's1HERE&S, the Board of Commissioners of the City of Paducah,
Kentucky, adopted an ordinance on February 23rd, 1923, dividing part
of Sub -Divisions A. B. and C., in Sewer District No. 3, into five sewer
zones for the purpose of constructing sewers therein, so as to provide
adequate sewers for the property owners within said zones; and,
WHEREAS, said Board of Commissioners having adopted a reso-
lution declaring the construction of said sewers in Sewer Zone No. 5 a

S:CTION 1.
That combined storm and sanitary sewers be constructed and
laid in Sewer Zone No. 4, in Sub -Divisions A. and B., Sewer District
3, in the City of l aducah , Y.en tucky, as folloa;s, to -wit:
"Commencing_ in Burnett Street from Trimble Street to
12th Street.
In Private property aloes; the trunk line serer from
12th and Burnett Streets to 10th and Flournoy Streets.
In 6th Street from Burnett Street to Trimble Street.
In 7th Street, and 7th Street if extended, from a
point 375 feet west of the center of Flournoy -Street to Cam-
pbell Street.
In 8th Street from Burnett Street to Trimble Street.
In an alley between 8th and 9th Streets from Boyd Street
to Harris Street.
In 9th Street, and 9th Street if extended, from a point

SECTION 2.
The construction of said sewers shall be done at the cost of
all the lots or parcels of land contained in said Zone, and as herein-
after provided in Section 3 hereof.
SECTION 3.
The Commissioner of Public Works, havins made'an approximate
estimate of the cost of construetinm said sewers along the streets, alleys
and property hereinbefore named, and his estimate havinn heretofore been
filed with the Board of Commissioners, andwhich shows that it will cost
the bounding or abutting property which abounds and abutts upon the
streets and alleys alonR, through and under which said sewers will be
constructed, a sum 'which will exceed Two (N2.00) Dollars per abutting
foot,- it is now, therefore, ordained by the Board of Commissioners that
all of the lots and parcels of land contained in Sewer Zone No. 5 are
deemed and declared to be the property ber:efitted by the construction of
said sewers, and each of said lots or parcels of Rround shall be assessed
for the payment of the cost of the construction of said sewers, according
to the number of square feet contair_ed in each lot and parcel of around,
and the cost per square foot shall be apportioned according; to the entire
cost of the construction of said sewers, and said Board of Commissioners
shall fix, btu ordinance, the amount of tax to be levied upon the lots or
parcels of around embraced in said .'.one on a square foot basis.
SECTION 4.
The lots and parcels of grnzr.d, which will be assessed by the
square foot, and which are benefitted thereby, are embraced in Zone No. 5,
which zone is described asfollows, to -wit:

14th Street and Trimble Street: thence southward with the
center line of 14th Street 203 feet 3 inches to the center
line of an alley; thence eastward with the center line of said
alley to the center line of 13th Street; thence northward with
the center lire of 13th Stree 203 feet 3 inches to the center
line of Trimble Street; thence eastward with the center lire
of Trimble Street to a point 203 feet 3 inches eastward from

SECTION 5.
Said sewers shall be constructed in strict accordance with the
plans, grades, specifications and profiles, as prepared by the Commission-
er of lublic .7orks, and accepted by the Board of Commissioners.

Bids shall be received for the construction of said sewers,
according to the plans, specifications, and profiles, and the contract
therefor shall be awarded to the lowest and best bidder, except the right
is expressly reserved to reject any and all bids, within the discretion
of the Board of Commissioners, but they may accept any bid which is for
the best interest of the City of Paducah.
SECTION 7.
The Commissioner of Public Works is hereby given the right and
authority to advertise for bids for the construction of said sewers, but

the manner of advertising and the time and place for receiving said bids,
shall be desip7;ated by the Board of Commissioners. j

Said work shall be constructed under the direction and super-
vision of the Commissioner of Public '•7orks or the authorized agents of
the City of Paducah, and shall commence and be completed at a time desig-
nated by contract.
SECT IOIT 9.
The Contractor awarded the contract for the work herein provided

for, shall be paid only from the funds arising from the special tax bills
and assessments made against the property located in said Sewer Zone,
except that said Contractor may be paid out of such bonds as may be
issued, according to law, and as provided in Sections 3101, 3102 and 310:
Kentucky Statutes.

This Ordinance shall take effect and be in force ten days from
