AVENUE, FROM T',E WEST PROP- ERTY LINE OF 12TH STREET TO THE EAST PROPERTY LINE OF 13TH STREET, IN THE CITY OF PADUCAH, KENTUCKY,FOR THE COST OF CONSTRUCTION OFA HARD SURFAuE ROAITIAY, CONSISTING OF A CONCRETE FOUNDATIOPI :JITH A SHEET ASPHALT TOP, AS SHOWN ON PLANS, TOGETHER WITH ALL NECESSARY MANHOLES, INTAKES, CATCH BASINS AND SEWER PIPE CONNECTIONS, EXCEPT THAT PORTION TO BE PAID FOR BY THE CITY OF PADUCAH, AND PROVIDING THAT SAID COST T' ?AY BE PAID IN TEN ANNUAL INSTALLMENTS IPI COLIPLIANCE SIITH THE KENTUCKY STATUTES APPLICABLE THERETO. 7,`HEREAS, the General Council of the Ciity of Paducah, Kentucky, has heretofore, to -wit; on may 5th, 1927, adopted an ordinance, entitled, "AN ORDI14ANCE PROVIDING FOR THE ILIFHOVEMENT OF 12TH STREET, FROM THE NORTH PROPERTY LINE OF TRIMBLE STREET TO THE NORTH PROPERTY LINE. OF BERNHEIN AVENUE; BERMHEIM AVENUE, FROM THE ;`TEST PROPERTY LINE OF 12TH STREET TO THE EAST PROPERTY LIME OF 13TH STREET, IN THE CITY OF PADUCAH, KENTUCKY; BY THF CONSTRUCTION OF A HtiRD SURFACE ROADFIAY, TOGETHER 1111TH ALL NECESSARY MANHOLES, INTAKES, 6ATCH BASINS AND SEWER PIPE CONNECTIONS, IN ACCOJJDAPJCE 'r7ITH THE PLANS AND SPECIFICATIONS PROVIDED THERFOR BY THE CITY ENGINEER AT THE COST OF THE ABUTTING PROPERTY OWNERS, AND PROVIDING THAT SUCH COST I. -AY BE PAID UNDER THE PROVISIONS OF THE TEN YEAR PAYBIENT PLAN;" and, 71HEREAS, it was provided in such ordinance that the cost of construction of said roadway, together with all necessary manholes, intakes, catch basins and sewer pipe connections be paid for by the abutting property owners on both sides of said streets, except that por- tion to be paid by the City of raducah as required by law; and, WHEREAS, pursuant to said ordinance a contract was entered into on the 28th day of June, 1927, between the Southern Roads Company, of Birmingham, Alabama, and the City of Paducah, Kentucky, for the construct ion of same; and, WHEREAS, said contract has been completed and dzly accepted by the General Council on the 6th day of September, 1927, pursuant to the I recommendationsof the Board of Public Works of said City, NOW, THEREFORE: I Be it ordained by the General Council of the City of PADUCAH, KENTUCKY: SECTION L. That all nroperty on both sides of 12th street, from the north property line of Trimble Street to the north property line of Bernheim Avenge; Bernheim Avenue, from the west property line of 12th Street to the east property line of 13th Street, in the City of Paducah, Kentucky, P No. 1015 be, and the same is, hereby assessed for the cost of construction of a hard surface roadway, consisting of a concrete foundation with a. sheet asphalt top, as shown on plans, together with all necessary manholes, intakes, catch basins and sewer pipe connections as follow-,: From the north property line of Trimble Street to the north property line of Bernheim Avenue, paving, per lineal foot..... $5.180025 From the west property line of 12th street to the east property line of 13th Street, paving, per lineal foot ............. $5.1200660, as particularly shown by the City Engineer's estimate of said cost filed and approved by the General Council of said City, and which will appear on file in the offices of the City Clerk and City Engineer, 11 respectively, and which are now referred to and made part hereof, i SECTION 2. That the funds derived from the assessment of said property lI shall be used for the purpose of paying; off the special tax bills issued against said property, or such bonds as may be issued by the 6 City of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes said I tax assessment may, at the option of the property owners, be payable in cash without interest within thirty days from the date of passage and publication of this ordinance, or in ten annual installments, provided the property owner within thirty days enters into a written agreement with said City, in accordance with the provisions of said Section 3101 of the Kentucky Statutes. SECTION 4. In order to provide the funds for the immediate payment of the cost of that portion of the special assessments herein provided for, which may be paid in the ten year installment plan, as hereinabove provided, the City of Paducah may issue and sell improvement bonds, and to secure the payment of such bonds, there is hereby pledged such taxes and liens on.the property assessed herein for the payment of principal and interest, but such bonds, shall not be sold for less than par, and the proceeds derived therefrom shall be applied ex- clusively to the payment of the cost of such construction as herein-, above provided; and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes.
