That it is hereby declared a necessity by the General Council I of the City of Paducah, Kentucky, in order to secure adequate sewerage, and in order to protect the health of the citizens residing in Sewer Zone Number One, Sub -Division C, :Sever District Number Three, that sanitary sewers be constructed and laid out at the cost of the lots or ! parcels of land benefitted thereby, and all of the lots or parcels of land embraced in said Zone are hereby declared to be the property benefitted, and subject to be assessed for the cost of constructing said severs. SECTIOPT 2. Said Sewer Zone Number One of Sub -Division C, of Seaver District Number Three, in which said sewers are to be constructed, is described by metes and bounds as follows, to -wit: I r A RESOLUTION DECLARING THE CONSTRUCTION OF SANITARY SEWERS IN SEINER ZONE NUMBER ONE, IN SUB -DIVISION C, SEWER DISTRICT IMABER THREE, TO BE a NECESSITY, AND SETTING OUT IN GENERAL TERMS, THE PROPERTY SUBJECT ;1fi` , TO THE PAYI.'.ENT OF THE COST OF SAME. WHEREAS, There has been created and established, in the City of i Paducah, Kentucky, Sewer District Ido. 3, which has been divided into Sub -Divisions A, B and C; and, WHEREAS, there is being constructed in said Sewer District trunk line sewers at the cost of the City of Paducah, Kentucky, which trunk line sewers have now been completed; and, WHEREAS, there has been created and established Sewer Zone Number One, in Sub -Division C, Sewer District No. 3, by an Ordinance adopted by the Board of Commissioners on the 23rd day of February 1923, s wherein said Zone is described by metes and bounds, and is hereinafter described, and a plat of which zone appears on file in the office of the City Engineer of the City of Paducah, Kentucky, and may be inspected by anyone making application therefor at said office; and, WHEREAS, Sewer Zone Number One, in Sub -Division C, Sever District No. 3,is not provided with sewers and is in a thickly populated territory, and in order to provide adequate sewers for the property owners in said 3 Zone, it is hereby deemed and declared a necessity by the General Council of the City of Paducah, Kentucky, that sanitary sewers be constructed in said Zone in order to provide adequate sewerage for the property owners ` residing in said Zone; NOVJ, THEREFORE, v BE IT RESOLVED BY 1HE GENERAL COUNCIL OF THE CITY OF PADUCAH, r KENTUCKY: SECTION 1. Said Sewer Zone Number One of Sub -Division C, of Seaver District Number Three, in which said sewers are to be constructed, is described by metes and bounds as follows, to -wit: I r No. l h3 "Beginning at a point on the center line of Bridge Street 166 feet North of the intersection of said center line with the North property line of Jarrett Street; thence along the bank of Island Creek eastward 169 feet, more or less, to a point ofithe center line of an alley, said point being 150 feet north of the north property line of Jarrett Street, measured along the center line of said alley; thence eastward along the bank of Island Creek to a point on the west property line of Jarrett Street 130 feet northward .from the center line of Powell Street, if extended; thence northward along said west property line of Jarrett Street to the north property line of the alley which runs from Clements Street to Jarrett Street on a line with Yeiser Street; thence westward along said north property line of the alley 31 feet; thence northward to the point where the south property line of Short Street intersects the center line of Farley Placed thence northward along the center line of Farley Place 78.5 feet; thence at right angles westward 161 feet; thence at right angles northward 42 feet; thence at right angles westward 33 feet; thence at right angles northward, parallel to Farley Place, 584.5 feet, more or less, to a point 155.5 feet south of the south property line of I.eyers Street, said 155.5 feet being measured at right angles to Meyers Street; thence westward, parallel to Meyers Street, 270 feet to a point 435 feet from the vest property line of Farley Place; thence at right angles northward 415.5 feet crossing 13eyers Street at an angle of 90 degrees; thence at right angles eastward, parallel to and 200 feet north of the north property line of Meyers Street to the east property line of Farley Place, if extended; .thence at right angles southward a distance of. 4 feet; thence at right angles eastward, parallel to Eeyers Street to the east property line of Clements Street, if extended; thence at right angles southward a distance of 13.5 feet; thence at right angles eastward, parallel to and 200 feet north of the i. north property line of Meyers Street to a point 380 feet eastwardly from the east property line of Woodward Street, if extended; thence at right angles southward 233 feet to the south property line of Lieyers Street; thence at right angles east:✓ard with the south property line of Ideyers Street 60 feet; thence at right angles southward 200 feet; thence at right angles westward, parallel to Pneyers Street, 307 feet to a point 133 feet from the east property line of '.7oodward Street; thence at right angles southward, parallel to Woodward Street 597 feet to a point 160 feet northward from the north property line of Yeiser Street; thence at right angles eastward, parallel to Yeiser Street 589 feet to the center line, if extended, of an alley between Hays and Ashcraft Avenues; thence at right angles southward along the ce:iter line of s aid alley to the north property line of Powell Street; thence at right angles eastward along said North property line of Powell Street to a point 175.5 - feet eastward from the center line of Ashcraft Avenue, said 175.5 feet being measured along the north property line of Powell Street; thence at right angles southward on a line parallel to and 175.5 feet from the center line of �I Ashcraft Avenue to a point 160 feet eastward from the center P line of Bridge Street, said 160 feet being measured at right angles to Bridge Street; thence southward along a line 160 feet from the center line of Bridge Street, said line conforming to the tuV4§ in Bridge Street, and remaining at all points 160 feet from said center line of Bridge Street, to the line of the coraorate limits of the City of Paducah; thence southward along the line of the City of Paducah, to . the center line of Bridge Street; thence northward, along the center line of Bridge Street, 200 feet; thence west;vard at right angles to Bridge Street 160 feet; thence northward along a line 160 feet from the center .line of Bridge Street, i' said line conforming to the turns of Bridge Street and remaining at all points 160 feet from said center line of Bridge Street, to a point 166 feet northward from the north property line of Jarrett Street, if extended, said 166 feet measured parallel to Bridle Street; thence at right angles east:,rard 160 feet to the point of beginning." AND FURTHERli 0 RE "Beginning at a point on the east property line of 1,1ill Street, if extended, 200 feet northward from the north property line of Meyers Street, said point being on the line of the City Limits of the City of Paducah; thence southward along the said Cit;* Limits line and said east property line of ?sill Street, to a point 200 feet southward from the south property line o£;eyers Street; thence westv✓ard, parallel to and P-00 feet from the south property line of Meyers Street to a point 770 feet aastward from the east property line of :!oodward Street, said 770 feet being measured parallel to T.ieyers Street; thence north- ward, parallel to V!oodward Street, to a point 200 feet northward from the north property line of i.:cyers Street; thence eastward, parallel to and 200 feet from the north property line of.Me Meyers Street to the y point of beginning." SECTION 3. Said severs shall be constructed along and under the following named streets and alleys in Server Zone No. 1, in Sub - Division C, Sevier District No. 3, and the cost of same shall be appor- tioned a7ainst all the Property in said sewer zone as follovrs: (1) All the lots or parcels of land bounding or .abutting on the hereinafter named streets, alleys or highways along or under vrhic such sewers shall be conttructed are hereby declared 'to be the property benefitted thereby, and said cost shall be apportioned and assessed equally against said abutting lots or lards according to the abutting feet thereon, provided that the costs of said construction does not exceed $2.00 per abutting foot. (2) In the event the cost of construction of said sewer shall exceed $2.00 per abutting foot, along any of said streets, alleys or highways whereon said sewer shall be constructed, then such cost shall be apportioned against all of the lots or lands in said Sever Zone benefitted by said sewer, according to the area in square feet of the lots or lands so benefitted. And which streets, alleys and highways along which said sewer shall be constructed are described as follov✓,, to -wit: I ! Ashcraft Avenue, from the Benton Road or Bridge Street, Northwardly to a Point near Po":vell Street, a distance of 1125 feet. Hays Avenue, from the Benton road or Bridge street, no.rthvrardly, to a point- near Sowell Street, a distance of 590 feet. Hays Avenue, from Yeiser Street southwardly to a point ��near Sowell Street, a distance of 925 feet. Ash��,t Avenue, from the Benton road, or Bridge i street northwardly to Sowell Street, a distance of 494.36 feet. Farley Place from Meyers Street, southwardly taaard Short Street, a distance of 770 feet. Jarrett Street from Povrell Street, northwardly to a point near Yeiser Street, if extended, a distance of 494.25 feet. Jarrett Strent from Po,, -.-ell Street southwardly a distance pf 342,05 feet. No. 135. Ordinance No..;___ _ Bridge Street from Vassuer Avenue to City Limits at I -dills Stre.et, a distance of 2296.5 feet. Bridge Street from Clements Street northward a distance of 525 feet. Powell Street from Ashbrook Avenue, westwardly a distance of 292.5 feet. Powell Street from Clements Street westwardly to Jarrett Street, a distance of 321 feet. Yeiser Street from Clements Street eestwardly to a point between Hays Avenue and Ashcraft Avenue, a distance of 1050 feet. Short Street from Clements Street westwardly to a point near Farley Place, a distance of 350 feet. Zeyers Street a point about 770 feet eastwardly from Woodward Street to the City Limits at mills Street, a distance of a--lo-lztt 2000 feet. feet. Sowell Street from Ashbrook Avenue westerly 105.65 Ashbrook Avenue from Yeiser Street southwardly to a point near Sowell Street, a distance of 975 feet. I Woodward Sbreet from Yeiser Street northwardly, a distance of 230 feet. Woodward Street from T,eyers Street southwardly, a distance of 675 feet. Six inch house connection service lines are to be constructed from the present sewer lines (built under the $600.000 bond issue) to thero e_tt P p r lines of all abutting property in the it or alleys following streets in 'such manner as to properly serve the property benefitted. Meyers street from a point 435 feet northwardly . from Farley Place to a point 440 feet southwardly from Ploodward street. Clements street from ;:e,*ers street to Bridge street, or the Benton Road. Bridge street, or the Benton Road, from Clements * street to Vasseur avenue. SECTION 4. Notice is hereby given to the owners of all property in said Zone, and all property bounding or abutting on any of said streets, alleys or highways, that the cost of constructing said sevier will be assessed against such property in the manner hereinabove provided. i SECTION 5. A blue print or plat showing the boundary of Sewer `Lone No. 1, naming and showing the Streets embraced in said Zone, and showing the line and course of the sewer to be constructed hereunder, is filed herewith and made a part hereof, marked Exhibit "A". SECTICPI 6. For additional information of the public and owners of property in said Zone, a blue print or plat showing the boundary of said Sewer Zone No. 136. Ordinance No. and showing the streets embraced therein, and the line and course of the sewer to be constructed hereunder, will be found on file in the office of the City Engineer of the City of. Paducah, and may be inspected at anpr time upon application at said office. I( SECTION 7. The resolution heretofore adopted by the General Council on April 21st, 1924, or any previous resolution, in conflict herewith, is hereby repealed, and this resolution shall take effect and be in force after its passage, approval and publication. _ ­id'M B—j of, -
