AS REQUIRED BY THE STATUTE OF KENTUCKY. C1HEi'EAS, the General Council of the City of Paducah, r' Kentucky, has heretofore adopted an Ordinance entitled: "AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF SANITARY SEVERS IN SE':'ER ZONE 110. 2, SUB -DIVISION "B" SE':'IER DISTRICT NO. 3, IN THE CITY OF PADUCAH, KENTUCKY AT THE COST OF THE PROPERTY O'MERS THEREIN, AND PROVIDING THAT SAID b .SE:':ERS SHALL BE CONSTRUCTED UPON THE TEN YE21R PAYMENT PLAN, AND NAMING THE STREETS. AND ALLEYS ALONG, UNDER AND THROUGH WHICH SAID SE ',ERS SHALL BE CONSTRUCTED AND SETTING OUT IN GENERAL TERNS THE PROPERTY BENEFITTED THEREBY AND SJBJECT TO THE PAYI`:ENT OF THE COST I i OF SAME" which was duly adopted on the 4th day of Lay, 1925, and I published, as required by the Statute, on the 12th day of ]',-ay, 1925, i wherein it is specified, among other things, that sanitary sewers be constructed on and along the streets and alleys hereinafter named;, and, WHEREAS, in+aeeordance with said Ordinanee.it was provided that the cost of construction of said sewers be paid by the owners of lots or parcels of ground abutting or binding upon said streets and alleys, provided the cost of same does not exceed Two Dollars per abutting foot, and all the lots or parcels of ground in said Zone are declared to be benefitted, and the entire cost of the construction of said �wers shall be assessed against each of said lots or parcels of ground located and embraced in said Zone in the proportion that the area in square feet of said lots or parcels of ground located in said Zone bear to the entire property located in said Zone, and benefitted thereby, and further providing that the General Council shall fix and assess the amount of tax on each of said lots or parcels of ground in said Zone; and, WHL+'REJiS,, pursuant to said Ordinance a contract was entered into on the 4th day of August, 1925, between the Koller Plumbing Company of Ponca City, Oklahoma and the City of Paducah, Kentucky, for the construction of said sewers; and, CJHEREAS, the cost of the construction of said sewers is less than ($2.00) Dollars per abutting foot; and, INHEREAS, said sewer construction has been completed and was duly accepted by the General Council on the 28th day of March, 1927, pursuant to the recommendation of the Board of Public ':'.'m ks of said City; NOVI THEREFORE: NO. 1018 BE IT ORDAINED BY THE GENERi+L COUNCIL OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. Caldwell Street or Caldwell Street, if extended, from a point 190 feet eastward from Caldwell Avenue to a point 190 feet westward from Caldwell Avenue. Caldwell Avenue from Caldwell Street to a point 830 feet southward from Caldwell Street and from Brown Street otherwise known as Union Str.e northwardly, a distance of 298.42 feet from the center line of Brown Street, otherwise known as Union Street. Brown Street and that part of Brown Street known as Union Street, from Caldwell Avenue to Green Street; Little Avenue, and that part of Little Avenue occupied by the railroad tracks from the center line of Brown Street, otherwise known as Union Street westward to a point in the Western right-of-way line of the Nashville, Chattanooga and St. Louis Railway, which point is 132.5 feet - westwardly from the center line of Brown Street, otherwise known as Union Street. Also the following additional lines necessary for the extension and connection of said sewers in said sewer Zone #2, to -wit: On Caldwell Street: Beginning at the manhole in 10th Street and running thence westwardly in Caldwell Street, -a distance of 300 feet; On private property vilest of 3rd Strect; Commensing at a manhole on the Relocation Island Creek Sewer at a point 179.5 feet east of 3rd Street: thence North 712 feet and a uth 298 feet; On private property east of 3rd Street; Commincing at the manhole at the intersection of 4th Street and Broad alley; thence, Northwardly 396 feet; In alley between 9th and loth Streets South from Bachman Street;; Commencing at the manhole in Bachman Street at the alley between 9th and 10th Streets; thence south 190.5 feet, thence L7est 62.8 feet; In Norton Street; Commencing at the manhole in 5th Street; thence West on Norton Street 300 feet; be and the same is hereby assessed with the cost of construction of said sewers at the rate of $1.2443679 per lineal foot as particularly shown by the estimat of such cost prepared by the 6fficial Engineers in charge of same, and duly filed and approved by the General Council of said City, and which estimate shows all the lots o'. parcels of ground assessed for such cost, and the amount of same, and is now referred t1o;and: made -a part hereof in as complete a manner as though copied in full herein., and which will appear from tl,.e files in the office of the City Clerk and City Engineer. No. 1021 II .SECTION 2. That the funds derived from the assessment of said prorrerty shall be used for the purpose of paying off tYje special tax bills issued against said property for such bonds as may be issued by the City of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes. II SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes said tax assessment may, at the option of the property owner, be paid in cash without interest, withing thirty days after the date of the passage and publication of this ordinance, or in ten annual installments provided the owner shall, before the expiration of said thirty days enter into a written agreement with said City in accordance with the provisions of Section 3101, Kentucky Statutes. ShCTION 4. i l In order to provide a Fund for the immediate payment of the cost of that portion of the special assessments herein provided for representing the amount which the property owners have elected to pay on the installment plan, as hereinabove provided, the City of Paducah may issue and sell improvement Bonds, and to secure the pay- ment of said bonds there is hereby pledged such taxes and liens on the property assessed herein, for the payment of principal and interest, but such bonds shall not be sold for less than par and the proceeds derived therefrom shall be applied exclusively to the payment of the cost of such construction, as hereinabove provided, and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101, Kentucky Statutes. SECTION 5, This ordinance shall take effect and be in force from and after its passage, approval and publication. C:H�IRM.0
