STREET, IN THE CITY OF PADUCAH, KENTUCKY, AT THE COST OF TEE ABUTTING PRO-
PrRTY OWNERS, AND PROVIDING THAT SAME SHALL BE CONSTRUCTED UPON THE TEN
YEAR FAYNIENT PLAN.
BE IT ORDAINED BY THE BOARD OF 00I21ISS.IONERS OF THE CITY OF
PADUCAH, KEINTUCYY:
SECTION 1.
That Seventeenth Street, or Fountain Avenue, from the North
property line of Broadway Street to the South property line of Jefferson
Street, in the City of Paducah, Kentucky, be, and the same is hereby order
ed to be constructed with concrete, or any other improved paving material,
as may be determined by the Board of Commissioners as the best and most
economical material for the construction thereof, and that all necessary
manholes, catch basins, intakes and sewer pipe connections be made, upon
bids made therefor, and all to be done in strict accordance with the plans,
grades, specifications, widths and profiles prepared in the office of the
Commissioner of Public Works, all of which are adopted as a part of this
Ordinance, as fully as if embraced herein or attached hereto and made a

SS-rTION 2.

That said .York shall be constructed under the direction and
supervision of the Commissioner of Public �iorks, and shall be
commenced
at the time designated by contract for the performance of said :York, and
completed on or before December 10th, 1923.

SECTION 3.
The cost of such construction of said work shall be paid for
wholly by the property owners abutting or fronting thereon, to be apporJ
tioned to and assessed against the property and property owners abutting'
thereon, according to the number of abutting feet thereof, except that
the Paducah Railway Company, which owns a strip of Pround through the ce,rter
of said street twenty fee wide and abutting on both sides of said pro-
posed improvement, shall, by reason of its abutting on both sides of saiid
improvement, be assessed and pay one-half of the cost of said construe -
tion, and that the cost of paving such portion of said street so abutt-
ing -upon said strip of ground, which belongs to the Paducah Railway Com-
pany, shall be assessed apair.st said Paducah Railway Company, and a tax
shall be levied upon all the property, assets and franchises of said
Company in the City of Paducah for the payment thereof.
SECTION 4.
The Contractor awarded the contract for the York herein, shall'
be paid as provided in Sections 3096, 3100, 3101 and 3102 of the Ken-
tucky Statutes.
SMTION 5.
The Mayor is hereby authorized and directed to execute all
written contracts and bonds with the successful bidder for the con-
struction of said .improvement, as required by law.
Sx T ION 6.
Bids shall be received for the construction of said improve-
ment, accordingto the plans and specifications made and provided there-
for by the Commissioner of Public Works, and the contract therefor shalll
be awarded to the lowest and best bidder, except the richt is expressly
reserved to reject any ar.d all bids, within the discretion of the Board
of Commissioners, but they may accept any bid which is for the best
interest of the City of Paducah.
SECTION 7.
The Commissioner of Public ':Yorks is hereby given the right and
authority to advertise for bids for the construction of said improvement
but the manner of advertising and the time and place for receiving said
bids shall be designated by the Board of Commissioners.
