CAH, YalTUCKY:
SECTION 1.
The Chicago, St. Louis and ITew Orleans Railroad Company is hereby
Prantod permission to raise that portion of its river fr)nt track lying
between the north property lira: of I:^onroe Street and a point approxi-
mately 175 feet north of. the north property line of Broad':aay Street frotr
its present grade of 91.5 foot at the lowest point onthe top of rail II

at the intersection of First and Jefferson Streets to a new olevation of
95 feet at this same point, continuing thence in each direction on suitabloi
gradients to'a connection with grade of existing. track. Also the richt to
construct, maintain and operate a now siding in First Street end across
Jefferson Street to serve the International Shoe Company's plant located
at the corner of First and Jefferson Streets, said siding to begin at a
point in the river front track about 200 feet north of Jefferson Street

and extending thence to the north property line of the public alley in
j Block No. 5, Addition A., between Broadway and Jefferson Streets, and
shall raise Jefferson Street from Second Street to a point on the east
line of First Street to uniform grade from an elevation of 97 feet at
Second Street to an elevation of 95 feet at a point 18 feet west of the
east property line of Pirst Street, also the right to raise the roadway j

in First Street, except the east 18 feet, which shall remain at its present
grade, between the north line of Jefferson Street and a lint approximately
175 feet north of the north line of Broadway Street, to the new elevation
of said river front track.
SECTION 2.
The cost of raising river front track and making the necessary
changes in the grade of streets, together with the cost of constructing sa
siding shall be paid by the Chicago, St. Louis and Ilew Orleans Railroad
Company or the International Shoe Corrg)any as they may mutin.11y agree.
SECTION 5.
Said spur track siding, constructed for the .International Shoe Com-
pany, shall conform to and be maintained at the new grade of said streets

and sidewalks as far as practical and shall, at ell times, be kept and
maintained in good repair.
SECTION 4.
. Said Railroad Company shall raise or construct to the new grades
of the Streets, as set out herein, two catch basins and one fire hydrant,
located on Jefferson Street near First Street at the expense of said Rail-
road Company,
SECTION 5.
There shall be constructed a wearing surface of gravel not less
than 12 inches in depth on all streets brought up to new street grade,
all to be done .free of cost to the City of Paducah, Kentucky, iprovided no
excavat-ion'wiil be required in order to make 12 inches wearing surface of
❑ew gavel.

Said Railroad Company shall indemnify and save harmless the
City of Paducah, Kentucky, against all damages which may be legally re-
covered against the said City by any person or corporation on account
of granting said richt-of-way, and the construction herein set -out, or
by the operation of said railroad thereon.
STICTION 7.
This Ordinance shall take effect and be in force ten (10) days
from and after its passage, record andA t'
