OF SAME.
WHEREAS, The Board of Commissioners of the City of Paducah,
Kentucky, adopted an ordinance on Yebruary 23rd, 1923, dividing part o£
Sub -Divisions A. B. and C., in Sewer District No. 3, into five sever
zones for the purpose of constructing sewers therein, so as to provide
adequate sewers for the property owners within said zones; and,
WHEREAS, Said Board of Commissioners having adopted a resolu-
tion declaring the construction of said sewers in Sewer zone r42 a neces-
sity; NOW, THEREFORE -
BE IT ORDAINED BY THE BOARD OF CO1,7MISSIOITERS OF TH;,; CITY OF
PADUCAH, KENTUCKY:
That sanitary sewers be constructed and laid in Sewer Zone
No. 2, in Sub -Division B. Sewer District To. 3, in the City of Padu-
cah, Kentucky, as follows, to -wit:
"Commencing along the bank of Tennessee River
from Washington Street to a point 182 feet south of
Ohio Street, and from Tennessee Street to Elizabeth
Street, and along the west bank of Island Creek from
Elizabeth Street to 4th Street.
In Husbands Street, and Husbands Street if ex-
tended, from the 'Tennessee River to 12th Street.
In 12th Street from Husbands Street to Caldwell
Street.
In Caldwell Street, from a point 190 feet east
of Caldwell Avenue to a point 190 feet west of Cald-
well Avenue.

SECTION 2.
The Construction of said sewers shall be done at the cost of
the bounding or abutting lots or parcels of land bounding or abutting
upon the streets, alleys and highways, in, under and along which said
sewers will be constructed, as provided in Section 3 hereof; and when-
ever said sewers are constructed along, under and across private pro-
perty, on account of it being impractical to lay said sewers under and
along any of the streets in said _',one, then the lots or parcels of land
bounding_ or abutting upon said sewers, which are constructed across
said private property, is deemed also to be benefitted thereby, and sub
ject to the payment of the cost of the construction of said sewers, as
provided in Section 3 hereof.
SECTION 3.
The cost of constructing said sewers shall be apportioned
equally on the abutting lots or parcels of land, according to the abutt-
Ing foot, and shall be paid for by said abutting lots or parcels of
land abutting or bounding upon the streets, highways and alleys, and
also the lots or parcels of land abutting or bounding upon the sewers
constructed across private property, provided the cost of same does not
exceed Two (tip2.00) Dollars per abutting foot; and, in the event the cost
of said improvement does exceed the sum of Two (.22.00) Dollars per
abutting foot, then all of the lots or parcels of ground are hereby
deemed to be the property benefitted, and the entire cost of the con-
struction of said severs shall be assessed against each of said lots or
parcels of ground embraced in said Zone, according to the number of
square feet contained in each lot or parcel of ground, and the cost per
square foot shall be apportioned according to the entire cost of the
construction of said sewers, and said Board of Commissioners shall fix,
by ordinance, the amount of tax to be levied upon the lots or parcels of
land in said Zone, as provided by law.

Sewer Zone No. 2, which Sewer Zone is described as follows, to -wit:
"Beginning at a point in the center line of
Jones Street, if extended, and 76 feet and 6 inches
eastward from the center line of 2nd Street, if extended,
said point being the southeast corner of First Sewer Dis-
trict;, thence northward with the boundary line of First
Sewer District, and parallel to and 76 feet and 6 inches
from the center line of 2nd Street, if extended, a distance
of 423 feet to the center of Tennessee Street; thence at
right angles eastward and with the center line of Tennessee
Street and v✓ith the boundary of the First Sewer District,
93 feet and 2 inches, more or less, to the center of the
36 inch trunk line sever for Sub -Divisions B and C, of
Sewer District No. 3; thence, deflecting 96 degrees 54
minutes to the right, up the center line of said trunk line

SECTIOP} 5.
Said sewers shall. be constructed in strict accordance with the
plans, grades, specifications ai3 profiles, as prepared by the Commis-
sioner of Public Tdorks, and accepted by the Board of Commissioners.

Bids shall be received for the construction of said sewers,
according to the plans, specifications and profiles, and the contract
therefor shall be awarded to the lowest and best bidder, except the rig:
is expressly reserved to reject any and all bids, within the discretion
of the Board of Commissioners, but they may accept any bid which is for
the best interest of the City of Paducah.
SECTION 7.
Phe Commissioner of public 'forks is herebir given the right
authority to advertise for bids for the construction of said serer
the manner of advertising and the time and place for receiving saj
shall be desienated by the Board of Commissioners.
SECTION 8.
Said work shall be constructed under the direction and su

vision of the Commissioner of I'ublic 3orks, or the authorized aFre
the City of Paducah, and shall commence and be completed at a Litt
designated by contract.

The Contractor awarded the contract for the work herein provided

Icept that said Contractor may be paid out of such bonds as may he issued,
(according to law, and as provided in Sections 3101, 3102 and 3105 EentucYw
Statutes.
SECTION 10.
This Ordinance shall take effect and be in force ten (10) days
from and after its passave.
