AN ORDINANCE ASSESSING THE ABUTTING PROPEaTY ON BOTH SIDES OF 10TH
STREET FROM THE NORTH PROPERTY LINE OF JEFFERSON STREET TO THE SOUTH
PROPERTY LINE OF IiIADISON STREET, IN THE CITY OF PADUCAH, I'iEidTUCKY,. THE

ViHEREAS, The Board of Commissioners of the City of Paducah,
Kentucky, has heretofore, to -nit: on the 15Th day of May, 1923, adopted
an Ordinance entitled "An ordinance providing for the construction of the
driveway, together with all necessary manholes, intakes, catch basins
and sevier pipe connections on 10th Street from the north property line
of Jefferson Street to the South property line of Madison Street in the
City of Paducah, Kentucky, at the cost of the abutting property owners,
and providing that the same shall be constructed upon the ten year
payment plan; and,
+HER AS, in accordance with said Ordinance it vias provided that
the cost of construction of said driveway be paid for by the abutting
property owners on both sides thereof, except that portion to be paid
by the City of Paducah, Kentucky, as required by law; and,
iiHEREAS, pursuant to said Ordinance a contract vias entered
into on the 14th day of June, 1923, between Yancey & Johnson, of Paducah,
Kentucky, and said City for the construction thereof; and,
'�iHEHEiiS, the said contract has been completed and duly accepted
by the General Council in the City of Paducah, on the 21st day of July,
1924, pursuant to the recommendations made therefor by the Bo and of
Public i`,orks of said City;
1100' THEREFORE, be it ordained by the General Council of the
City of Paducah, Iieritucky.
SECTION 1.

That all of the property on both sides of '10th Street from the
north property line of Jefflerson Street to the South property line of
Madison Street in the City of Paducah, Kentucky, as shown bji the *City
Engineer's Estimate of the cost of same, be ana the same is hereby
assessed for the cost of construction of the driveway on said street
with concrete the'sum"o"f $2.53846 per abutting foot, as particularly
shown by said estimate of such cost on file in the office of the City
Engineer now referred to and made part hereof.
SECTION 2.
That the funds derived from tyle assessment of said property
shall be used for the purpose of paying off the special tax bills issued

against said property, or such bonds as may be issued by the City of
Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes.
SECTION 3.
That pursuant to Section 3101, Kentucky Statutes said tax
assessment may, at the option of the property owners, be payable in cash
without interest within 30 days from the date of the passage and puolica-
tion of this Ordinance, or in ten annual installments provided the proper -YY
owners shall oefore the expiration of said 30 days enter into an agree-
ment in writing %%ith said City, in accordance with the provisions of
Section 3101 of the Kentucky Statutes.
SEC TION 4.
In order to provide a fund for the immediate payment of
the cost of that portion of the special assessment herein provided for
Which may be paid for on the installment plan, as hereinbefore provided,
the City- of Paducah may issue and sell Improvement Bcnds, and to secure
the payment of such bonds there is hereby pledged such taxes and liens
on the property assessed herein for the payment of the principal and
interest, but such bonds shall not be sold for less than par, and the
proceeds derived therefrom shall be applied exclusively to the payment
of the cost of said construction as hereinbefore provided, and such bonds,
if issued, shall bear interest and shall be payable in accordance with
the provisions of section 3101 Kentucky Statutes as amended by kct of
1910.
SECTIO14 5.
This ordinance shall tale effect and be in force from its
Passage, record and publication.
