feet abutting thereon, and shall be paid for by the owners
said lots or parcels of land abutting or bounding upon such streets,
eys and highways, provided the cost of same does not exceed $2.00 per

abutting foot. In the event the cost of said improvement dhall exceed
Ilthe sum of $2.00 per abutting foot, then all the lots or parcels of
ground in said zone are hereby declared to be the property benefitted,
and the entire cost of the construction of said sewers shall be assessed
against each of said lots or parcels of ground embraced in said zone in
the proportion that the area in square feet of such lots or parcels
!i of ground shall bear to the area in square feet of all the lots or
i parcels of ground located in said zone; and the General Council shall
fix and assess the amount of tax to be levied upon each of said lots
or parcels of ground in said zone as required by law, PROVIDED, the
lots and lands of the biaplelawn cemetery shall not be served by said
sewer and no part of the cost of construction of same shall be apportioned
to the said cemetery property.
SECTION 3.
I
The lots or parcels of ground which are hereby declared to
be benefitted by the constwuetion of said sewer, and subject to the
payment of the cost of same, are located in said Zone No. 5, which is
particularly described in the ordinance establishing said Sewer Zone
No. 5, adopted by the Board of Commissioners of said City on the 23rd
day of February 1923, and also particularly described in the resolution
declaring said sewer to be a necessity, adopted by the General Council
of said City on October 6th, 1924, and particularly desnribed as follows:
"Beginning at the intersection of the center
lines of i_= 14th Street and Trimble Street; thence southward
and with the center line of 14th Street 203 feet 3 inches to
the center line of an alley; thence eastward with the center
line of said alley to the center line of 13th Street; thence
northward with the center line of 13th Street 203 feet 3 inches to
the center line of Trimble Street; thence eastward with the
center line of Trimble Street to a point 203 feet 3 inches
eastward from the center line of 6th Street; said point being
the intersection of the center line of Trimble Street and the
center line of an alley which runs south from Trimble Street;
thence in a northerly direction parallel to and 203 feet 3
inches eastward from the center of 6th Street to a point in the
center line of Campbell Street 217 feet 6 inches northward from
the intersection of the center lines of Campbell and Sixth Streets
west of Campbell Street; thence northward with the center line
of Campbell Street 67 feet 6 inches to a point 285 feet northward
from the center line of 6th Street west of Campbell Street;
thence westward parallel to and 285 feet from the center line
of 6th Street west of Campbell Street and along the northerly
line of Lots 144 and 154 in the Flournoy, Norton, Trimble and
Harris Addition, a distance of 410 feet to the center line of
Harris Street; thence southward with the center line of Harris
Street 57 feet 6 inches to a point 227 feet 6 inches, measured along
the center line of Harris Street from the center line of 6th
Street'; thence westward parallel to and 227 feet 6 inches from
the center line of 6th Street 460 feet to a point on the center
line of Boyd Street; thence deflecting 3 degrees 58 minutes to the
left continuing westward parallel to and 226.95 feet from the
center line of 6th Street, measured at right angles to 6th
Street to a point 200 feet west of the west property line of Burnett
Street, said 200 feet being measured parallel to Sixth Street;
thence southward parallel to and 200 feet from the west property
line of Burnett Street, said distance being measured parallel to
Sixth Street, to a point on the center line of Ninth Street, if
extended; thence westward on the center line of Ninth Street,
if extended, to the Common intersection point of Blocks 40, 41,
51 and 50 of Flounoy, Norton, Trimble and Harris Addition, said
point being 400 feet more or less, from the west property line
of Burnett Street and measured parallel to Ninth Street, if extended;
thence southward, on the line between Blocks 41 and 51 of Flournoy,
Norton, Trimble, and Harris Addition, a distance of 330 feet,
more or less, to a point 150 feet north of the north property
line of Tenth Street, said point being on the south property
line of an alley, if extended, running east and west through
said Block 41; thence westward on a line parallel to and
150 feet from the north property line of Tenth Street, said
150 feet being measured parallel to Flournoy 'Street, a distance
of 259 feet, more or less, to a point 150 feet northward from
the north property line of Tenth Street and 141 feet eastward
from the east property line of Flournoy Street, said 150 feet
being measured parallel to Flournoy Street and said 141 feet
being measured parallel to Tenth Street; thence southward on
a line parallel to and 141 feet from the east property line of.
Flournoy Street, said 141 feet being measured parallel to Tenth
Street, a distance of 180 feet, more or less, to a point in the
center line of Tenth Street, said point being where a line
parallel to and 141 feet from the west property line of
Flournoy Street intersects the center line of Tenth Street;
said 141 feet being measured parallel to Tenth Street; thence
westward bn the center line of Tenth Street, a distance of
601 feet, more or less, to a point where the west line of
Block 62 of the Flournoy, Norton, Trimble and Harris Addition,
if extended, intersects the center line of Tenth Street, said
point being 200 feet measured from the center line of Cleveland
Avenue and measured parallel to Tenth Street; thence southward
on the line between Blocks 62 wand 72 of the Flournoy, Norton,
Trimble and Harris Addition, a distance of 190 feet, more or
less, to a point where the line between Lots 14 and 15 of
Block 62, Flournoy, Norton, Trimble and:Harris Addition inter-
sect the west property line of Block 62, Flournoy, Norton,
Trimble and Harris Addition, said point being 200 feet west ofl
the center line of Cleveland Avenue and 160 feet south of the
north property line of Block 62 Flournoy,'Plorton, Trimble and
Harris Addition, said 200 feet being measured parallel to
Tenth Street, and said 160 feet being measured parallel to
Cleveland Avenue; thence westward across Block 72 of the
Flournoy, Norton, Trimble, and Harris Addition to a point
of intersection where a line parallel to and 195 feet at
right angles from the center line of Tenth Street, located
west of Terrell Street, intersects the center line of North
Street, if extended, said point being 255 feet, more or less,
from the center line of that portion of Eleventh Street,
located between Greer and North Street, said 255 feet being
measured parallel to North Street; thence westward parallel
to and 195 feet at right angles from the center line of Tenth
Street to a point on the center line of Palm Street, said
point being 195 feet from the center line of Tenth Street,
measured at right angles to Tenth Street, thence in a southerly
direction along the line of the center of Palm Street to a
point 242 feet 6 inches southward from the center line of
13th Street; thence eastward, parallel to and 242 feet 6
inches from the center line of 13th Street to the center line
of Willett Street; thence southward along the center line of
Millett Street and said center line extended, to a point 195
feet southward from the center line of 14th Street; thence
eastward along a line 195 feet south of the center of 14th
Street, measured at right angles to 14th Street, said line
deflecting to conform to the angle in 14th Street at Faxon
Street, to the center line of Flournoy Street; thence
southward along the center line of Flournoy Street and said
center line, if extended, to a point 226 feet southward from
the center line of Rushing Street, said point being within the
limits of Oak Grove Cemetery; thence east along a line parall
to and 226 feet from the center line of Rushing Street to a
point 180 feet northward from the center line of Trimble Street]
measured at right angles to Trimble Street, said point being l
on the south property line of an alley which runs through Block
No. 46 of the Flournoy, Norton, Trimble and Harris Addition;
thence eastward along said south property line of said alley
to the line between Lbts No. 3 and 4 of said Block Ivo. 46;
thence southward with said line between Lots No. 3 and 4,
189.4 feet to a point in the center of Trimble Street, 39 feet,.
more or less, westward from the center line of 15th Street,
measured along the center of Trimble Street; thence with the
center line of Trimble Street to the intersection of the center,
lines of 14th Street and Trimble Street, to the point of
beginning."

SECTION 4.
Said server shall be constructed in strict accordance with the
plans, grades, specifications and profiles as prepared and furnished
by the City Engineer of said City of Paducah, and adopted by the
General Uouncil of said City.
SECTION 5.
Bids shall be received for the construction of said sewers
according to the plans, specifications and profile, and contract
therefor shall be awarded to the lowest and best bidder, except the
right is expressly reserved to reject any and all bids, within the
discretion of the General Council, and it may accept any bid which
appears to be for the best interest of the City of Paducah.
SECTION 6.
The Board of Public Vlorks of said City is hereby authorized
and directed to advertise for bids for the construction of said
sewers, and said Board shall report the bids received by it, with
its recommendation for the acceptance of any of same or the rejection
of all of same.
SECTION 7.
Said work shall be constructed Lander the dir«,ction and
supervision of the City Engineer and the Board of Public horks of
said City, or their authorized agents, and the same shall commence and
be completed at a time designated by contract.
SECTION S.
The contractor awarded the contract for the work herein
provided, shall be paid only from the funds arising from special
tax bills or assessmentSmade against the property located in said
Sewer Zone, except that said contractor may be paid out of such bonds
as may be issued according to law, and as provided in Sections 3101, ix
3102 and 3108 Kentucky Statutes.

This ordinance shall take effect and be in force from
and after its passage, approval and publications
