P � �, �AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF SANITARY SEVERS i• IN SEWER ZONE NO. 3, SUB -DIVISIONS A AND B, S3M DISTRICT NO. 3, IN THE CITY OF PADUCAH, KENTUCKY, AT THR, COST OF._TFM PROPERTY GfWNERS THEREIN, N AND PROVIDING THAT SAID SE':ER SHALL BE CONSTRUCTED UPON THE IO YEAR P PAYMENT PLAN, AND NAMING THE STREETS AND ALLEYS ALONG, UNDER AND THROUGH ',`WHICH SAID SE7IERS SHALL BE CONSTRUCTED, AND SETTING OUT IN GENERAL T^R1.5, TIE PROPERTY BENEFITTED THEREBY AND SUBJECT TO THE PAYIJ�N1' OF THE COST OF SAIr1v. ,'WHEREAS, The Board of Commissioners of Paducah, Lentucky, adopted an ordinance on February 23rd 1923, dividing part of Sub -Divisions n, II B and C, in Sewer District No. 3, into five sewer zones for the purpose I of constructing sewers therein, so as to provide adequate sewers for the property owners within said zones; and, �I "'4EEREAS, Since the adoption of the aforesaid ordinances the City 4 of Paducah has by a vote abandoned the Commission Form of Government, and has returned to the old form of-ldermanic Government, and by the express provisions of the law,cf the acts, ordinances and laws, enacted under either form of government remain in force under the succeeding form of it said government; and, i9HEREAS, The General Council of said city has adopted a resolution declaring the construction of such sewers in said sewer zone No. 3 to be a necessity; NOW, THEREFORE, BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, KENTUCKY. SECTION I. That sanitary sewers be constructed in, under and along the streets, alleys and highways, in sewer zone No. 3, in Sub -Divisions - and B, Sewer District No. 3 in the City of Paducah, Lentucky, as follows, to-wit(t, "A" street from '�7heeler avenue northwardly to a point / near an alley, said alley being about 160 feet from Guthrie avenue, a diptance of 300 feet. Goebel -venue from a point about 40 feet north of the t north property line of Guthrie -.venue in a northerly direction to a point near •iorten avenue, a distance of 623 feet. Tennessee street from a point in Goebel --venue near a street or alley known as Baumer tivenue; in a northeasterly direction, a distance of 350 feet. Tennessee street from ,orten avenue in a southwesterly direction, a distance of 3,48.2 feet. a Tennessee street fromorten avemient+ eA northeasterly direction C a distance of 232. feet, Smithland avenue from a point in a,,street or alley er ,avenue in a northeasterly direction, a distance orten avenue from Smithland avenue in a northwesterly di- rection to a point near Goebel avenue, a distance of 897.3 feet. Smithland avenue from Brakeman avenue to Morten avenue in a southwesterly direction, a distance of 140.68 feet. Brakeman avenue from a point near the intersection of 3rakeman avenue and Baumer avenue at the existing 24 inch sewer in a north- wardly direction to-mithland avenue, a distance of 601.82 feet. Baumer avenue from a point near the intersection of Baumer avenue and Brakeman avenue at the existing 24 inch sewer in a northwesterly direction to �Dmithland avenue, a distance of 570.7 feet. Guthrie avenue east of the Clayfield Ltoad, from Layfield road in an I easterly direction to a point near the intersection of Smithland avenue, if extended, a distance of 325 feet. 1.4heeler avenue from the Idayfield road in a westerly direction to a point near B.street, a distance of 725 feet. AL1 the above described lateral sewer lines are to be constructed with 6 inch house connection service Lines extending from the sewer proper to the property lines of all property abutting on the streets or alleys in which the above described lateral sewers are to be built in such manner as to properly serve the property benefitted. Six inch house connection service lines are to be constructed from the present sewer lines (built under the ??600,000 bond issue) to i the property lines of all abutting property on the following streets or alleys in such manner as to properly serve the property benefitted. Clayfield xoad from a point 300 feet north of Cedar avenue southward to a Point 300 feet south of cuarles -venue. Mayfield road and that portion of the Clayfield road known as Goebel avenue from a point 40 feetnorth of Guthrie avenue southward to a point 400 feet south of 1,11heeler avenue. heeler avenue, if extended, from the Clayfield road eastward to a point 188.4 feet eastward from the Idayfield road. SECTION 2. the cost of constructing said sewers shall be apportioned equal. ly against the abutting lots or parcels of land, according to the num- ber of feet abutting thereon, and shall be paid for by the owners of said lots or parcels of land abutting or'bounding upon such streets, al- leys and highways, provided the cost of same does not exceed ?j2.00 per abutting foot. In the event the cost of said improvement shall exceed the sum of =x2.00 per abutting foot, then all the lots or parcels of ground in said zOn9 are hereby declared to be the property benefitted, and the entire cost of the construction of said sewers shall be assessed against each of said lots or parcels of ground embraced in said zone it the proportion that the area in square feet of such lints or parcels of ground shall bear to the area in square feet of all of the lots or par- cels of ground located in said zoq*; and the General Council shall fix and assess the amount of tax to be levied upon each of said lots or parj eels of ground in said zone as required by law. I SECTION 3. the lots or parcels of ground which are hereby declared to be benefitted by the construction of said sewer, and subject to the payment,, N0. N of the cost of same, are located in said zone -,o.3, which is particularly described in the ordinance establishing said sewer zone 11o. .3 adopted by the Board of Commissioners of said City on the 23rd day of February 1923, and also particularly described in the resolution declaring said i sewer to be a necessity, adopted by the General Council of said city on October 6, 1924, and particularly described as follows: "Beginning at the intersection of the center line of Brakeman Avenue and Baumer avenue; thence with the center line of Baumer avenue, in a westward direction, to a point 150 feet east of the intersection of the center line of Baumer avenue and the south property line of that part of �-mithland avenue north of Baumer avenue; thence at right angles southward 197 feet; thence at right angles west- ward 189 feet; thence deflecting 107 degrees 13 minutes to the left, 140 feet; thence deflecting 84 degrees 53 minutes, to the fight, 183.2 feet; thence deflecting 97 degrees 27 minutes, to the left, 318 feet; thence deflecting 90 degrees, to the right 188.4 feet, to a point on the center of the Layfield goad, 175 feet southward from the center line of Yiheeler avenue,.measured alone said center line of the Layfield road; thence at right angles southward with the center of the Layfield road 225 feet; thence at right angles westward 190 feet; thence at right angles northward, parallel to the-ayfield Road, to a point on the south property line of an allay, if extended, said point being 210 feet, more or less, south of the south property line of wheeler Avenues thence westward with the south property line of said alley 680 feet, more or less to the center of y street; thence northward with the center of u street to a point on the center lire of an alley, said ;point being 338 feet north of the center line of +heeler Avenue; thence at right angles eastward with the center line of said alley 396 feet to the center of A street; thence at right angles northward with the center of A street 21 feet; thence at right angles eastward 193 feet to the center of an alley; thence at right angles northward with the center of said alley 96 feet to a point 59 feet south of the south property line of Guthrie avenue; thence at right angles eastward, parallel to Guthrie avenue 163 feet, to the west property line of the I:Iayfield hoad; thence northward with the west property lines of the Mayfield -"oad and Goebel Avenue 159 feet to a point 40 feet north of the north property line of Guthrie Avenue; thence at right angles west,:zard 163 feet to the center of an alley] thence at right angles northward with the center line of the alley and said center line extended, 720 feet, more or less, to the center line of '"orten =venue, if extended; thence at right angles eastward along the center line of +orten Avenue, if extended, 203 feet to the east property line of Goebel Avenue; thence at right angles northward with the east property line of Goebel Avenue, 126 feet to a point 106 feet north of the north property line of Torten Avenue; thence deflecting 90 degrees 18 minutes, to the fight in an easterly direction and following the rear boundaries of lots fronting on,6orten Avenue 186 fe.et; thence deflecting 12 degrees 46 minutes, to the right, continuing to follow the rear boundaries of lots fronting on +,orten Avenue, 132.5 feet; thence deflecting 28 degrees 10 minutes to the right, con- tinuing to follow the rear boundaries of lots fronting on ivorten Avenue 329.7 feet to the center of Tennessee street; thence deflecting 85 degrees 38 minutes, to the left, in an easterly direction along the center line of Tennessee street 126 feet, more or less, to a point 221 feet from the east property line of 'i+orten Avenue; thence at right angles in a southerly direction 155 feet; thence at right angles west- ward 95 feet to the center of an alley, a point 126 feet east of the east property line of JoTten Agenue; thence at right angles southward on a line with the center of said alley to the center of Brakeman Avenue; thence southward along the center of Brakeman avenue, to theoint of beginning." p ginning. AND FUR THERTAORE "Begimiing at a point on the east property line of the ]Mayfield road 300 feet north of the north property line of Cedar -venue, said 300 feet being measured along said east property line of the J3ayfield 11oad; thence south- ward along the east property line of the I,iayfield road 100 feet; thence at right angles westward to a point 168 feet westward from the west property line of the hayfield road; thence at right angles southward on a line parallel to the Jdayfield road, to a line which runs at right angles to the Idayfield Road and which intersects the east property line of said road 300 feet southward from a point where the east property line of said road is intersected by the south property line of auarles avenue; thence at right angles eastward to a point 168 feet eastward from the east property line of said road, said 168 feet being measured parallel to auarles ivenue; thence at right angles northward on a line parallel to the I.iayfield -oad, to a point 300 feet northward from the north property line of Cedar revenue, said 300 fegt,being measured parallel to the Layfield ILoad; thence' :'Ve*2.0i;rfl,,O,Parallel to Cedar Avenue, to a, point of beginning.'' SECTION 4. ',aid sealer shall be constructed in strict accordance with the Plans, grades, specifications and profiles as prepared and furnished by the City Engineez• of said city of raducah, and adopted by the Gen- eral Council of said City. SECTION 5. Bids shall be received for the construction of said sewers ac- cording to the plans, specifications and profile, and contract there- for shall be awarded to the lowest and best bidder, except the right is expressly reserved to reject any and all bids, within the discre- tion of the General "ouncil, and it may accept any bid which appears tl be for the best interest of the city of Paducah. SECTION 6. =he Board of rublic 1°orks of said city is hereby authorized and directed to advertise for bids for the construction of said sevrers, a. said Board shall report the bids received by it, with its recommendat for the acceptance of any of same or the rejection of all of same. SECTION 7. :.•aid work shall be constructed under the direction and supervisl ion of the City Engineer and the Board of rublic +orks of said city, of their authorized agents, and the same shall commence and be completed at a time designated by contract. SECTION 8. the contractor awarded the contract for the work herein provided shall be paid only from the funds arising from special tax bills or as- sessmentSmade against the Property located in said sewer zone, except that said contractor may be paid out of such bonds as may be issued ac_ cording to law, and as provided in sections 3101, 3102 and 3105- :en- tucky Ztatutes. :.
