CONSTRUCTION OF STORI.1 AND SANITARY SECII?RS IN COMBINED FORlJ IN SAID
SEWER ZONE NO.6, IN THE CITY OF PADUCAH, KENTUCKY, AND PROVIDING
THAT THE PAYMENT OF SUCH COST IdAY BE MADE IN TEN ANNUAL INSTALLMENTS,
BEING ONE EACH YEAR POT? A PERIOD OF TEN YEARS, TJPON EXECUTION BY THE
PROPERTY O';lNERS OF AGREEMENT REnUIRED BY LA17.
WHEREAS, the General Council of the City of Paducah has heretofore,
after adoption of resolution as required by law, on the 18 day of Novembe
1926, duly adopted an ordinance, entitled, "AIT ORDINANCE CREP.TING SE';'.'FR
ZONE NO. 6, SUB -DIVISION "A"" IN SEWER DISTRICT NO. 3, IN THE CITY OF
PADUCAH; 'ElTTUCKY, and PROVIDING FOR THE CONSTRUCTION OF STORY AND SANITARY
SE'Z'ERS IN COMBINED FORM IN SAID SE9ER ZOITE, AT TEE COST OF THE PROERTY
OWNERS THE=EIN, AND PROVIDING THAT SAID SEWER SHALL BE CONSTRUCTED UNDER
THE PROVISIONS OF THE TEN YEAR PAYMENT PLAN, AND NAMING THE STREETS AND
ALLEYS ALONG :_ND UNDER :1HICH SAID SE".'ER 'SHALL Bh CONSTRUCTED, AND SETTIIN

among other things, that storm and sanitary sewers in combined fora be
constructed in said sever zone 'therein described in metes and bounds, and
hereinafter described, and wherein the streets and alleys on and along
which said sewer shall be constructed are named and designated as follows:
"On Mildred Street commencing at the manhole in 24th Street on
the south line of Mildred Street and running thence eastwardly on Mildred
Street to the center line of Bloomfield Avenue extended in I'.Iildred Street[
On Mildred Street commencing at the manhole in 24th Street on
the south line of Mildred Street and running thence westwardly in Mildred
Street, to the center line of Atkins 'Avenue.
On Bloomfield Avenue commencing at the proposed sewer in Mildred

Street and running thence northwardly to the ,south iino:ofr13th'Street.
:On .Langstaff Avenue commencing at the proposed sewer in Mildred
Street and running thence northwardly on Langstaff Avenue and through
private property to the center line of Cairo Road.
On Atkins Avenue commencing at the proposed sewer in Mildred Stet
and running thence northwardly to a point 50 feet south of the south line
of the Cairo Road.
On 13th Street commencing at the proposed sewer in Langstaff'
Avenue and running thence westwardly 350 feet on 13th Street.
On Cairo Road commencing at the proposed sewer in Langstaff
Avenue and extending through private property into the Cairo Road and
running thence eastwardly on Cairo Road 625 feet.
On Cairo Road commencing at the proposed sewer in Langstaff
Avenue and extending through private property into the Cairo Road and
running thence westwardly on Cairo Road 430 feet.

On Hinkleville Road commencing -at the manhole at the
east line of 24th Street and running thence westwardly to
the center line of 26th Street.
On 25th Street commencing at the proposed sewer 1n
�I Hinkleville Road and running thence northwardly to a n_oiht
465 feet north of the center line of Kruger Street.
On 26th Street commencing at the proposed sewer in Hinkleville
Road and running thence northwardly to a point 500 feet north
of the center line of Kruger Street; "and",
'711EREAS, SAID SE'::IER ZONE NO.6, provided for in said ordinance
is particularly described as follows, to -wit:
°Beginning at a point 200 feet south of the center line
of Hinkleville Read and 154 feet vest of the center line of
24th Street; thence westwardly on a line 200 feet soutth of
and parallel to the center line of the Hinkleville Road to
a point 48 feet west of the west rine of 26th Street, extended,
thence northwardly on a line 4B feet west of and parallel to
the west line of 26th Street to the center line of the east
and west alley in Block #7 of Thurman's Park Addition; thence,
westwardly on said center line of the east and west alley to
the center line of the north and south alley just west of
Block #7 of Thurman's Noble Park Addition; thence northwardly
on said center line of the North and south alley 167.5 feet
west of the west line with the center line of the alley be-
tween 26th Street and Thompson Avenue, lying between Block #8
of Thurman's Noble Park Addition andBloek N o. 2 of `3adsworth
Improvement Company's Addition; thence, northwardly on the
center line of said alley and the center line extended to the
point of the intersection with the center line of the alley
first west of Atkins Avenue, a line 173 feet vest of and
parallel to the weat line of Atkins'Avenue; thence, northwardly
on the center line of the alley first west of Atkins Avenue to
its intersection with the center line extended of 13th Street;
thence, eastwardly on the center line of 13th Street to a point
50 feet west of Atkins Avenue; thence, northwardly on a line 50
feet west of and parallel to the west line of Atkins Avenue to -
the center line of Cairo Road; thence, eastwardly on the center
line of Cairo Road to its intersection with the West City Limits;
thence, northwardly on the West City Limits to a point at the
intersection of the '.'lest City Limits line with a line 150 feet
north of and nerallel to the north line of Cairo Road; thence,
eastwardly an the line 150 feet north of and parallel to the
north line of Cairo Road to the center line of Palm Street;
thence, southwardly on the center line of Palm Street and
this line extended to a point 242.5 feet south of the center
line of 13th Street; thence, eastwardly on a line 242.5 feet
south of and parallel to the center line of 13th Str et to a
point 173 feet east of the east line of Bloomfield avenue;-
thence, southwardly along a line 173 feet east of a d parallel
to the east line of Bloomfield Avenue to the center ,line of
Mildred Street; thence, west'aardly on the center line of
Mildred Street to the point w` ere it intersects the west
boundary line of Thurman's Glenwood Addition; thence, south-
wardly on the said west boundary of Thuitian's Glenwood Addition
to the point of beginning."
llfiE EAS, accordance with said ordinance, it was provided
that the cost of construction of said sevier shall be apportioned
equally to the abutting property or parcels of land according to
the number of feet abutting thereon, provided that the cost of
same should not exceed $2.00 per abutting foot. That in the event
the cost of said improvement should exceed '$2.00 per abutting foot,
then all of the lots or parcels of ground in said Zone are declared
to be the property benefitted, and the entire cost of said sewer
shall be assessed against each of said lots or parcels of ground
embraced in said zone in the proportion that the area in square
feet of such lots or parcels of ground shall bear to the area in
square feet of all of the lots or parcels of ground located in said
zone; and, further, that the General Council shall fix and assess

the amount of tax to be levied upon each of said lots or parcels of
ground in said zone as required by law; and,
WHEREAS, pursuant to said ordinance a contract was entered
Into on the 19th day of January, 1927, between the McKelvey Construct-
ion Company, of St. Louis, Yissouri, and the City of Paducah,
Kentucky, for the construction of said sewers; and,
FJHEREAS, the cost of construction of said sewers was in
excess of $2.00 per abutting foot, and therefore must be assessed
against all of the property in said sewer zone upon area basis as
hereinabove mentioned; and,
13HEREAS, said sewer construction has been completed and duly
accepted by the General Council on September 6th, 19?7, pursuant to

the recommendation of the Board of Public FJorks of said City:
BE IT ORDAINED BY THE GENERAL COUNCIL OF TFIE CITY OF
PADUCAii, KENTUCKY:
SECTION 1.
That all of the lots or parcels of ground located in said
sewer Gone No. 6, as hereinabove described, be, and the same are
hereby assessed for the cost of construction of said sewer at the
rate of $0.01786651 per square. foot as particularly shown by t116'
estimate of such cost prepeLmed and certified by the official en-
gineer in charge of and directing same, which has been duly filed
and approved by the General Council of said City, and which report
and estimate shows all of the lots or parcels of ground assessed
for such cost and the amount of same, and the same is now referred
to and made part.beggof,:.•.and will appear on file in the offices of
the City Clerk and City Engineer, respectively.
SECTION 2.
That the funds derived from the assessment of said property
shall be used for the purpose of paying off the special 'tax bills
issued against said property or such bonds as may be issued by the
City of Paducah, Kentucky, pursuant to Section 3101 of the nentucky
.Statutes.
SECTION 3.
That pursuant to Section 3101 of the Kentucky Statutes, said tax
assessment may, at the option of the property owner, be paid in cash
without interest within thirty days after date of the passage and
publication of this ordinance, or in ten annual installments, pro-
vided the property owner shall before the expiration of said thirty
days enter into a written agreement with said City in accordance with
the provisions of Section 3101 of the Kentucky Statutes.

SECTION 4.
In order to provide a fund for the immediate payment of the
cost of that portion of the special assessments herein provided for
.representing the amount which the property owners have elected to
pay on the installment plan, as hereinabove provided, the City of
Paducah may issue and sell improvement bonds, and to secure the
Payment of said bonds, thereis hereby pledged such taxes and liens
on the property assessed herein for the payment of principal and
interest, but such bonds shall not be sold for less than nar, and the
proceeds of such construction shall be applied exclusively to the
payment of the cost of such construction as hereinabove provided;

and such bonds, if issued, shall bear interest and shall be payable

iin accordance with the provisions of Section 3101 of the Kentuc3cy
Statutes.
SECTION 5.
This ordinance shall take effect and be in force from and
after its passage, approval and publication.
