HomeMy WebLinkAboutOrdinances Book 8, Page 1026, No Resolution NumberNO. 1026 A RESOLUTION CRE -TING SEPIER 'LONE 7-B, IN SUB -DIVISION "A", OF SANITARY SEWER DISTRICT NO. 3, IN TILE CITY OF PADUCAH, KENTUCKY: TO PROVIDE FOR THE DRAINAGE OF STORM WATER AND SANITARY SEWERS IN COMBINED FORM THEREIN; declaring THE CONSTRUCTION OF STOMI WATER AND SANITARY SE1,71ERS IN SAID Z01iE 7-B TO BE A NECESSITY, AND SETTING' OUT IN GENERAL TEFMIS TILE PROPERTY SUBJECT TO THE COST OF SUCH CON- STRUCTION. WHEREAS, there has been created and established in the City of Paducah, Kentucky, Sevier District No. 3, which has been divided into sub -division. A,,B,. C; and, WBEREAS, a trunk lateral sewer has been constructed in sub- division "A" of said Sewer District to the point of Twenty-first and Jackson Streets, which is designed for the purpose of serving additional territory; and, WHEREAS, it is now deemed necessary to extend said sewer lateral so as to serve said sewer 'Lone 7-B hereinafter described, and it is therefore hereby declared by the General Council of the City of Paducah to be a necessity that storm and sanitary sewers in combined form be constructed in said Sevier Zone 7-B, to serve the property and property owners located therein; NOP.', THEREFORE, BE IT RESOLVED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. There is hereby created Sewer Zone 7-B for the drainage of storm and sanitary sewerage (which is supplementary to Sewer Zone 4), in sub- division on "a" of Sewer District No. 3, in the City of Paducah, Kentuck3 which is particularly described as follows: "Beginning at a point in the center line of Twenty-first Street, 207.75 feet south of the center line of Jackson Street; said point being in the west boundary line of Sevier `Lone 4; thence, at right angles, and in a westerly direction with the center line of the block between Jackson and Ohio Streets to the west property line of Twenty-fifth Street, approximately 1650 feet; thence, at right angles, and in a northerly direction with the west property line of Twenty-fifth Street; 421 feet to the center of,the block between Jackson and Adams Streets; thence, at right angles, and in an easterly direction with the center line of said block 1417 feet; thence, at right angles and towards Jackson Street 23.25 feet; thence, at right angles and in an easterly direction, parallel with Jackson Street, 233 feet to the center line of Twenty-first Street, in the west boundagy line of said Zone 4; thence, at right angles and with the center line of Twenty-first Street and the west boundary line of `Lone 4, 397.75 feet to the beginning." SECTION "2" It is hereby declared by the Geheral Council of the City of Pqducah to be a necessity, in order to provide for the health, comfort and general welfare of said City and the citizens residing in said Sewer Zone 7-B, that a combined storm and sanitary sewer be constructed NO. 1027 and laid out at the cost of the owners of property andlots or parcels of ground located therein, and benefitted thereby, and all lots or parcels of ground located in said Zone 7-B', are hereby declared to be the property benefitted and subject to assessment for the costs of such construction. SECTION 3. Said sewer shall be constructed along and under the following named streets and alleys in said Sevier Zone 7-B, in the City of Paducah, Kentucky, to-wit,- On o-wit;On Jackson Street, from the manholes located at the center of �fthe intersection of Twenty-first and Jackson Streets; and running thence in a westerly direction with the center line of Jackson Street, crossing Twenty-third Street, Twenty-fourth Street and Twenty- fifth Street, to the west property line of Twenty-fifth Street, approximately 1650 feet. SECTION 4. The cost of construction of said sewer shall be apportioned i itagainst all the property in said Sevier Zone 7-B as follows: First: All the lots or parcels of ground bounding or abutting' on the above named streets along or under which said sewers shall be constructed are hereby declared to be the property benefitted thereby, and said cost shall be apportioned and assessed equally against said abutting lots or parcels of ground according to the number of abutting 9, feet thereon, provided the cost of said construction shall not exceed'. i $2.00 per abutting foot. Second: In the event the cost of said construction shall exceed Two Dollars ($2.00) per abutting foot along said street or streets whereon said sewer shall be constructed in said sewer zone, then such costs shall be apportioned against all of the lots or parcels of ground in said sewer zone in the proportion that the area in square feet of the lots or parcels of ground so benefitted, shall bear to the area of all the lots or parcels of ground in said sewer zone. SECTION 5. Notice is hereby given to all the owners of property in said Sewer Zone 7-B, and all property bounding or abutting on said street or streets, that the cost of construction of said sewers shall:'be assessed against said property in the manner hereinabove provided. SECTI014 7. The combined storm water and sanitary sewer line along said street, as herein provided, shall have six-inch house connection service lines, extending from said sewer lateral to the property line of all property abutting or bounding on said street or streets, and said sewer shall be constructed in such manner as to properly serve the property benefitted.
