AN ORDINANCE ASSESSING THE ABUTTING PROPERTY 04TNERS ON THE SOUTH SIDE OF CALDWELL STREET AND THE EAST SIDE OF CALD;;"ELL iiVENUE IN THE CITY OF PADUCAH AS FOLLOWS: "BEGINNING AT A POINT ON THE SOUTH SIDE OF CALDt1ELL STREET 350 FEET WEST OF THE WEST PROPERTY LINE OF 12TH STREET, AND RUNNING THENCE ALONG THE SOUTH SIDE OF CALDdELL STREET APPROXIMATELY 136 FEET TO THE INTERSECTION OF CALD,TELL STREET AND CALD'9ELL AVENUE (13TH STREET); THENCE ALONG THE EAST SIDE OF CALa'IELL AVENUE ABOUT 1336 FEET TO THE INTERSECTION OF CALITTELL AVENUE WITH UNION OR BROWN STREET, EXCEPTING THEREFROM THE LOW GROUND ON CALDWELL AVENUE LYING BETWEEN STATIONS 12-07 and 15-63, A DISTANCE OF 356 FEET, THE COST OF CONSTRUCTION AS FOLLOWS: CONCRETE SIDDIIRLK, EXPANSION JOINTS AND INCIDENTALS $0.19664 PER SQ.FT. CONCRETE GUTTER 39� PER LIN. FT. CONCRETE DRIVEWAYS 30� PER LIN. FT. 4" CAST IRON PIPE 40� PER LIN. FT. CONCRETE CURB STRIIGHT 63¢ PER LIN. FT. CONCRETE CURB CIRCULAR 73� PER LIN. FT. ALL OF WHICH IS SHWI'di BY THE CITY ENGINEERIS ESTIMATE OF SAID COST, EXCEPT THAT PORTION TO BE PAID FOR BY THE CITY OF PADUCAH, KENTUCKY, AND PROVIDING THAT SAID ASSESSMENT MAY BE PAID IN TEN ANNUAL INSTALLMENTS, BEING ONE EACH YEAR FOR A PERIOD OF 10 YEARS." 101HEREAS, The General Council of the City of Paducah, Kentucky, on the 14th day of August, 1924, adopted an ordinance entitled "An ordinffnce providing for the construction of concrete sidewalks, gutters and curbs of concrete or granite, according to the bid accepted, together with all necessary manholes, intakes, catch basins and sewer pipe connections along the south side of Caldwell Street and the east side of Caldwell Avenue, in the City of Paducah, Kentucky, particularly described as follows: "Beginning at a point on the south side of Caldwell Street 350 feet west of the west property line of 12th Street and running thence along the south side of Caldwell Street approximately 1.36 feet to the intersection of Caldwell Street and Caldwell Avenue (13th Street); thence along the east side of Caldwell Avenue about 1336 feet to the inter- section of Caldwell Avenue with Union or Brovin Street, except- ing therefrom the low ground on Caldwell Avenue lying between the stations 12-07 and 15-63, being a distance of 356 feet, at the cost of the abutting property owners, and providing that same may be paid for upon the ten year payment plan; and, WHEREAS, in accordgnee with said ordinance/ it was provided that the cost of construction of said sidewalks, curbs and gutters be paid for by the abutting property owners, except that portion to be paid by the City of Paducah, as required by law; and, IYHEREAS, pursuant to said ordinance a contract was entered into on the 5th day of September, 1924, between George W. Katterjohn, Jr., of Paducah, Kentucky, and said City for the construction thereof; and, 'UHEREAS, said contract has been completed and duly accepted I by the General Council of the City of Paducah, on the 20th day of October! 1924, pursuant to the recommendation made therefor by the Board of Public 'forks of said City; NOW, THEREFORE, BE IT ORDAINED BY THE GENERAL COUNCIL OF T-,,?? CITY OF PADUCAH, KENTUCKY: PAGE 169. SECTION 1. That all the property on the south side of Caldwell Street and the east side of Caldwell Avenue, beginning at a point on the south side of Caldwell Street 350 feet west of the west property line of 12th Street and running thence along the south side of Caldwell Street i approximately 136 feet to the intersection of Caldwell Street and Caldwell Avenue (13th Street); thence along the east side of Caldwell Avenue about 1336 feet to the intersection of Caldwell Avenue with Union II or Brown Street, excepting therefrom the low ground on Caldwell Avenue, lying between stations 12-07 and 15-63, being a distance of 356 feet, in the City of Paducah, Kentucky, as shown by the City Engineer's estimate of the cost of same, be and the same is hereby assessed for the cost of con struction of concrete sidewalks, curbs and gutters as follows: Concrete sidewalk, expansion joints and incidentals $0.19664 per Sq. Ft. it Concrete Gutter, 39� per lin. ft. Concrete Driveways, 301 per lin. ft. 4" Cast Iron_ Pipe, 40� per lin. ft. Concrete Curb Straight, 63� per lin. ft. Concrete Curb Circular, 73� per lin. ft. all of which is shovm by said Uity Engineer's estimate on file in the office of said Engineer, now referred to and made part hereof. SECTION 2. That the funds derived from the assessment of said property shall be used for the purpose of paying off the special tax bills issued against said property, or such bonds as may be issued by the City of Paducah, pursuant to Section 3101, Kentucky statutes, SECTION 3. That pursuant to Section 3101, Kentucky Statutes, said tax assessment, may at the option of the property owners, be payable in cash without interest within thirty days from date of passage and Publication of this ordinance, or in ten annual installments, provided that the property owners shall before the expiration of said thirty days enter into an agreement in writing with said city in accordance with the provisions of Section 3101 of the Kentucky Statutes. SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessment herein provided for, which may be paid on the installment plan as hereinbefore provided, the City may issue and sell improvement bonds, and to secure the payment of such bonds there is hereby pledged such taxes and liens on the property assessed herein for the payment of the principal and interest, but such bonds shall not be sold for less than par and the proceeds derived there- from shall.be applied exclusively to the payment of the cost of said construction as hereinbefore provided; and such bonds, if issued, shall bear interest and be payable in accordance with the provisions of 3101, Kentucky Statutes as amended by Act of 1910.
