WHERE_:S, There has been created and established in the City
of Paducah, Kentucky, Sewer District No. 3, v✓hich has been divided
into Sub -Divisions A, B and C; and,
17HEREAS, there is being constructed, in said Sever District,
trunk line sewers at the cost of the City of Paducah, Kentucky, which
trunk line sewers have now been completed; and,
Y,HEREAS, there has been created and established, Sdv✓er Zone
.,'umber Three, in Sub -Divisions A and B, Seaver District No. 3 by an
Ordinance adopted by the Board of Commissioners on the 23rd day of
February, 1923, •wherein said Zone is described by metes and bounds, .
and is hereinafter described, and a plat of which zone appears on file
in the office of the City Engineer of the City of Paducah, Kentucky,
and may be inspected by anyone making application therefor at said
office; and,
'.;HERS,:S, Sewer Zone Number Three in Sub -Divisions. A and B,
Sever District 11o. 3, is not prouided v.,ith sewers and is in a thickly
populated territory, and in order to provide adequate sewers for the
property owners in said Zone, it is hereby deemed and declared a
necessity by the General Council of the City of Paducah, Kentucky, that
sanitary sewers be constructed in said Zone in order to provide adequate
se✓✓erage for the property owners residing in said 'Lone; 1101,1.', TH1F.EFORE,
BE IT RESOLVED BY TH- GE-N-EIIAL COUNCIL OF THE' CITY OF PADUC.LH,
SECTION 1.
That it is hereby declared a necessity by the General
Council of the City of Paducah, Kentucky, in order to secure adequate
sewerage, and in order to protect the health of the citizens residing
in Sewer Zone Iiumber Three, Sub -Divisions A and B, Sewer District
Number Three, that sanitary sewers be constructed and laid out at the
cost of the lots or parcels of land benefitted thereby, and all of the
lots or parcels of land embraced in said Zone are hereby declared to
be the property benefitted, and subject to be assessed for the cost

of constructing said servers.

"Beginning at the intersection of the center line of
Brakeman Avenue and Baumer Avenue; thence with the center
line of Baut}ter Avenue, in a westward direction, to a point
150 feet east of the intersection of the center line of
Baumer Avenue and the south property line of that part of
Smithland Avenue North of Baumer Avenue; thence at right
angles southward 197 feet; thence at right angles west-
ward 189 feet; thence deflecting 107 degrees 13 minutes to
the,left, 140 feet; thence deflecting 84 degrees 53 minutes,
to the right; 183.2 feet; thence deflecting 97 degrees 27
minutes, to the left, 318 feet; thence deflecting 90 degrees,
to the right 188.4 feet, to a point on the center of the
hayfield Road, 175 feet southward from the center line of
Theoler Avenue, measured along said center line of the
Mayfield Road; thence at right angles southward with the.
center of the (aayfield Road 225 feet; thence at right
angles westward 190 feet; thence at rinht angles northward,
parallel to the Mayfield Road, to a point on the south property
line of an alley, if extended, said point being 210 feet, more
or less, south of the south property line of '::•heeler Avenue
thence westward with the south property line of said alley
680 feet, more or less, to the center of B Street; thence
northward with the center of B Street to a point on the
center line of an alley, said point being 338 feet north of
the center line of '..heeler Avenue; thence at richt angles
eastward with the center line of said alley 396 feet to the
center of A Street; thence at right angles northward with
the center of A Street 21 feet; thence at right angles
eastward 193 feet to the center of an alley; thence at right
angles northward with the center of said alley 96 Peet to a
point 59 feet south of the south property line of Guthrie
Avenue; theme at right angles eastward, parallel to Guthrie
Avenue 163 feet, to the gest property line of the Mayfield
Road; thence northward with the west property lines of the
Mayfield Road and Goebel Avenue 159 feet to a point 40 feet
north of the north property line of Guthrie Avenue; thence
at right angles westward 163 feet to the center'of an alley;
thence at right angles northward with the center line of
the alley and said center line extended, 720 feet, more or
less, to the center line of Torten Avenue, if extended;
thence at right angles eastward along the center line of
Torten Avenue, if extended, 203 feet to the east property
line of Goebel Avenue; thence at right angles northward
with the east property line of Goebel Avenue; 126 feet to
a point 106 feet north of the"north property line of "torten
Avenue; thence deflecting 90 degrees 18 minutes, to the right
in an easterly direction and following the rear boundaries
of lots fronting on �orten _'.venue 186 feet; thence deflecting
12 degrees 46 minutes, to the right, continuing to follow
the rear boundaries of lots fronting on `aorten Avenue, 132.5
feet; thence deflecting 28 degrees 10 minutes, to the right,
continuing to follow the rear boundaries of lots fronting on
Worten Avenue 329.7 feet, to the center of Tennessee Street;
thence deflecting 85 degrees 38 minutes, to the left, in an
easterly direction along the center line of Tennessee Street
126 feet, more or less, to a point 221 feet from the east
property line of "obten Avenue; thence at right angles in a
southerly direction 155 feet; thence at right angles westward
95 feet to the center of an alley, a point 126 feet east of
the east property line of Porten Avenued thence at right
angles southward on line with the center of said alley to
the center of Brakeman avenue; thence southward along
the center of Brakeman avenue, to the point of beginning."

"Beginning at a point on the east property line of the
Mayfield Road 300 feet north of the north property line
of Cedar Avenue, said 300 feet being measured along said
east property line of the Kayfield (toad; thence southward
along the east property line of the :.aayfield Road 100 feet;
thence at right angles westward to a point 168 feet westward
from the west property line of the ; ayfield Road; thence at
right angles southward on a line parallel to the hayfield
Road, to a line which runs at right angles to the Mayfield
Road and which intersects the east property line of said
road 300 feet southward from a point where the east property
line of said road is intersected by the south property
line of Quarles Avenue; thence at right angles eastward
to a point 168 feet eastward from the east property line
of said road, said 168 feet being measured parallel to quarlos
Avenue; thence at right angles northward on a line parallel
to the Mayfield road, to a point 300 feet northward from the

being measured parallel to the hayfield Road; thence
westward, parallel to Cedar Avenue, to the point of

SECTION 3.
Said sewers shall be constructed along and under the following
named streets and alleys in Sewer Zone Ido. 3, in Sub -Divisions A and B
Sewer District No. 3, and the cost of same shall be apportioned against
all the property in said sewer zone as follows:
(1) All the lots or parcels of land bounding or abutting
on the hereinafter named streets, alleys or highways along or under
which such sewers shall be constructed are hereby declared to be the
property benefitted thereby, and said cost shall be apportioned and
assessed equally against said abutting lots or lands according to the
abutting feet thereon, provided that the costs of said construction
does not exceed ¢J2.00 per abutting foot.
(2) In the event the cost of construction of said sewer shall
exceed :2.00 per abutting foot, along any of said streets, alleys or
highways whereon said sewer shall be constructed, then such cost shall
be apportioned against all of the lots or lands in said sewer zone
benefitted by said sewer, according to the area in square feet of the

lots or lands so benefitted.
And which streets, alleys and highways along =which said
sewer shall be constructed are described as follows, to -wit:
"A" Street from ";heeler Avenue northwardly to a point
near an alley, said alloy being about 160 feet from Guthrie ,
Avenue, a distance of 300 feet.
Goebel Aveniie from a point about 40 feet north of the
north property line of Guthrie Avenue in a northerly direction
to a point near Porten .:venue, a distance of 623 feet.
Tennessee street from a point in Goebel Avenue near a
street or alley known as Baumer Avenue; in a northeasterly
direction, a distance of 350 feet.
Tennessee Street from Cforten Avenue in a southwesterly
direction, a distance of 348.2 feet.

a distance of 232," feet.
Smithland Avenue from a point in a strcat or alley,
known as Baumer Avenue in a northeasterly direction a distance.

direction to a point near Goebel Avenue, a distance of 897.3
feet.
Smithland Avenue from Brakeman Avenue to 'torten Avenue
in a southwesterly direction a distance of 140.88 feet.
Brakeman Avenue from a point near the intersection of
Brakeman :venue and Baumer avenue at the existing; 24 inch
sewer in a northwardly direction to Smithland Avenue a distance
of 601.32 feet.
Baumer Avenue from a point near the intersection of
Baumer Avenue and Brakeman avenue at the existing 24 inch sewer
in a northwesterly direction to Smithland Avenue a distance of
570.7 feet.

Guthrie Avenue east of the I.Iayfield Road from
Iayfield Road in an easterly direction to a point near the
intersection of Smithland Avenue, if extended, a distance
of 325 feet.

All the above described lateral sewer lines are to be
connected with 6 inch house connection service lines extending from the
�. sewer proper to the property lines of all property abutting on the streets
or alleys in which the above described lateral sewers are to be built in
such manner as to properly serve the property benefitted.
Six inch house connection service lines are to be
constructed fro:a the present sewer lines ( built under the ?600,000
bond issue)to the property lines of all abutting property on the following
streets or alleys in such manner as to properly serve the property
benefitted,
hayfield :.oad from a point 300 feet north of
Cedar Avenue southward to a point 300 feet south of
Quarles Avenue.
Eayfield road and that portion of the is:uyfield
road known as Goebel :_venue from a point 40 feet north
of Guthrie Avenue southward to a point 400 feet south
of ':,heeler Avenue.

',heeler Avenue, if extended, from the Idayfield
road aastvjard to a point 188.4 feet eastward from
the i,:ayficld Road.
SSCTIOiI 4.
Notice is hereby given to the owners of all property
in said 'Gone, and all property bounding or abutting on afty of said streets„
alleys or highways, that the cost of construction of said sewer ';rill be
assessed against such property in the manner hereinabove provided.
SECTION 5.
A blue print or plat showing the boundary of Sevier 'Gone
Ido. 3, naming and showing the streets embraced in said `Gone, and shoving
the line and course of the sewer to be constructed hereunder, is filed
I herewith and made a part hereof, marked Exhibit "A".
SECTION 6.
For additional information of the public and owners of
property in said Zone, a blue print or plat showing the boundary of said
sewor zone and sholving the streets embraced therein, and the line and
course of the sewer to be constructed hereunder, Viill be found on file in
the office of the City Engineer of the City of Paducah, and may be inspected
at any time upon application at said office. -

SECTION 7.
The resolution Yieretofore adopted by the General
Council on `.�pr-il^i1st, 1924, or any previous resolution, in conflict
herewith, is hereby repealed, and this resolution shall Lake effect
and be in force after its passage, approval and publication.
