AN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON ROTA SIDES OF TENSIESSEE_ STREET PROM THE EAST PROPERTY LINE OF 3RD STREET TO THE 'NEST PROPERTY LINE OF SND -STREET; AND ON BOTH SIDES OF HIGH, STREET FROM THE NORTH PROPERTY LINE OF BHOQDNAY STREET TO THE SOUTH PROPERTY LINE OF JEFFERSON STREET; AND ON BOTH SIDE'S OF 15TH STREET FROM THE SOUTH PROPERTY LINE OF BYOAIWAY STREET TO THE NORTH PROPERTY LINE OF KENTUCKY AVENUE, IN 70E CI'PY OF PADUCAH, KENTUCKY, FOR THE COST OF CONSTRUCTION OF AWARD SURFACE ROADWAY, TOGETHER WITH CURBS AND GUTTERS AS SHOWN ON PLANS, AND ALSO WITH ALL NECESSARY MANHOLES, INTAKES, CATCH BASINS, DRIVEWAYS AND SEWER PIPE CONNECTIONS EXCEPT THAT PORTION TO BE PAID FOR BY THE CITY OF PADUCAH AS P.EQ IRED BY I I'. LACI, AND PROVIDING THAT SAID COST MAY BE PAID IN TEN ANNUAL INSTALL- MENTS IN ACCORDANCE WITH THE PROVISIONS OF THE .KENTUCKY STATUTES APPLICABLE THERETO. i WHEREAS, the General Council of the City of Paducah, Kentucky, has heretofore, to -wit; on the 28th day of March, 1927, adopted the following ordinances: (1). "AN ORDINANCE PPOVIDING FOR THE IMPROVEMENT OF TENNESSEE STREET, FROM THE EAST PROPERTY LINE OF 3RD STREET TO THE WEST PROPERTY LINE OF 2ND STREET, IN THE CITY OF PADUCAH;. KENTUCKY,. °Y THE CONSTRUCTION OF A HARD SURFACE ROADWAY, TOGETHER WITH ALL NECESSARY MANHOLES, INTAKES, CATCH BASINS, DRIVEWAYS AND SEWER PIPE CONNECTIONS, IN ACCORDANCE WITH THE PLANS LND SPECIFICATIONS PRO- VIDED THEREFOR BY THE CITY ENGINEER, AT THE COST OF THE ABUTTING PROPERTY OWNERS, AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION MAY BE PAID IN ACCORDANCE CiITH THE PROVISIONS OF THE TEN YEAR PAYMENT KLAN.'' (2). "AN ORDINANCE PROVIDING FOR THE IMPROV99ENT OF HIGH STREET FROM THE NORTH PROPERTY LINE OF BROADWAY STREET TO THE SOUTH PROPERTY LINE OF JEFFERSON STREET, IN THE CITY OF PADUCAH, KENTUCKY, BY THE CONSTRUCTION OF A HARD SURFACE ROADWAY, TOGETHER WITH ALL NECESSARY MANHOLES, INTAKES, CATCH BASINS, DRIVEWAYS AND SEWER PIPE CONNECTIONS, IN ACCORDANCE WITH THE PLANS AND SPECIFICATIONS PROVIDED THEREFOR BY THE CITY ENGINEER, AT THE COST OF THE ABUTTING PROPERTY OWNERS, AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION] MAY BE PAID IN ACCORDANCE WITH THE PROVISIONS OF THE TEN YEAR PAYMENT PLAN." (3). "AN ORDINANCE PROVIDING FOR THE IMPROVEMENT OF 15TH STREET FROM THE SOUTH PROPEITY LINE OF BROADWAY STREET TO THE NORTH PROPERTY LINE OF KENTUCKY AV4NUE, IN THE CIT:! OF PADUCAH; KENTUCKY, BY THE CONSTRUCTION OF A HARD SURFACE ROADWAY, TOGETHER WITH ALL NECESSARY MANHOLES, INTAKES, CATCH BASINS, DRIVEWAYS IND SEWER PIPE CONNECTIONS, AND ALSO CURBS AND GUTTERS OF FI'PHFR CONCRETE OR GRANITE, IN ACCORDANCE WITH TIE PLANS AND SPECIFICATIONS PROVIDED WHEREFOR BY THE CITY ENGINEER, AT THE COST OF THE ABUTTING PROPERTY OWNERS, AND No. 1006. PROVIDI1u THAI' THE CuST OF SUCH CONSTRUCTION MAY BE PAID IN ACCORDANCE WITH THE PROVISIONS OF THE TEN YEAR PAY1.4F.NT PLAN." and, I WHEREAS, it was provided in each of said ordinances that the cost of construction of said roadway, curbs and gutters, together with all necessary manholes, intakes, catch basins, driveways and sewer pipe connections be paid by the abutting property owners on each of said streets, except that portion to be paid by the City of raducah as re- quired by law; and, WHEREAS, pursuant to said ordinances a contract was entered into on the loth day of I,fayy', 1927, between the Southern Roads Company, Of Birmingham, Alabama, and the City of Paducah for the construction of same as provided in each of said ordinance; and, 'WHEREAS, said contract has been completed and duly accepted on the 15th day of August, 1927, nursuant to the recommendations of the Board of Public ',Jerks of said City; Noll!, THEREFORE, BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PAIUCAH, KENTUCKY. SECTION 1. I That all property on both sides of Tennessee Street from the iteast property line of 3rd Street to the west property line of 2nd Street and on High Street from the north property line of Broadway Street to they south property line of Jefferson Street; and on 15th Street from the south property line of Broadway Street to the north property line of Kentucky Avenue, in the City of Paducah, nentucky, be, and the sum s e i hereby assessed for the cost of construction of a hard surface roadway, to- gether with curbs and gutters as provided in said ordinances, as shown on plans, together with all necessary manholes, intakes, catch basins, I driveways and sewer pipe connections as follows: On Tennessee Street from the east line of 3rd Stro.et to the'We's.t line of 2nd Street, for paving 9e11-yneal foot.-.... ,, - •••••• .5,0286391. For curbs and gutters, per lineal foot...... .................. $0.68899433, as particularly shown by the City Engineer's estimate of -said cost filed and approved by the General Council of said City, and which will appear on file in the offices of the City Clerk and City Engineer, respectively, and which are now referred to and made part hereof. SECTION 2. That the funds derived from the assessment of said property No. 1007. shall ^e used ror the purpose of paying off the special tax bills issued against said property, or such bonds as may be issued by the City of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, said tax assessment may, at the option of the property owners, be payable in cash without interest within thirty days from the date of passage and publication of this Ordinance, or in ten annual install- ments, provided the property owners within thirty days enter into a written agreement with said City, in accordance with the provisions of said Section 3101 of the Kentucky Statutes. SECTION 4. In order to provide the funds for the immediate payment of the cost of that portion of the special assessments herein pro- vided for, which may be paid on the ten year installment plan, as hereinabove provided, the City of Paducah may issue and sell im- provement bonds, and to secure the payment of such bonds, there is hereby pledged such taxes and liens on the property assessed herein for the payment of principal and interest, but such bonds shall not be sold for less than par, and the proceeds derived therefrom shall be applied exclusively to the payment of the cost of such construc- tion as hereinabove provided; and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 0£ the Kentucky Statutes.
