HomeMy WebLinkAboutOrdinances Book 8, Page 122, No Ordinance NumberNo. 122. Ordinances - AN ORDINANCE REGULATING THE BUSINESS OF SOLICITORS OF'VENDORS IN THE CITY OF PADUCAH, KENTUCKY. BE IT ORDAINED BY THE GENERAL COUNCIL OF TIS CITY OF FIMUCAH, KENTUCKY. SECTION 1. DEFINITION. A solicitor or vendor within the meaning of this ordinance is defined to be any person who goes from house to house, or from place to place in the City of Paducah selling or taking orders for, or offering to sell or take orders for goods, wares or merchandise for future delivery, or for services to be performed in the future, or for the making„ manufacture or repair of any article whatsoever for future delivery; provided, however, that this article shall apply only to solicitors or vendors who demand, acdept or receive payment or deposit of money in advance of final delivery. SECTION 2. It shall be unlawful for any person to act as solicitor or vendor within the meaning of this ordinance without first securing a license from the City of"PaduGah so to do. SECTION 3. APPLICATION - BOND. Any person desiring a license to engage as a solicitor within the City* of Paducah shall make application therefor at the office of the City Treasurer, furnishing the name and address of the applicant, the name and address of the person, firm or corporation which he represents, and the kind of merchandise offered for sale, or the kind of services to be performed. Such application shall be accompanied by a bond in the penal sum of $500.00 executed by a surety company, or by two responsible property owners residing in said City, qualified to make said bond good ( or in lieu thereof a cash bond of equal amount.) conditioned upon the making of final delivery of the goods or merchandise ordered, or services to be performed, in accordance with the terms of such order or failing therein, that the advanced payment on such order shall be refunded. Any person aggrieved by the action of any such solicitor shall have a right of action on said bond for the recovery of the money or damage, or both. Such bond shall remain in full force and effect, and in case of cash deposit such deposit shall be retained by said City for a period of 90 days after the expiration of any such license, unless sooner released by order of the General Council. SECTION 4. ORDERS- All orders taken by license solicitors shall be in writing in duplicate, stating the terms thereof and the amount paid in advance, and one copy shall be given to the purchaser. No. 123. Ordinances - SECTION 5. The license herein required shall be $6.00 per week. SECTION 6. All ordinances and parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed, and this ordinance shall take effect and be in force from its passage, approval and publication.
