CITY OF PADUCAH., KENTUCKY, AT THE COST OF THE PROP RTY OWNERS THEREIN,
AID PROVIDING THAT SAID SEWERS SHALL BE CONSTRUCT:.,9 UPON THE TXN YEAR

WHEREAS, The Board of Commissioners of the City of Paducah,
Kentucky, adopted an ordinance on February 23rd, 1923, dividi.na pert of
9„r-Diviainns A_ R. and C.. in Sewer District No. 3, into five sewer
zones for the purpose of constructing sewers therein, so as to provide
adequate sewers for the property owners within said zones; and,
WHEREAS, said board of Commissioners havinn adopted a resolu-
tion declaring the construction of said sewers in Sewer Zone No. 1, a
necessity; VOW, THEREFORE -
BE IT ORDAINED BY THE BOARD OF COKEISSIONE RS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1.
That sanitary sewers be constructed and laid in Sewer Zone No.
1, in Sub -Division C., Seger District No. 3, in the City of Paducah,
Kentucky, as follows, to -wit:
"Commencing in Meyers Street from a point 435 feet
west of the west line of Farley Place to a point 440 feet
east of the east property line of Woodward Street.
In Clements Street from Meyers Street to Bridge
Street.
In Bridge Street from Clements Street to Vassuer
Street.
In Bridge Street from Vassuer Street southward to
Mill Street, or City Limits.
In Bridge Street from Clements Street to a point
166 feet north of the north property line of Jarrett
Street.
In Sowell Street from Ashbrook Avenue to Hays
Avenue.
In Powell Street from Ashbrook Avenue to Jarrett
Street.
In Yeiser Street, or Yeiser Street if extended, from
an alley between Ashcraft Avenue and Hays Avenue, to
Clements Street.
In Short Street from Clements Street to Farley Place.
In Ashcraft Avenue from Towell Street to Bridge Street.
In Hays Avenue from Yeiser Street to Bridge Street.
In Ashbrook Avenue from Yeiser Street to NridRe Street.
In Woodward Street from Meyers Street to Yeiser Street.
Ir. Farley Place from Meyers Street to Short Street.
In Jarrett Street from Yeiser Street, if extended, to
Bridge Street.

The construction of said sewers shall be done at the cost of the
bounding or abutting lots or parcels of land bounding or abutting upon the
streets, alleys and highways, in, under and along_ which said sewers will
bo constructed, as provided in Section 3 hereof; and whenever said sewers
Tare constructed alone, under and across private property, on account of it 1'
lbeing impractical to lay said sewers under and along any of the streets in
said Zone, then the lots or parcels of land bounding or abutting upon said
sewers, which are constructed across said private property, is deemed also
Ito be benefitted thereby, and subject to the payment of the cost of the
1construction of said sewers, as provided in Section 3 hereof
SECTION 3.
The cost of constructing said sewers shall be apportioned
equally on the abutting lots or parcels of land, according to the abutting
foot, and shall be paid for by said abutting lots or parcels of land,
abutting or bounding upon the streots,high:'✓ays and alleys, amd also the
lots or parcels of land abutting or bounding upon the sewers constructed
across private property, provided the cost of same does not exceed Two
(x2.00) Dollars per abutting foot; and, in the event the cost of said im-
provement does exceed the sum of Two (12.00) Dollars per abutting foot,
then all of the lots or parcels of around are hereby deemed to be the j
property benefitted, and the entire cost of the construction of said sewers
shall be assessed against each of said lots or parcels of ground embraced
in said Zone, according_ to the number of square feet contained in each lot
or parcel of ground, and the cost per square foot shall be apportioned
according to the entire cost of the construction of said sewers, and said
Board of Commissioners shall fix, by ordinance, the amount of tax to be
levied upon the lots or parcels of land in said Zone, as provided by law. j

SECTION 4.
The lots and parcels of ground, which are benefitted thereby, and'
subject to the payment of the cost of said sewers, are embraced in Sewer
Zone No. 1, which Sewer Zone is described as follows, to -.:pit: j
"Beginning at a point on the center line of Bridge
Street 166 feet north of the intersection of said center
line with the north property line of Jarrett Street-,
thence along the bank of Island Creek eastward 769 feet,
more or less, to a point on the center line of an alley,
said point being 150 feet north of the north property
line of Jarrett Street, measured alone the center line
of sail alley; thence eastward along the bank of Island
Creek to a point on the west property line of Jarrett
Street 130 feet northward from the center line of
Powell. Street, if extended; thence northward along

thence at right angles northward 415.5 feet, crossing
Meyers Street at an angle of 90 degrees; thence at right
angles eastward, parallel to and 200 *.eet north of the
north property line of Deyers Street to the east property
line of Farley Place, if extended; thence at right angles
southward a distance of 4 feet-, thence at r:i7ht angles
eastward. parallel to 1.1eyers Street to the east property
line of Clements Street, if extended; thence at right
angles southward a distance of 13.5 feet; thence at right
angles eastward, parallel to and 200 feet north of the
north property line of I::eyers Street to a point 380 feet
eastwardly from the east property line of Woodward Street,
if extended; thence at right angles southward 233 feet to
the south property line of I:?eyers Street; thence at xiRnt
angles eastward with the south property line of I'eyers
Street 60 feet; thence at right angles southward 200 feet;
thence at right angles westward, parallel to I:?eyers Street,
307 feet to a point 133 feet from the east property line
of 71oodward Street; thence at rizrht angles southward,
parallel to Woodward Street 597 feet to a point 160 -Feet
northward from the north property line of Yeiser Street;
thence at richt angles eastward, parallel to Yeiser Street
589 feet to the center line, if extended, of an alley
between Hays and Ashcraft Avenues; thence at right angles
southward along the center line of said alley to the north
property line of Fowell Street; thence at right angles
eastward along said north property line of Powell Street
to a point 175.5 feet eastward from the center line of
Ashcraft avenue, said 175.5 feet being measured along the
north property line of Towell Street; thence at right
angles southward on a line parallel to and 175.5 feet
from the center line of Ashcraft Avenue to a point 160
feet eastward from the center line of Bridge Street, said
160 feet being measured at right anL•les to Bridge Street;
thence southward along a line 160 feet from the center
line of Bridge Street,said line conforming to the tLrns in
Bridge Street and remaining at all points 160 feet from
said center line of Bridge Street, to the line of the
corporate limits of the City of Paducah; thence southward
along the line of the City Limits of the City of Paducah,
to the center line of Bridge Street; thence northward,
along the center line of Bridge Street, 200 feet; thence
westward at ri.it angles to Bridge Street 160 feet; thence
northward along a line 160 feet from the center line of
Bridge Street, said line conforming to the turns of
Bridge Street and remaining at all points 160 feet from
said center line of Bridge Street, to a point 166 feet
northward from the north property line of Jarrett Street,
if extem9-ed, said 166 feet measured parallel to Bridge
Street; thence at right angles eastward 160 feet, to the
point of beginning."

from the north property line of Meyers Street, said
point being; on the line of the City Limits of the
City of Paducah; thence southward along the said City
Limits line and said east property line of fill. Street,

line of I.T.eyers Street; thence westward, parallel to and
200 feet from the south property line of Meyers Street
to a point 770 feet eastward from the east property line

Said sewers shall be constructed in strict accordance with the
plans, grades, specifications and profiles, as propared by the Commission
er of Public '.Yorks, and accepted by the Board of Commissioners.
SECTION G.
Bids shall be received for tho construction of said sewers,

according: to the plans, specifications and profiles, and the contract
therefor shall be awarded to the lowest and best bidder, except the right j
is expressly reserved to reject any and all bids, within the discretion
of the Board of Commissioners, but they may accept any bid which is for i
the best interest of the City of Paducah.
SECTION 7.
The Commissioner of Public Works is hereby given the right and
authority to advertise for bids for the construction of said sewers, but
the manner of advertising and the time and place for receiving said bids,
shall be designated by the Board of Commissioners.

Said work shall be constructed under the direction and super-
vision of the Commissioner of Public 'Yorks, or the authorized agent of
the City of Paducah, and shall commence and be completed at a time des-
ignated by contract.
SECTION 9.
The Contractor awarded the contract :for the work herein provid- ;
ed for, shall be paid only from the funds arising from the special tax

bills and assessments made against the property located in said Sewer
Zone, except that said Contractor may he paid out of such bonds as may
be issued, according to law, and as provided in Sections 3101, 3102 and
i
3105 Kentucky Statutes.
SECTION 10.
I
This Ordinance shall take effect and be in force ten (10) days
from and after its psssag•e.
