HomeMy WebLinkAboutOrdinances Book 8, Page 1044, No Ordinance NumberNO. 1044 r.N ORDINUCE' ASSESSING THE ABUTTING PROPERTY ON BOTH SID-:" OF JEFFERSON STREET, FROM THE '.IEST PROPERTY LINE OP 17TH STEEET TO THE EAST PROPERTY LINE OF 19TH STREET, IN TIIE CITY OF PADIICAH, KENTUCKY, FOR THE COST OF CONSTRi1CTION OF A IIARD 3i1RFACF, ROAD:''i.Y, CONSISTING OF A COiTCRETE FOIE:D TION WITS A SHEET iiSPHALT TOY, AS SHOVII OIT PLANS, TOGETHER '7ITH ALL iIECESSi,R`r TIANHOLES, INTAKES, CATCH BASINS AND SE'."ER PIPE CONAIECTIONS, EXCEPT THAT PORTION TO BE PAID FOR BY THE CITY OF PADTICAH, A3 D PROVIDING THAT SAID COST LAY BE PAID IN TEN ANNUAL IN- STALLI.'EITTS BY COEPLI.Ai:CE '"!ITH TI+E KENTUCKY STATITTES APPLICABLE THERETO. 17HEREAS, the General Council of the City of Paducah, Kentucky, has heretofore, to-wit,on the 25th day of July, 1927, adopted an hull ordinance, entitled, "AN ORDINANCE PROVIDING FOR THE IMPROVEVENT OF i JEFFERSON 53T7EET, FROM THE I°JEST PROPERTY LINE OF 17th STREET (FOUNTAIN AVEN[IE) TO THE EAST PROPERTY LINE OF 19TH STREET, IN THE CITY OF PADUCAH, KE"ITUCKY, BY THE CONSTRUCTION OF A HARD SURF -:.CE ROAD!.*AY, TOGETHER ';lITH ALL NECESSARY I.IANIIOLES,1 I11TAKES, Ci:TCH BASINS AND SE"'ER PIPE CONNECTIONS, IN ACCORDANCE WITH TIE PLATIS AND SPECIFICATIONS PROVIDED THEREFOR BY THE CITY ENGINEER, AT TIIECOST OF THE ABTITTITTG PROUI:RTV 01"...ERS, AT?D PROVIDING T11AT SUCH COST T,'.AY 1317. PMD UNDER THE PROVISIONS OF TIIE TEN YE,:R PAYT'ENT PLAN:" and, INHEREAS, it was provided in such ordinance that the cost of constructionof said roadway, together with all necessary manholes, intakes, catch basins and sewer nine connections, be paid for by the I abuttine property on both sides of said streets, except that portion i to be paid by the City of Paducah as required by law; and, 17HE`IEAS, pursuant to said ordinance a contract wa.s entered into on the 6th day of August , 1927, between the aouthern Roads Comnany, of Birmingham, Alabama, and the City of Paducah, for the constri.iction of same; and, 'YNEREAS, said contract has been completed and duly accented by the 'Gen-ral Council on the 19th day of Sentember, 1927, pursuant to the recommendations of the Board of Public l7orks of said City, Now, THEIEFORE: BE IT ORDAIM1,D BY THE G -EN F1' AL COMNUIL OF THE CITY OF PAD,'CAH, I-ENTUCKY: SEC'CIOPI 1 . That all property on"both sides of .Jefferson street, from the west nronerty line .of 17th street to the eas�j-:nroperty line of 19th Street, in the City of Paducah, Kentucky, be., and the somo-is, hereby assessed .for the cost of construction of a hard surface roadway, con- sisting of a concrete foundation With a sheet ,snhalt ton, as shown on plans, together with all necessary manholes, intakes, catch basins 9nd sevier nipe connections u -s follows: 110. 1045 On both sides of Jefferson Street, from the west nroperty line of 17th Street to the east nroperty line of 19th Street, naving, per abutting £oot--------------------------------------- ------;x.7291390, as particularly shown by the. pity Engineer' s estimate of said cost filed and annroved by the General Council of said City, a.rd which will annear on file in the offices of the City Clerk and City Engineer, respectively, and which are now referred+to and made hart hereof. SECTION 2. That the funds derived from the assessment of said nroperty i shall be used for the nurnose of paying off the special tax bills issued against said propefty, or such bonds as may be issued by the City of Paducah, Kentlzcky, pursuant to Section 3101 of the Kentucky Statutes. S CTION 3. �I That pursuant to Section 3101 of the Kentuckv Statutes said tax assessment may, at the option of the property owners, be ngyarle in cash without interest within thirty days fromthe date of nassage and nuhlication of thisOrdinance, or in ten annual installments, pro -I vided the nroperty owners within thirty days enter into a written I ii agreement with said City in accordance with the provisions of said Section 3101 of the Kentucky .Statutes. SRCTION 4. f In order to provide the funds for the immediate nayment�of it the cost of that portion of.the speical assessments herein provided for, which may be•paid on the ten year installment plan, as herein- above provided, the Cittr of Paducah may issue and sell improvement i bonds, and to secure the nayment of such bonds, there is hereby pledged such taxes and .liens on the nroperty assessed herein for I the payment of principal and interest, but such bonds shall not he sold for less than na.r, and the proceeds derived t'''erefrom shell be applied exclusively to the nayment of the cost of such construct- ion as hereinabove provided; and such bonds, if issued shall bear interest and shall be nayahld in accordance with the provisions of I Section 3101 of the l,entucky Stat�ites.
