PROVIDING FOR THE CONSTRUCTION OF SANITARY
SEWERS IN SEAVER 'LONE NO. 2, SUB -DIVISION B, SEWER DISTRICT NO. 3, IN
THE CITY OF PADUCAH, KENTUCKY, AT THE COST OF THE PROPERTY OWNERS
i!,THEREIN, AND PROVIDING THAT SAID SEWER SHALL BE CONSTRUCTED UPON THE
TEN YEAR PAYMENT PLAID, AND NAMING THE STREETS AND i�LLEYS ALONG, UNDER
(!AND THROUGH WHICH SAID SEVERS SHALL BE CONSTRUCTED, AND SETTIIIG OUT

IjIN GECIERAL TERMS, THE PROPERTY BENEFITTED THEREBY AND SUBJECT TO THE
!iPAYMENT OF THE COST OF SAME.
WHEREAS, The Board of Commissioners of Paducah, Kentucky,
:'adopted an ordinance on February 23rd, 1923, dividing part of Sub -
Divisions ti, B and C, in Sevier District No. 3, into five sewer zones
i'for the purpose of constructing sewers therein, so as to provide adequate
sewers for the property owners within said zones; and,
WHEREAS, Since the adoption of the aforesaid ordinanceo the
l�City of Paducah has by a vote abandoned the Commission Form of Government,
land has returned to the old form of Aldermanic Government, and by the

express provisions of the law the acts, ordinances and laws, enacted
i
(under either form of government remain in force under the succeeding
I
form of said government; and,
WHEREAS, The General Council of said City has adopted a
i
(resolution declaring the construction of such sewers in said sewer zone
I'No. 2 to be a necessity, NOW, THEREFORE -
BE IT DRDAINED BY THE GENERAL COUNCIL OF THE CITY OF
�jPADUCAH; KENTUCKY:
SECTION 1.

All the above described lateral sewer lines are to
be constructed with 6'inch house connection service lines extending from
the sewer proper to the property lines of all property abutting on the
streets or alleys in which the above described lateral sewers are to be
built, in such manner as to properly serve the property benefitted.
Six inch house connection service lines are to be con-
structed from the present sewer lines ( built under the $600,000 bond
issue) to the property lines of all abutting property on the following
streets or alleys in such manner as to properly serve the property benefitted.

a point 190 feet eastward from Caldwell Avenue to a point 190

Caldwell Avenue from Caldwell Street to a noint 830

otherwise known as Union Street northwardly, a distance of
298.42 feet from the center line of Brown Street, otherwise
known as Union Street.
Brown Street and that part of Brown Street known as

SECTION 2.
The cost of constructing said sewers shall be apportioned
equally against the abutting lots or parcels of land, according to the
number of feet abutting thereon, and shall be paid for by the owners of
said lots or parcels of land abutting or bounding upon such streets, alleys,
and highways, provided the cost of same does not exceed ;2.00 pLr abuttin
foot. In the event the cost of said improvement shall exceed the sum of
X2.00 per abutting foot, then all the lots or parcels of ground in said
Zone are hereby declared to be the property benefitted, and the entire
cost of the construction of said sewers shall be assessed against each of
said lots or parcels of ground embraced in said zone in the proportion
that the area in square feet of such lets or parcels of ground shall
bear to the area in square feet of all of the lots or parcels of ground

located in said zone; and the General Council shall fix and assess the
amount of tax to be levied upon each of said lots or parcels of ground in

SECTION 3.
The lots or pardels of ground which are hereby declared to
ie benefitted by the construction of said se%%,er, and subject to the payment
,f the cost of same, are located in said Zone No. 2 which is particularly

which runs at right angles to Caldwell Avenue, and which
intersects the west property line of Caldwell Avenue at
a point 298.42 feet- northward from the point where the
west property line of Caldwell Avenue intersects the
east right of way boundary line of the Nashville,
Chattanooga: and St. Louis Railway; thence at right
angles eastward to the east property line of Caldwell
Avenue; thence at right angles southward along the
east property line of Caldwell Avenue to the point
of beginning."
SECTION 4.
Said sewer shall be conttr'.icted in strict accordance with the
plans, grades, specifications and profiles as,prepared and furnished by
the "ity Engineer of said City of Paducah, and adopted by the General
Council oP Xad ,.-i'da � `
SECTION 5.
Bids shall be received for the construction of said sewers
according to the plans, specifications and profile, and contract therefo�
shall be awarded to the lowest and best bidder, except the right is
expressly reserved to reject any and all bids, within the discretion
of the General Council, and it may accept any bid which appears to be
for the best interest of the City of Paducah,
SECTION 6.
The Board of Public Works of said "ity is hereby authorized
and directed to advertise for bids for the construction of said sewers,
and said Board shall report the bids received by it, with its recommenda-
for the acceptance of any of same or the rejection of all of same.
SECTION 7.
Said work shall be constructed under the direction and
supervision of the City Engineer and the Board of Public %7orks of said
City, or their authorized agents, and the same shall commence and be
completed at a time designated by contract.

SECTION B.
The contractor awarded the contract for the work herein
provided, shall be paid only from the funds arising from special
tax bills or assessmenksmade against the property located in said
Sewer Zone, except that said contractor may be paid out of such
II bonds as may be issued according to law, and as provided in
3101, 3102 and 3105, Kentucky Statutes.
SECTION 9.
Sections
This ordinance shall take effect and be in force from
and after its passage, approval and publication.
