WHEREAS, all richt-of-way across private property, necessary
for the construction of sewers for Sub -Divisions A. and B. of Seger Dis-
trict Number Three, has been granted by the property owners for small
considerations, excepting the property owners hereinafter named; and.
WHEREAS, the hereinafter named property owners refuse to grant
to the City of Paducah right-of-way for said sewer construction for
considerations deemed reasonable by the Board of Commissioners; and,
WHEREAS, it :is deemed absolutely necessary and essential by the
Board of Commissioners that the hereinafter described property be con-
demned for the purpose of procuring a right-of-way for the construction
of the sewers for Sub -Divisions A. and B, of Seer District No. 3; NOW,
THEREFORE -
BE IT RESOLVED BY THE BOARD OF COI:II.IISSIONERS OF TAE CITY OF
PADUCAH, KENTUCKY:
SECTION 1.
That the following property, of the persons horeinafter set -out,
be condemned, as provided by law, for the purpose of procuring a right -
of way for the construction of sewers for Sub -Divisions A. ani B. of
Sever District Number Three, according to the plans which have been
approved and filed by the Board of Commissioners of the City of Paducah,
The owner of said property, the length of the right -of -wap over said
property, the interior diameter of said sewer, the depth of said sewer
on said property and the location of said property, are as follows, to -
wit:
"WM. M. HOPM-0 , ONNER. Lot on North Seventh Street, if
extended, between Burnett and Flournoy Streets. Right-of-
way 270 feet long, sewer 36 inches diameter and 9 feet deep."
"JOE LEAVISON, OWNER. Lot at Burnett and Seventh Street.
Right-of-way 130 feet long, sewer 36 inches diameter and
10 feet deep."
"JOHN W. HUBBARD , OWNER. Lot at Washington Street, if
extended, between 19th and 21st Street. Right-of-way
565 feet long, sewer 27 inches diameter, and 10 feet deep."
"CHAS. K. '✓HEELER AND MAMIE K. WHEELER, OWNER. Lots on
Clark Street, if extended, between 19th and 17th Streets.
Right of way 147 feet long, sewer 24 inches diameter, and
11 feet deep."
"M. A. TASCHNFR AID WIFE,C. TASCHNER, OWITER. Lot facing
on Broad Street and 247 feet East of Bridge Street and
extending from Broad Street to Island Creek Bank. Right-of-
way 175 feet long, server 12 inches diameter and 10 feet
deep."
SECTION 2.

The Commissioner of Public Works is hereby authorized to procure
if possible, from the property owners heroin -named, said right-of-way, sub
jest to the approval of the Board of Commissioners.
SECTION 3.
In the event said r itzht-of-way can not be procured by agreement
with the property owners, then the City Solicitor is hereby ordered,
directed and authorized to proceed to condemn any, or all of said property'
set -out herein for a richt-of-way for said sewers, as is provided by the
laws of the State of Kentucky.
SECTION 4.
This Resolution shall be in force and effect from and after its
passage, record ani publication.
