NSTRUCTED, AND .SETTIftG OUT IN GENE?iAL Tsui: -:S THE PROPERTY BENEFITTED "F.EREBY AND SUvJECT TO THE PAYfaP'T OF THE COST OF S-iE"• and the amendment therof duly adopted on the 8th day of December, 1926, wherein, it is providbd', among other things, 1 that storm water sewers be constructed in said Zones "A" and "B" therein described by metes and bounds, and hereinafter described, and whercSn the atr•eets and alleys on and along which said seners shall be I� constructed are named and designated, in said storm water zone "A" as follows: On Harrison Street from the low water mark on the Ohio River to the center line of 9th Stxieet, crossing 2nd, 3rd, 4th, 5th, 6th, 7th and 8th Streets and to. the center line of 9th Street, and taking - care of the drainarre at each of said intersections. I On 3rd Stbeet from the sewer in the center line of 'T-rrison Street to the center line of Clay Street; and on Clay Street from the center line of 3rd Street to the center line of 9th Street, crossing 4th, 5th, 6th, 7th and 8th Streets, and to the center line of 9th Street, and taking care of storm water at each of said inter- sections. On 3rd Street from the sewer in the center line of Harrison Strr,�t to the center lire of Liadison Street, and on Ladison Street frcm the center line of 3rd Street to the center line of 9th .Street, crossinmh 4th,5th, 6th, 7th and 8th Streets, and to the center line of 9th Seets, and taking care of the drainage of storm hater at each of said inte' sections": andr- , 7HLHEAS, said storm water sewer 'Z,one ".A" provided for in said ordinance, is narticularly described as follows: "Beginning at a point on the south property line of Trimble Street, said point being 173.25 feet west of the ,rest pronerty line of 9th Street; thence, in an easterly direction, and along the south property line of Trimble Street 2672.25 feet to the east curb line of trd'Street; thence, in a southerly direction, and along the east cprb line of 3rd Street, 752 feet to the north property line of Harrison Street; thence, in an easterly direction along the n m th property line of Harrison Street, if extended , to the low water mark on the Ohio River, a distPnce of approximately 850 feet; thence, with the low water mark on the" Ohio River in'a Motherly direction to the south property line ATO. 1060 lof Harrison Street, if extended, a distance of approximately 66 feet; thence, in a westcrly dir-ction, and along the south property line of Harrison Street to the cast curb line of 3rd Street, a distance of approx- imat,ely 960 feet; thence, in a southerly direction, and along the east curb line of 3rd Street 505.75 feet to a point 173.25 feet south of the south property line of 1;1adison Street, said point being the center of the block lying between Madison and Monroe Streets; thence, in a westerly direction along a line, said line being the center of the block lying between Madison and Fon'roe Streets, 2672.25 feet to a point 173.25 feet west of the west property line of 9th Strcet; said point being the center of the block lying between Eadison and 13onroe Streets; thence, in a north- erly direction alone a line, said line being 173.25 feet west of the west property line of 9th Street, and parallel thereto, 1410.75 feet to the - south property line of Trimble Street, the point of beginning"; and, WHEREAS, in accordance with said ordinance, it Inas providedthat the cost of the construction of said sewer shall be apnortioned equally to the abutting property or parcels of land according to the number of ahutting feet thereon, provided ti:e cost of same should not exceed ?p2.00 ner abutting foot. That in the event the cost of said improvement should exceed $2.00 per abutting; fbot along said streets whereon said sewers shale be constructed, then such cost shall be apnortioned against all of the lot or parcels of lAnd in said Sevier zone so benefitted, in the nronortion that the area in square feet of such lots or parcels of land shall bear to the area in square feet of all of the lots or parcels of g-ound locate in said zone; and, further, that the General Council shall fix and assess the amount of tax to be levied unon each of said lots or parcels of land as required by lave; and, pursuant to said ordinance, a contract was entered into on the 19th day of January, 1927, (and re -executed on lilarch 16, 1927). between McKelvey Construction Company of St. Louis, Missouri, and the City of Paducah, nentucky, for the construction of said sewers: and, "'HERE�.S the cost of construction of said se'sers as against the pronerty abutting thereon was in excess of -;2.00 per abutting foot, and therefore must be assessed against all of the property in said sewer zone uron the area basis as hereinabove mentioned; and, 17HEREAS, said sewer construction has been completed and duly adcented by the General Council on the 23rd day of September, 1927, pursuant to the recommendation of the Board of Public ''Jorlts of said city, NODI; 1,HEREFOHE BL IT ORDAI`IED BY THE GENERGL COUNCIL OF PiADTTCAH, KENTUCKY: SECTION 1. That all the lots o:^ parcels of ground located in said storm water sewe- Zone "A", hereinabove described, be, Find the same are hereby assessed for the cost of construction of said sewer as follows: Property abutting on sewer, covering lateral connections ... „0.0233070079 per square foot; Property on cross streets, and not abutting on said secrer..?x;0.0172932376 per square foot; 110. 1061 as particularly shown by the estimate of said cost prepared and certified by the official engineer in charge of and directing same, which has been duly filed and confirmed by the General Council of said City, and which report and estimate show all of the lots or parcels of ground assessed for such cost, and the amount of same, and is now referred to and made part hereof, and will appear on file in the offices of the City Clerk and City Engineer, respectively. SECTION 2. That the funds derived from the assessment of said property shall be useld for the purpose of paying off the special tax bills issued against said property, or such bonds as may he issued by the City of Paducah, lentucky, pursuant to Section 3101 of'the Kentucky Statutes,. cECTION 3. That nursuant to Section 3101 of the Kentucky Statutes, said tax i assessment may, at the option of the property owners, be paid in eash without interest within thirty days from the date of the pass-,ge and Publication of this Ordinance, or in ten annual installments, pro- vided the property owner shall before the expiration of said thirty days enter into a written agreement with sai& City in accordand- with the provisions of Section 3101 of the Kentucky Statutes. SECTION 4. In bader to trovide a fund for the immediate payment of the cost of that portion of the special assessments herein nrovided for, rep- , resenting the amount which the property owners have elected,to nay on the installment plan, as hereinabove provided, the city of Paducah, may issue and sell improver,:ent bonds, and to secure the payment of said bonds, there is hereby pledged such taxes a -d liens or, the property assessed herein for the payment of principal and interest, but such bonds shall not be sold for -'less than par, and the proeded's derived therefrom shall be applied exclusively to the payment of the cost of such construction as hereinabove provided; and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes. SEC`.CION S. This Ordinance shall take effect and be in force from and after its nassa�-e, appr Val and publication.
