WHEREAS, The Board of Commissioners of the City of Paducah,
Kentucky, adopted an ordinance on February 23rd, 1923, dividing part
of Sub -Divisions A. , B. and C. , in Sewer District ITo. 3, into five
sewer zones for the purpose of constructing sewers therein, so as to
provide adequate sewers for the property owners within said zones;
and ,

SECTION 1.
That sanitary sewers be constructed and laid in Sewer Zone No.
3, in Sub -Divisions A. and B., Sewer Distr ict No. 3, in the City of
Paducah, Kentucky, as follows, to -wit:
"Commencing in "A" Street from :7heeler Avenue to
an alley between ,7heeler Avenuear,d Guthrie i,venue.

In Mayfield Road and Goebel Avenue :from "Jheeler Avenue
to :7orten Avenue.
In Tennessee Street from I'ayfield Road or Goebel Avenue
to a point 221 feet east of torten Avenue.
In Smithland Avenue from Baumer Avenue to Brakeman
Avenue.
In S''Iheeler Avenue from I'a}ffield Road to "B" Street.
In Guthrie Avenue from 1.7ayfield Road eastward to a
point 300 feet east of the I'syfield Road.
In Baumer Avenue from Brakeman Avenue to Goebel
Avnue or I.`ayfield Road.
In Wo'rten Avenue from Smithland Avenue to Goebel Avenue.
In Brakeman Avenue from Baumer Avenue to Smithland
Avenue
In 1.:ayfield Road from a point 300 feet south of the south
property line of Quarles Avenue to a point 300 feet north of
the north property line of Cedar Avenue.
Across private property from '7heeler Avenue and the
Mayfield Road to a point. 200 feet east of the Mayfield Road."
SECTION 2.
The construction of said sewers shall be done at the cost of the
bounding or abutting lots or parcels of ]and bounding or abutting upon the
streets, alleys &id hi�_nways in, under and alone which said sewers ;gill be
constructed, as provided in Section 3 hereof; and whenever said sewers are
constructed alono-, under and across private property, on account of it
being impractical to lay said sewers under and alono any of the streets in
said Zone, then the lots or parcels of ]and bounding or abutting upon said
sewers, which are constructed across said private property, is deemed also
to be benefitted thereby, and subject to the payment of the cost of the
construction of said sewers, as provided in Section 3 hereof.
SECTION 3.
The cost of constructing said sewers shall be apportioned equally,

on the abutting lots or parcels of land according to the abutting foot, aryl

shall be paid for by said abutting lots or parcels of ].and abutting or ILII
bounding upon the streets, hio-hways and alleys, and also the lots or par-
cels of land abutting or bounding upon the sewers constructed across pri-
vate property, provided t�-e cost of same does not exceed Two ($2.00)

Dollars per abutting foot; and, in the event the cost of said improvement

does exceed the sum of Two ('9'2.00) Dollars per abutting foot, then all of i
i
the lots or parcels of ground are hereby deemed to be the property bene-
fitted and the entire cost of the construction of said sewers shall be
assessed against each of said lots or parcels of ground embraced in said
Zone, according to the number of square feet contained in each lot or
parcel of ground, and the cost per square foot shall be apportioned accord
ing to the entire cost of the construction of said sewers, and said Board
of Commissioners shall fix, by ordinance, the amount of tax to be levied
upon the lots or parcels of land in said ;one, as provided by law.
SECTION 4.
The lots and parcels of ground, which are benefitted thereby,
and subject to the payment of the cost of said sewers, are embraced in

Brakeman Avenue and Baumer Avenue-, thence with the center
line of Baumer Avenue, in a westward direction, to a point
150 feet east of the intersection of the center line of
Baumer venue and the south property line of that part of
Smithland -venue north of Baurner Avenue; thence at right
angles southward 197 feet; thence at right angles west-
ward 189 feet; thence deflecting 107 degrees 13 minutes, to
the left, 140 feet; thence deflecting 84 degrees 53 minutes,

thence westward with the south property line of said alley

northward with the center of B Street to a point on the
center line of an alley, said point being 338 feet north of
the center line of i9heeler Avenue; thence at right angles
eastward with the center line of said.alley 396 feet to the
center of A Street; thence at right angles northward with
the center of A Street 21 feet; thence at right angles
eastward 193 feet to the center of an alley; thence at right
angles northward with the center of said alley 96 feet to a
point 59 feet south of the south property line of Gutrw ie
Avenue; thence at right angles eastward, parallel to Guthrie:
Avenue 163 feet, to the west property line of the I:'ayfield
Road; thence northward with the west property lines of the
Fay;field Road and Goebel Avenue 159 feet to a point 40 feet
north of the north property line of Guthrie Avenue; thence
at right angles westward 163 feet to the center of an alley;
thence at right angles northward with the center line of
the alley and said center line extended, 720 feet, more or
less, to the center line of Worten Avenue, if extended;
thence at right angles eastward along the center line of
"Worten Avenue, if extended, 203 feet to the east property
line of Goebel venue; thence at right angles rorthward
,ith the east property line of Goebel Avenue 126 feet to a
point 106 feet north of the north property line of Worten
Avenue-, thence deflecting 90 degrees 18 minutes, to the right
in an easterly direction and following the rear boundaries

SECTION 5.
Said sewers shall be constructed in strict accordance with the
plans, grades, specifications and profiles, as prepared by the Commission-
er of Public Works, and accepted by the Board of Commissioners.
SECTION G.
Bids shall be received :for the construction of said sewers,
according to the plans, specifications and pro"iles, and the contract
therefor shall be awarded to the lowest and best bidder, except the ri, t
is expressly reserved to reject any and all bids, within the discretion
of the Board of Commissioners, but they may accept any hid which is for
the hest :interest of the City of Faducah.
SECTION 7.
The Commissioner of Tublic 3orks is hereby given the right and
authority to advertise for bids for the construction of said sewers, but
the manner of advertisira and the time and place for receivir,p said bids,
shall be designated by the Board of Commissioners.
SECTION 8.
Said work shall be constructed under the direction and super-
vision of the Commissioner of Public Works or the authorized agent of

the City of Paducah, and shall commence And be completed at a time des-
ignated by contract.
SECTION 9. �
The Contractor awarded the contract for the work herein provided 1
for, shall be paid only from the funds arising from the special tax bills jl
and assessments made against the property located in said Sewer Zone, I
except that said Contractor may be paid out of such bonds as may be issued!
according to law, and as provided in Sections 3101, 3102 and 3105 Yen- i
tueky Statutes.
SECTION 10.
This Ordinance shall take effect and be in force ten days from
and after its passage
