'ilHEREAS, the Board of Commissioners of the City of Paducah,
i
:..�ntucky, has heretofore, to -reit; on the 15th day of I,Iay, 1925, adopted
an ordinance entitled "An ordinance providing for the construction of
the driveway, together with all necessary manholes, catch basins, int:1_es
and seder pipe connections, on North Twelfth Street from the North property
line of Jefferson Street to the south property line of Madison Street;
on South Twelfth Street from the south property line of Tennessee Street.to
the I'Iorth property line of Jones Street; on North Eleventh Street from j
the North property line of Jefferson Street to the South property line
of .-Madison Street; on North Ninth Street from the north property line
of Jefferson Street to the south property line of Madison Street; on

the City of Paducah, Kentucky, at t. e cost of the abutting property ormera,
and providing that same shall be const-,:-ucted upon the ten year payment
plan'.'; and,
WHEREAS, in accordance with said ordinance it was provided that;
the cost of construction of said driveway be paid for by the abutting
property owners on both sides thereof, except that portion to be paid by
the City of Paducah, P:entucky. as required by law; and,
WHEREAS, pursuant to said ordinance a contract was entered
into on June the 15th, 1925, between Yancey & Johnson, of Paducah, Kenti.zck,
and said Cit;- for the constriction thereof; and,
WHEREAS, the said contract has been completed and duly accepted
by the General Council on the 18th day of August, 1924, pursuant to the
recommendation made therefor by the Board of Public 'Norks of said City:

SECTION 1.
All property on both sides of North 12th Street from the
north property line of Jefferson Street to the south property line of
Madison Street; on both sides of South 12th Street from the south property
line of Tennessee Street to the north property line of Jones Street; on
both sides of North 11th Street from the north property line of Jefferson
Street to the south property line of Madison Street; both sides of North
9th Street from the north property line of Jefferson Street to the South
property line of ,Iadison Street'; on both sides of North Sth Street from
the north property line of Jefferson Street to the South property line of
Ladison Street; on both sides of North 7th Street from the north property
line of .Jefferson Street to the south property line of Idadison Street;
(ori both sides of South 7th Street from the South property line of Kentucky
A)aenue to the north property line of Washington Street; on both sides
of North 6th Street from the north property line of Jefferson Street to
the south property line of },Madison Street; on both sides of South 6th
Street from the south property line of Kentucky Avenue to the north property
line of 'Nashington Street; and on both sides of North 5th Street from the
north property line of I1onroe Street to the South property line of Madison
Street, in the City of Paducah, I.entucky, as shown by the City Engineerts
Estimate of the cost of same, be and the same is hereby assessed for the
cost of constr-uction of the driveway on said streets, with concrete, the
sum of yr4.71B681 per abutting foot, as particularly shown by said estimate
of such cost on file in the office of the City Engineer now referred to
and made a. nart hereof.

SECTION 2.
That the .funds derived from the assessment of said property
shall be used for the purpose of paying off the special tar, bills issued!
against said property, or such bonds as may be isaiod by the City of

Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes.

SECTION 3.
That pursuant to Section 3101 of Kentuoky Statutes, said tax
assessment may, at the option of the property owner, be payable in cash
without interest within thirty days from the date of passage and publica-
tion of this ordinance or in ten annual installments, provided the
property owners shall before the expiration of said thirty days, enter
into an agreement of writing with said City, in accordance with the
provisions of Section 3101 of the Kentucky Statutes.
SECTION 4.
In order to provide a fund for the immediate payment of the
cost of that portion of the special assessment herein provided for, which
may be paid for on the installment plan, as hereinbefore provided, the

City of Paducah may issue and sell Improvement Bonds, and to secure the
I
payment of'such bonds there is hereby pledged such taxes and liens on'the
I
property assessed herein for the payment of the principal and interest,
but such bonds shall not be sold for less than par, and the proceeds
derived therefrom shall be applied exclusively to the payment of the cost
of said construction as hereinbefore provided, and such bonds, if issued,
I
shall bear interest and shall be payable in accordance with provision of,
Section 3101 of the Kentucky Statutes, as amended by Act of 1910.
SECTION 5.
This ordinance shall tale effect and be in force from the
date of passage, record and publication.
